July 6, 1999 The meeting of the Planning Commission of Franklin Township, held in the Township office, was called to order at 2000 hours. Present were Dwight Miller, Ralph Breiding, Hugh Crandall, Duane Davis, and Jim Pfadt. MINUTES Breiding moved to accept the minutes of 6/1/99 as presented. Crandall seconded. Carried. Joe Szymanowicz arrived at 2004 hours. VISITORS Duane Davis/Craig Pieper Sketch Plan - Mr. Pieper owns a 43+-acre parcel on Eureka and a 10-acre parcel that adjoins it at 10145 Eureka. The ten-acre parcel has his home and outbuildings on it. Mr. Davis is purchasing 25 acres from the 43-acre parcel. The lot has 399 ft. of frontage and is 2,739 ft. deep. The remaining 18 acres is located behind Mr. Pieper's 10-acre parcel and has no frontage on Eureka. Crandall - the rear parcel should be joined to the existing 10-acre parcel or have a 50 ft. right-of-way to it from Eureka. Szymanowicz - remember that buildings have to be so many feet from the property lines. Davis - we plan on building a house but we'll have to see how septic approval goes. Crandall moved to accept the Davis/Pieper sketch plan as presented with the condition that the remaining property is made accessible to the road by either a right-of-way or by combining it with the front 10-acre parcel. Miller seconded. Carried. Jim Pfadt Variance Request - Mr. Pfadt, 11986 Silverthorn, has an existing pole building that is right on the front yard set back line. He would like to attach a 14' carport to it for his RV and feels that he would need a variance to do so. Crandall - would the carport be on a foundation? Pfadt - no, just posts in the ground and a roof, no sides. I can't put it on the rear of the building because my septic system is there and I don't want to cover it. Breiding - the carport becomes part of a permanent structure. Discussion on how best to build the carport and avoid a variance. Szymanowicz - it's considered a permanent structure and you will be taxed on it. It may be easier to move the building location instead of requesting a variance. Pfadt - I could put it on the north side but would need a new driveway. I just need a roof over the RV. It has a cover over it now. I'll ask for a variance and see if they'll allow it, otherwise I will keep it covered. Szymanowicz - I'd look into some temporary type of cover. Pfadt - I did look into it and it would cost me more than I'd have in the carport. Crandall - if they put in a stipulation that it goes when the RV goes, they may approve it. Mr. Pfadt left the meeting at 2045 hours. Dennis Howard Mylar - Mr. Howard is subdividing a 10-acre lot from a 63-acre parcel that fronts on Route 98 and Falls Road. The 10-acre lot is for his daughter. Discussion on the proposed house and septic site. Szymanowicz - there is no problem with the Mylar but the surveyor didn't show all the existing and remaining frontages. He should take the Mylar back and complete it. Szymanowicz moved to return the Howard Mylar for revisions because it doesn't show the parent parcel with it's remaining frontage and there is no 75 ft. setback line (50 ft. building line is shown). Breiding seconded. Carried. Breiding - Mylar's should be right when they come through here. We shouldn't have to try to figure out what is going on. Miller - the Mylar does not include the requirements of Section 702.3D of the Subdivision Ordinance. OLD BUSINESS None. NEW BUSINESS Adopt New Erie County Subdivision Ordinance - Joe reported that he didn't see anything in it that was objectionable. The other members are still reviewing the ordinance.
