February 25, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler with the Pledge of Allegiance at 0903 hours. Present were Netzler, Benjamin Sitek, David Henderson, Attorney Mark Richmond, Pat Rossi, Jeff Nelson and George Antolik. MINUTES Sitek said he wanted an answer to his question of the last meeting, what did George Antolik purchase his land for. Netzler replied that it's up to George to answer that. Herb presented the law pertaining to unlawful taking. Discussion. Henderson moved to accept the minutes of February 9, 1993 as presented. Sitek seconded. Carried. FUEL BIDS FOR 1993 The only bid received was from Erie Petroleum. Gasoline - .6585/gal. Diesel Fuel - .7110/gal. Henderson moved to accept the bid from Erie Petroleum. Sitek seconded. Carried. VISITORS Pat Rossi, Emergency Services Training Academy - presented a plan showing the proposed training facilities. Netzler - because this facility is a school the property does not need to be rezoned. Attorney Richmond agreed. Henderson - if ESTA purchases the Tipton property, they will have to go through subdivision requirements. Henderson moved to waive any permit fees involved with the Emergency Services Training Academy. Sitek seconded. Carried. Jeff Nelson, ESTA - The Health Dept. will be out to inspect the Carr property septic system. When the student facility is built we may need a holding tank. Henderson - you could put in a small flow treatment facility. Henderson moved to approve leasing a portion of the Township property for $1.00 for 99 years to the Emergency Services Training Academy. Insurance and liability is the sole responsibility of ESTA. If ESTA becomes defunct, the property reverts back to Franklin Township. ESTA is given permission to use the Township driveways. Sitek seconded. Carried. Jeff Nelson paid the $1.00 fee. Nelson - the Health Dept., D.E.R. and E.P.A. have been contacted. Jeff requested use of the Township backhoe to dig test holes. Discussion on plans for run off water from the burn building. Jeff added that the County and other township's have asked for cooperation to build the facility and prepare the site. The Soil Conservation agency in Waterford has said they see no problem with wetlands. Their map shows no areas of concern. Henderson moved to authorize Attorney Richmond to draw up an agreement between Emergency Services Training Academy and Franklin Township. Sitek seconded. Carried. Rossi and Nelson left the meeting at 0930 hours. REPORTS Superintendent - Dave reported that snow has been plowed, repairs made to the Mack and that the Athey will be brought in soon. A decision will have to be made on repairs to it's front end. Application for County Aid - Dave moved to adopt the following resolution, Ben seconded. Motion carried. c8RESOLUTION #2-93 THEREFORE BE IT RESOLVED, that we, the officials of Franklin Township, Erie County, PA, in regular session assembled on the 25th day of February, 1993, do hereby make application to the County Council of Erie County for an allocation of County Liquid Fuel Tax Funds in the amount of $9,357.00 to be used in the improvement of Fry Road (TR448), to purchase and apply on 2.20 miles of Fry Road (TR448) from Crane Road to Old State Road 2 inches of FB 1 B.C. and 1 inch of FB 1 W.C. 20 feet wide and to fill berms to pavement surface level. Estimated total cost of project is $50,000. It is certified by the Municipality and the officers who execute this application that all materials used and work done hereunder shall conform to the current PA DOT specifications or specifications approved by the Department and that all work will be done within the legal right of way or with permission of the abutting property owners. Letter to PA DOT/Old State - on hold. Letter to NRECA - Dave moved to send a thank you letter to Northwestern RECA for work done on the light at Rt. 98 and Old State. Ben seconded. Carried. Beck Mailboxes - Dave said that the posts the boxes are on are a hazard. Ben moved to send a letter to Bobby Beck and Steve Nesselhauf asking them to removed the posts and replace them with the approved mailbox design. Dave seconded. Carried. FINANCIAL AND TAXES Bills - Ben moved to approve the bills as listed excluding PA One Call totaling $8,110.42 general fund. Dave seconded. Carried. Payroll - Dave moved to approve payrolls #3-93 and #4-93. Ben seconded. Carried. Renkis Report/Tax Collector - on hold. Computer Update - on hold. Tax Bills - June reported that the tax bills are late coming from the County due to a computer breakdown and will be several days late going out. PLANNING, ZONING AND HEALTH DEPT. Planning Commission - no report. Amendment to the Zoning Ordinance - on hold. Wagner Request - request withdrawn. Industrial Parks - on hold. Verbal Complaint/Greiner Occupant - Ben moved to send the current occupant a letter telling him a complain was received alleging that he may be in violation of the home occupation regulations and to attend the March 9th meeting. Dave seconded. Carried. Venango Twp. Meeting - the Supervisors will try to attend the meeting at Venango Twp. with D.E.R. concerning septic systems and permits. SOLICITOR Major/Minor Subdivision and George Antolik - the opinion letter from the Solicitor was reviewed. It states that a subdivision fronting on an existing road with ten lots or less with no sewer extensions, no dedication of a street or alley qualifies it as a minor. Netzler to George Antolik - why aren't you going to major and what's the difference in work involved between the two. Henderson - we don't know what we're doing. This is the first major subdivision we've had and we need to get clear on what we're doing. Antolik - I've been doing what my engineer (Ralph Heidler) recommends. Henderson - read the requirements of a major subdivision. Netzler - why don't you just go major and save problems. A major keeps the turmoil down. Richmond - I saw no definition for very low density. Henderson - the only thing we can go by then is lot size. If a lot is two acres with 250 foot frontage and has one single family residential structure on it then that is very low density for A-1. Discussion. Henderson moved to direct the Planning Commission, in accordance with the Subdivision Ordinance procedures on page 3 for a major subdivision paragraph 5, that George Antolik has complied with A,B,C,D,E. He is at the submission of a final plan stage of a major subdivision. That plan will have to be submitted. Two acre lots with a minimum of 250 foot frontage are acceptable. Sitek seconded. Carried. Antolik - is the road agreement done. Henderson - as a major subdivision, you don't need an agreement but you must build the road to our ordinance specifications. Antolik - Erie County Planning specifications says I must use blacktop. Can that be waived to tar and chip? Richmond - make out a written application spelling out the details per traffic load. Discussion on dedication of a road, construction etc. Alternate for P.C. - Richmond questioned how an alternate could be up to date on what's going on. Dave said he didn't think the P.C. should be increased in size. Ben moved to leave the Planning Commission at five members with no alternate. Dave seconded. Carried. Dave added that when they have difficulty making a quorum, those members not regularly attending should come off the Board. M.D.I.A. Contract - the draft was reviewed and proposed changes made including dropping all references to the BOCA code. Richmond will send the revised draft to Mr. Franks. Cable TV - on hold. Szymanowicz Complaint - Richmond will set up for next meeting. Garbage - the Feb. 22, 1993 letter from the Attorney was reviewed. Netzler - if Waste Management wanted to come back on us, we'd be in trouble. Henderson - why do we allow all those garbage trucks to run up and down the roads damaging them. Netzler - so we don't aggravate the taxpayers. They have a choice. I'm content with the arrangement we have. Other haulers should bring their pick ups back to the Township bin for Waste Management to pick up. Richmond - at the very least you could send a letter to the other haulers informing them of the Township's exclusive contract with Waste Management. Sitek - we could tell people about the problem in the newsletter. Henderson - Waste Management won't pick up in front of homes, it wasn't in the contract. Should we have curb side pick up? Netzler - no. Sitek - we should have at least one. We can't ram it down people's throats, they should have a choice. Richmond - you must stick with the contract in force. You can change at the end of the present contract. There's nothing in the contract about picking up curb side recyclables. I think you're stuck for the length of the present contract. Discussion. Sitek moved to leave the problem alone until the end of the present contract (Sept. 1994). Henderson seconded. Carried. F.T.V.F.D. Oath/Fire Police - secretary is to call to see if all have been sworn in. Load Limits - Mark said he has a draft copy ready and will send it. Dave said to put it all in one comprehensive ordinance. Herb added that we can expand the present gas and oil drilling ordinance to include load limits on all heavy equipment for any purpose. Discussion on farm equipment, milk haulers doing damage to roads, etc. Richmond said you can make them post a bond based on the number of miles traveled in the Township. Ben said to contact other township's on how they handle the problem and who polices it. Richmond was instructed to research and revise the draft. OLD BUSINESS Sesquicentennial - copy of information from History of Erie County was sent to Edith. Town Hall/Goodban School - certified letters sent. Claybro has contacted the fire dept. to burn the old school. Boy Scouts - nothing. Fire Dept./Twp. Safety - nothing. Roof Leaks - in the spring the edges will be painted. We'll see if the patches work when it rains. Auction Contract/Fire Dept. - Dave moved to authorize himself to sign the contract. Ben seconded. Carried. The fire dept. concerns were reviewed. Dave said we will post no stopping or standing signs on New Rd. to the creek. NEW BUSINESS Triathlon - Sitek moved to approve the Triathlon when the insurance form is received and to send the required letter to PA DOT. Henderson seconded. Carried. Council Person - Judy Lynch is to visit on March 4 at 11 a.m. to introduce our new council person, Paul Foust. CORRESPONDENCE Soil Conservation Dinner - Herb and Ben will attend.
