February 6, 2007 The meeting of the Planning Commission of Franklin Township, held in the Township office, was called to order at 1900 hours. Present were Hugh Crandall, Dwight Miller, Dennis Howard and Joe Szymanowicz. VISITORS/PUBLIC COMMENT No visitors were present. MINUTES Howard moved to approve the minutes of 1/2/07 as presented. Szymanowicz seconded. Carried. OLD BUSINESS Zoning Ordinance Amendment/Storage Trailers, Ground-Level Storage – on hold. NEW BUSINESS Terry and Nancy Rea SFTF – M/M Rea purchased property on the northwest corner of Mohawk and Clair Wright and has applied for a permit from DEP to install a small flow treatment facility. The paperwork was reviewed. Crandall moved to accept the Rea SFTF paperwork as presented. Miller seconded. Carried. Wetland Deed Restrictions – a letter was received from the Erie County Conservation District saying that all subdivisions will be required to also have a PASPGP-3, a federal Clean Water Act, Section 404 Permit. The letter states that, “as of July 1, 2007, any activity either constructing or expanding a residential, commercial, or institutional subdivision or development, where greater than 0.25 acres of wetland, in addition to those being impacted by the proposed project, are located on the property boundary, the application should include a proposed deed restriction, conservation easement, or deed restricted to open space area, that protects such wetland from activities such as filling, draining, mowing, placement of structures, cutting of vegetation, clearing or plowing of natural vegetation. If a deed restriction is not included within the application, federal authorization would need to be obtained through separate review by the Army Corp of Engineers.” Discussion was held on the additional cost for a subdivision that this regulation will create. Nuisance Ordinance Rewrite – the draft from the January meeting was presented and reviewed. Szymanowicz moved to approve the draft and forward it to the Board of Supervisors. Crandall seconded.
