January 4, 1993 The organizational meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek at 0900 hours with the Pledge of Allegiance. Present were Sitek, Herbert Netzler and David Henderson. The Attorney was excused. ORGANIZATIONAL AGENDA APPOINTMENTS: Temporary Chairman - Henderson moved to appoint Ben Sitek, Netzler seconded. Carried. Temporary Secretary - Henderson moved to appoint Bonnie Bernhardt, Netzler seconded. Carried. Chairman - Sitek moved to appoint Herbert Netzler, Henderson seconded. Carried. Vice Chairman - Henderson moved to appoint Ben Sitek, Netzler seconded. Carried. Secretary/Treasurer - Netzler moved to appoint Bonnie Bernhardt, Henderson seconded. Carried. Vacancy Board - Henderson moved to appoint Paul Sachar, Sitek seconded. Carried. Solicitor - Henderson moved to appoint Schroeck and Associates, Sitek seconded. Carried. Secretary/Planning Commission and Zoning Hearing Board - Henderson moved to appoint Bonnie Bernhardt, Sitek seconded. Carried. Act 511 Tax Collector - Henderson moved to appoint June Suhy, Sitek seconded. Carried. Zoning Administrator - Henderson moved to appoint Bonnie Bernhardt, Netzler seconded. Carried. Henderson pointed out that M.D.I.A. will not act as zoning administrator, they will issue permits only. Planning Commission - Netzler moved to appoint Gary Kulich and Hugh Crandall, Sitek seconded. Carried. Zoning Hearing Board - Sitek moved to appoint Joe Szymanowicz, Netzler seconded. Carried. Executive Board/E.C.A.T.O. - Netzler moved to appoint Ben Sitek as delegate, Dave Henderson as first alternate and Herb Netzler as second alternate, Henderson seconded. Carried. State Convention Delegate - Netzler moved to appoint David Henderson, Henderson seconded. Carried. Roadmaster - Sitek moved to appoint David Henderson, Netzler seconded. Carried. Equipment Operators and Laborers - Sitek moved to approve Richard Gould, Benjamin Sitek, Herbert Netzler, David Henderson, John Conrad, John Sachar, Wayne Cousins, Edward Warhola, Raymond Swift, Dennis Swift, Daniel Swift and Duane Taylor as equipment operators and laborers and as temporary drivers and substitutes, Netzler seconded. Carried. Temporary Equipment Operators and Laborers - Netzler moved to approve the same list as above for temporary operators and laborers, Henderson seconded. Carried. Representative to Northwest PA Regional Planning and Development Commission - Will ask for a volunteer from the Planning Commission. C.P.A. Firm Appointment - Henderson moved to appoint Monahan and Monahan to audit the 1993 books, Sitek seconded. Carried. COMPENSATION AND MILEAGE RATES: Recommend to Auditors/Mileage Rate - Henderson moved to recommend 26 cents (.26), Netzler seconded. Carried. Wages/Roadmaster - Henderson moved to recommend to the auditors a 4% cost of living increase for the Roadmaster (.40) and Supervisor/Laborers (.34), Sitek seconded. Carried. Henderson added that he and Rick Gould would like to put some of their increase into a State managed disability insurance package (approximately $300/yr.). The money would come from a payroll deduction. The employees would have to join the plan in the Township's name. Sitek moved to establish a payroll deduction plan for disability insurance for Dave Henderson and Richard Gould, Netzler seconded. Carried. Wages/Laborers and Equipment Operators - Henderson moved to give the laborers and equipment operators a 4% cost of living increase (.30). Wage rate to be $7.56/hr. Netzler seconded. Carried. Zoning Administrator - Henderson moved to pay the zoning administrator $7.56/hr., Sitek seconded. Carried. Secretary/Treasurer - Henderson moved to pay the secretary/treasurer $7.56/hr., Sitek seconded. Carried. Act 511 Tax Collector - Henderson moved to pay the Act 511 tax collector 4% of taxes collected plus expenses, Sitek seconded. Carried. Compensation for selling garbage bags/Suhy and Walter - Netzler moved to pay Suhy and Walter five cents (.05) per bag sold, Henderson seconded. Carried. OTHER Roadmaster Duties - Netzler moved that the Roadmaster duties follow the Second Class Township code and as determined by the Board of Supervisors, Sitek seconded. Carried. Duties/Other Employees - Netzler moved that the other employees duties will remain the same and as determined by the Roadmaster and the Board of Supervisors, Henderson seconded. Carried. Meeting Dates and Times - Henderson moved to hold meetings on the second Tuesday of each month at 8 p.m., and on the fourth Thursday of each month at 9 a.m. in the township office. Meetings will be moved to the F.T.V.F.D. social hall in case of an overflow crowd. The 1994 organizational meeting will be held on January 3, 1994 in the Township office at 9 a.m. Budget sessions will be held on November 15 and 18 at 9 a.m. in the township office. The November fourth Thursday meeting will be moved to November 19 because of Thanksgiving, Sitek seconded. Carried. Office Hours - Netzler moved to hold office hours on Tuesdays and Thursdays from 8 a.m. to 12 p.m. and from 1 p.m. to 4 p.m., Henderson seconded. Carried. Recommend Treasurer Bond Limit - Henderson moved to recommend $100,000 to the auditors, Sitek seconded. Carried. Depository for Township Funds - Henderson moved to approve Marine Bank and P.L.G.I.T. as the depositories for Township funds, Sitek seconded. Carried. Review procedures for selling garbage bags and review price - Henderson moved to charge $1.50/bag for 1993 and 1994 until a new contract is negotiated, Netzler seconded. Carried. Approve advertising for bids - Sitek moved to advertise for gas and diesel fuel bids for 1993 and anything else that needs to be bid throughout the year, Netzler seconded. Carried. Review charges for ordinances, etc. - Henderson moved to charge $6.50 for ordinance books, Sitek seconded. Carried. Review schedule of fees for Highway Occupancy permits - Henderson moved to charge $35 installation fee/no permit required for replacing an existing pipe; state road - $35 installation fee/no permit for new pipe; state roads and township roads for replacement pipes - $35/install 20' pipe, $52.50/install 30' pipe, $70/install 40' pipe; new pipe on township roads - $25/permit $10/installation of 20' pipe, $25/permit $27.50/installation of 30' pipe, $25/permit $45/installation of 40' pipe, Sitek seconded. Carried. Custodian of Petty Cash - Henderson moved to appoint Bonnie Bernhardt, Sitek seconded. Carried. Attendance at schools, as pertains to duties - Henderson moved to allow attendance at schools according to the Second Class Township code, Netzler seconded. Carried. MINUTES Sitek moved to approve the minutes of December 24, 1992 as presented, Henderson seconded. Carried. VISITORS None present. REPORTS Superintendent - Henderson reported that the crew is on full time again. Beute and Bliley has increased cinder deliveries. He will try to get 20 loads delivered in March so a supply will be on hand for winter. J.C.B. - nothing. Zessinger Pit Operator Bid - Henderson said the Board could accept Hoover's bid or wait until spring but he didn't think we would get a better offer. Netzler - said he thought Mayer Bros. were interested but that it was a bad time of year for them, they go to Florida. He suggested waiting until March to award the contract. Sitek - said he would like to see some of the money received go into the permanent improvement fund. Henderson - I don't want to wait 3 months if they're not interested. They never showed interest when the proposals were sent to them. I don't want to dilly dally much longer or things won't be in place in 1994. We've wasted 6 months now. I don't mind waiting until the January 28th meeting and send them a letter and find out their intent. Herb will talk to them and Bonnie is to send a letter to the Erie office. FINANCIAL Bills - Henderson moved to pay the bills as listed excluding Anderson Equipment, PA One Call and Edinboro E.I.T. totaling $1,773.18. Sitek seconded. Carried. Payroll - Sitek moved to approve payroll #26-92. Henderson seconded. Carried. Renkis E.I.T. - nothing. PLANNING COMMISSION Nothing. SOLICITOR Nothing. OLD BUSINESS Sesquicentennial - nothing. Clean Up - nothing. Boy Scout Grant - Bain will work on required information. PennDOT Letter - not sent yet. Workers Comp. Report - Sitek asked if we were going to have Wagner talk to the fire department. Henderson recommended sending the department a letter suggesting holding safety seminars on a quarterly basis with the dept. and the township participating in an effort to make us all more safety conscious. Wagner or Erie Insurance could provide safety awareness material. If more specific information is needed, an instructor could be hired. Netzler said the first seminar should be free and mentioned that Wagner is an independent expert who is not trying to sell anyone insurance. Henderson moved to send the fire department a letter concerning safety seminars. Sitek seconded. Carried. NEW BUSINESS Fire Police List for 1993 - Netzler moved to approve Jim Barrett, Sr., Rick Adams, Sr., June Suhy, Sara Hollobaugh and Dan Swift as fire police for 1993. Sitek seconded. Carried. Netzler said that the department has made some changes to "tighten up their act." Henderson said he thought the whole active roster was to be approved as fire police. Discussion on the law. Dave said that the law says you can appoint a private citizen as fire police in an emergency but fire personnel not previously sworn in as fire police are not to be used in that capacity in an emergency. Herb disagreed. B.F.I. Billing - some residents with an R..D. #2, Girard address are being billed for services that they did not receive or sign up for. Sitek said if he got such a bill he would throw it away. Dave said that some people would think they owed the money and pay it. Herb added that he thinks what BFI is doing is fraud. Netzler said that we have an exclusive contract with Waste Management in this township and that they could come back on us because of the private haulers collecting in the township. Discussion on damage done to the roads by the garbage trucks. Netzler moved to send the Girard residents a letter telling them not to pay the bills from BFI. Sitek seconded. Motion voted down. Contract with Waste Management was reviewed. Netzler moved to have the Attorney research the Waste Management contract, the Erie Solid Waste act and the State law on the legality of our contract with Waste Management. Also, can we have curb side pickup hauling separate from our present contract. If we know that there are curb side pick up haulers, what is the Board's legal position in light of our contract with Waste Management. Can we tell other companies that they cannot come into the township. What happens if we do nothing. Sitek seconded. Carried. Solicitor Meeting Schedule - Henderson moved that due to a reduction in the 1993 budget for solicitor fees, the Township will arrange to have the solicitor come to the Thursday morning meetings only. Attendance at the Tuesday evening meeting is on an at request only basis or if an emergency occurs. Written interim reports are to be supplied for the Tuesday meeting on request of the Board.
