February 9, 1993 The meeting of the Supervisors of Franklin Township, held in the township office, was called to order by Chairman Herbert Netzler at 2003 hours. Present were Netzler, Benjamin Sitek, David Henderson, Pat Platz, Hugh Crandall, Greg Soltys, Gary Kulich, Clarence Mischler, Daniel Parker and George Antolik. MINUTES The minutes of January 28, 1993 were approved as presented in a motion by Sitek and second by Henderson. Carried. VISITORS Clarence Mischler - questioned whether Steve Simon is paying taxes in Franklin or Fairview township. Netzler will check with the Assessment office. REPORTS Superintendent - Henderson reported that roads were cindered and brined, building was cleaned up, brakes were put on the Oshkosh. Parts are no longer available for the Hough. If the steering knuckles fail, will switch the steering axle back from the other Hough and check with Langner for parts. J.C.B. - All but the labor and travel expense was covered by J.C.B., expense owed is $525.75. Letter to PennDOT - Henderson and the secretary will compose a letter to Don Dolecki. Logging on Francis - Dave will check on who is hauling logs. FINANCES AND TAXES Bills - Dave moved to pay the bills as listed including the E.I.T. claims and quarterly advances, excluding PA One Call, totaling $5,011.67 general fund and 1,810.58 EIT claims. Ben seconded. Carried. Payroll - none to sign. Renkis Report - nothing yet. F.D. Fund, Workers Comp. - Dave reported that the workers comp. premiums are not to be paid from the Fire Dept. Fund. Money must come from the general fund. Next year we can reduce the millage to the fire dept. and increase millage to the general fund. Computer Update - Dave said the budget has $1,000 for updating the computer system. He feels we can buy new, sell the old and the cost would be less than upgrading. Dave recommended buying new and will get figures for the next meeting. PLANNING, ZONING AND HEALTH DEPARTMENT P.C. Report - P.C. members asked if another member could be added, they have trouble making a quorum. Netzler said they should add two if more are added. Dave feels it would be harder to make a quorum with more members. Soltys asked about staying at five members and adding one as an alternate. Will check the legality of an alternate. P.C. Chairman - Crandall reported that no one feels they have enough time to be chairman. As the township grows, more field work will need to be done, more important decisions made. Netzler said all the chairman does is run meetings, M.D.I.A. does the field work. Henderson added that according to Act 247, the chairman only runs the meeting. Platz asked about violations. M.D.I.A handles those. Dave added that the Township did not adopt electrical codes so no letter needs to be sent to the electric companies serving the Township. Crandall asked if the Commission could work with M.D.I.A. as far as expansion goes. Henderson said that was the Planning Commission's job. Sitek said he doesn't think it's the Supervisors job to check on violators. He feels M.D.I.A. should travel the Township once a month to check on violations. Any complaints from residents should be reported to the Township office, it then goes to the Supervisors and then is forwarded to M.D.I.A. Antolik Subdivision and Road - Pat Platz said he sees this as a major subdivision according to the zoning ordinance. Sitek - who makes the decision on a major or minor. Henderson - what's the end resulting difference. Soltys - we are concerned with a high residential density in a rural A-1 zone. Antolik - all lots there now are according to A-1 regulations. Soltys - I disagree. It's not very low density according to this zoning ordinance. Netzler - it's not up to anyone in this room to deny a person from doing with his ground what he purchased it for originally. Sitek - what did Antolik buy the land for originally. Crandall - the Township doesn't need to take over the road, it can remain a private road. Henderson - what is the advantage to us or the developer with a major or minor subdivision. Crandall - it's cheaper for a minor, there are no plot plans, no new roads required. Henderson - if it's a major, what does Antolik have to do. Crandall - he has to come up with an extensive plot plan showing curbs, streets etc. Netzler - that doesn't need to be done to be built on. Crandall - what's needed for a minor is an existing road. Netzler - if so many people in the subdivision petitions the court, the Township must take over the road. The Township must be careful how any agreement is written. Crandall - a minor can't be created on a private drive, it must be on an existing road. Platz - we as a planning commission can not approve his plans for a minor subdivision when it's located on a private road. Soltys - do you feel you're talking very low density with that road. Henderson - it agrees with the way the ordinance is written, two acre minimum with 250' frontage. Netzler moved to have the Attorney look into whether George Antolik's Western Trails subdivision is a major or minor subdivision and whether it constitutes very low density. Henderson seconded. Carried. Henderson - as far as density of homes is concerned, his lots meet A-1 zoning. If he cuts smaller lots, he would have to rezone. Discussion on water and sewage capacity in that area. Crandall - the Health Dept. thinks there will only be four houses going in on this property. It may end up with many houses. Soltys - I have no problem with two acre lots on an existing road. I have a problem when you start cutting a new road. It doesn't conform with the intent of the ordinance for very low density. Solicitor's Letter to D.E.R./Antolik's Sewage Modules - letter was reviewed. Henderson moved to send the letter to DER. Sitek seconded. Carried. Amendment to Zoning Law - reviewed the proposed changes. Henderson moved to advertise the amendment changes when appropriate. Sitek seconded. Carried. The Attorney will write and place the ad. Wagner Request - the Planning Commission recommended Mr. Wagner ask for a variance or put his mobile home on his A-1 zoned property. A residence is not listed as a conditional use on B-1 zoned property. Herb added that he could run his septic and well lines from his A-1 land and hook into the existing well and septic on the B-1 land. Antolik Road - Netzler moved to have the Attorney draw up an agreement, run it by M.D.I.A. and get it approved by the Supervisors, George Antolik and M.D.I.A. Henderson seconded. Carried. Netzler - I agree with the Planning Commission if putting in a road makes this a major subdivision and if it is contrary to very low density for an A-1 zone. Discussion. Antolik - when bonding is done or money is put in escrow means the road is to be turned over. When the supervisors sign the agreement, the Supervisors agree to take over the road for dedication. Roads in other subdivisions in surrounding townships were dedicated as soon as topsoil was moved. Henderson - if George builds his road and it turns out to be a major subdivision, what's the difference in the end. SOLICITOR M.D.I.A. - nothing. Cable Television - nothing. Szymanowicz Complaint - nothing. Garbage/BFI - will discuss at Feb. 25th meeting. F.T.V.F.D. Fire Police - being sworn in. Load Limits Ordinance - nothing. Kulich Conflict of Interest - the Attorney's opinion is that as an adjoining property owner, Gary has no conflict as long as he votes in accordance with the zoning ordinance and keeps an open mind. The fact of being a neighbor isn't a conflict. Kulich added that the problem may be with someone not liking his vote. He said he didn't want the Planning Commission or the Township to get called on a technicality because of his vote. The Planning Commission has always looked out for the Township residents, the taxpayers have always taken precedence. OLD BUSINESS Sesquicentennial - nothing. Boy Scouts - nothing. Ferrick/McKean Twp. - nothing. F.T.V.F.D./Safety Seminars - nothing. Clean Up/Town Hall, Corner of W. Stancliff and Eureka - Sitek moved to send a certified letter to Claybro Development Co. giving them until May 1, 1993 to clean up their corner at W. Stancliff and Eureka advising them that if it is not done the Township will do the work and bill them. Henderson seconded. Carried. Sitek moved to send a certified letter to Florence Chivari, owner and Steve Chivari, Jr., caretaker giving them thirty days from receipt of letter to clean up the grounds and secure the old town hall building in Franklin Center advising them that if it is not done the Township will do the work and bill them. Henderson seconded. Carried. Roof Leaks - Dave reported that repairs were made today. The eaves need to be painted. Estimated life of the roof is five more years, eight years maximum. He suggested considering using municipal building millage for roof replacement in five or six years. Mohawk Road/Liquid Fuels - Russ Atkins, PennDOT, has agreed to carry the information through channels for us and will check on reimbursement for past years liquid fuel money on that section of Mohawk road. Generators - Dave will call the surplus office on the generators listed in the PA Bulletin. NEW BUSINESS Supervisors School - Dave will attend all four schools, Ben will attend when possible, will pay his own way and then get reimbursement. F.T.V.F.D. Fund Raisers - Dave moved to approve the list as presented. Ben seconded. Carried. Co-op Purchase Resolution - Dave moved to accept Resolution #1-93 as written. Herb seconded. Carried, one nay, Sitek. c8RESOLUTION #1-93 REQUESTING PERMISSION TO PARTICIPATE IN THE COMMONWEALTH OF PENNSYLVANIA COOPERATIVE PURCHASING PROGRAM. WHEREAS, The General Assembly of the Commonwealth of Pennsylvania has enacted an Act known as the "Cooperative Purchasing Act", Act 31 of July 1971, and WHEREAS, Act 31 of 1971 permits local governments to purchase materials, supplies, and equipment from purchase contracts of the Commonwealth of Pennsylvania. BE IT RESOLVED, that Franklin Township, hereby requests authorization to participate in purchase contracts of the Department of General Services, subject to the following: 1. That we agree to be bound by such terms and conditions as the Department may prescribe. 2. We agree that we will be responsible for payment directly to the awarded vendor under each purchase contract. Enacted into Resolution this ninth day of February, 1993. Industrial Parks - Herb asked for authorization to check into grant money available for the two I-1 zones in the Township. Ben moved to grant Herb authorization. Dave seconded. Carried. Title and License for Dodge 1-Ton - Dave reported that the State would not send the necessary paperwork until the invoice was paid. The check has cleared the bank so paperwork should be forthcoming. He will check with Scott Pepperman. Herb recommended getting rid of our old municipal licenses and taking the license off the Dodge until the paperwork is received. County Council - Herb reported that Paul Foust is now our council person. CORRESPONDENCE Upcoming meetings were reviewed. Ben moved to authorize the secretary to attend the upcoming secretaries workshop. Dave seconded. Carried. ADJOURN Netzler called the meeting adjourned at 2203 hours. Bonnie J. Bernhardt, Secretary
