May 11, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order at 2000 hours by Chairman Herbert Netzler with the Pledge of Allegiance. Present were Netzler and David Henderson. Benjamin Sitek was absent. MINUTES The minutes of April 22, 1993 were approved as presented in a motion by Netzler and second by Henderson. Carried. VISITORS Ben Sitek, Jr. - Silverthorn road needs something done. We've lost the crown, there are boulders in the road and the material put on the sides of the road needs to be moved. Our vehicles are going bad, I've had to replace the shocks on mine. This is the first time I've really disagreed with what's being done. Henderson - we can't get salt brine on the roads with our heavy tanker. If we grade the dust will be unbearable. John Ratay - my car has under carriage damage. Is there a plan, a schedule? Ditching seems to be the answer. Henderson - the plan was to rebuild both sections of New and Mohawk south. All the money has been spent on emergency repairs. All we will do this year is ditch. We spent two weeks on repairs to Silverthorn and W. Stancliff. We've also been putting gravel down on bad spots. Discussion on the cost of putting down geotextile fabric and gravel and on when to grade. Henderson - if we take the crust off the roads and it rains, it will be nothing but mud. The foundation to the road is gone. Our equipment will make more ruts after we grade. Netzler - we might as well grade, we can't make the ruts much worse. Henderson - ditches are not the answer when there's no base. We've hauled 700 yards of gravel in the last two days and our equipment destroyed the roads we were working on. My approach has been to stay off until the frost is out. One resident of 70 years told me that he's never seen a spring this bad with the Township able to keep the roads open to traffic. We have applied for emergency funds from the County but won't see that money for months if at all. Denver Ireland - why not suspend paving Fry road for this year. Henderson - those funds will not come from the general budget, that money is encumbered in special funds. Netzler - I don't agree with paving Fry at all. Sitek, Jr. - those people worked hard for their paving, you've made a commitment. You can't pull the rug out from under them. Ed Mumau - if we don't qualify for grants and need more money, raise the taxes. Henderson - one mill of tax is only $3,000. To rebuild one additional mile of road with surface gravel would take 3 mills of tax. We're near our limit without court approval. A millage rate hike will not raise that much more. Bill Smith - these guys are doing the best they can. Mother nature pulled a dirty trick that we'll pay for well into next year. PLANNING, ZONING AND HEALTH DEPARTMENT Beck/Hurley Complaint - Stan Hurley said he wrote to Bob Beck asking him to clean up the assorted junk on the Beck property which adjoins his. Mr. and Mrs. Hurley were advised to file a nuisance complaint with the Supervisors. Netzler will confer with the Attorney to see whether an ad can be placed in the paper instead of sending a certified letter to the offending party as we do not know the whereabouts of young Bob Beck (property owner). Sign I-79/William Smith - After reviewing Mr. Smith's letter and the zoning ordinance, Netzler moved to write a letter giving permission for the sign to be erected as per the drawing submitted as it meets all Township regulations. Henderson seconded. Carried. Mr. Smith left the meeting at 2110 hours. Amendment to Zoning Law - nothing. Antolik Subdivision - nothing. Industrial Parks Grants - nothing. Wheeler/Home Occupation Sign - Dave stated that he didn't think they were advertising a home occupation. Situation was referred to the Planning Commission. Zonna Building Permit Extension - County approved extending the permit. Henderson moved to extend the Zonna building permit until the addition is done. Netzler seconded. Carried. REPORTS Superintendent - see discussion on roads. Letter to PennDOT - will do. Five Star Invoice for Towing - Dave reported that manuals were to come with the new trucks but were not sent. On one of the trucks a deeply set hex screw came out and let the oil drain out and he thought the truck had blown a seal. It was towed to Five Star who discovered the problem. Our argument is that if the manual had been supplied as per the specs., we would have found the problem and did the work ourselves. He feels the invoice for towing should not be paid. Netzler agreed and moved to not pay the Five Star invoice for towing. Henderson seconded. Carried. FINANCIAL AND TAXES Payroll - Dave moved to approve payroll #9-93. Herb seconded. Carried. Bills - Dave moved to pay the bills as listed excluding PA One Call, TPS Distributing (adjustment), Valk Manufacturing (not received) and American Safety Services (error in billing) totaling $2,066.43 general and $8,497.03 state. Herb seconded. Carried. Computer Update - nothing. GMSD Confidential Tax Info. Agreement - Dave reported that the school district has appointed Larry Brown to be the party to secure and dispense to other reliable tax collectors tax information from the PA Dept. of Revenue. The agreement acknowledges the confidentiality of the information and binds Brown as agent. Netzler - why does Larry Brown have anything to do with it. Tax information for Franklin Township residents should be given directly to June Suhy. It should not have to come through Brown. The Attorney will be instructed to look into the matter. Adopt GMSD EIT Rules and Regulations - a copy of the rules and regulations will be sent to the Attorney to look over and give an opinion on for the May 27th meeting. Request GMSD for 50% Additional Bond - the school district will be asked to pay half of the bond increase for any assistant June Suhy hires. Herb said he feels June should get permission from the Board before she hires anyone to help with tax collection. The Attorney will be asked to research the legality of the situation for the May 27th meeting and will be instructed to write June a letter informing her of his findings. SOLICITOR All items on hold until the May 27th meeting. Herb mentioned that he has seen a truck with a sign on it's door that says "Intra Global" with the Crane road address. OLD BUSINESS Sesquicentennial - the Township News has an article in it on writing articles which will be copied for Bob Berry. Clean Up/Old Town Hall, Goodban School - Greg Soltys has secured the door and picked up most of the litter around the building as a favor to the Chivaris. Nothing on the Goodban school site. Safety Seminars with F.D. - the fire dept. said to set it up. Roof Leaks - no leaks as yet. NEW BUSINESS Solicitor Attend Underground Storage Tank Seminar - it was decided that his attendance is not necessary. Shrubs for Around the Building - the cost would be approximately $200 for shrubs that would cost considerably more retail. Dave stated that the Township has spent very little on the exterior of the building. Henderson moved to purchase shrubs for around the building for approximately $200. No second.
