May 27, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler with the Pledge of Allegiance at 0900 hours. Present were Netzler, Benjamin Sitek and David Henderson. Attorney Mark Richmond arrived at 0905 hours. MINUTES The minutes of May 11, 1993 were approved as presented in a motion by Sitek and second by Henderson. Carried. REPORTS Superintendent - Dave reported that roads have been graded, work is progressing on the Athey, a seal blew on the hydraulics of truck #6, will be repaired on the 28th. Letter to PennDOT - Herb reported that Old State will be tarred and chipped, berms will not be boxed out. Dave said our whole objection is how narrow the road is, tar and chip won't correct the problem. He feels berms should be boxed out and bad areas skin patched prior to tar and chip. A letter will be sent asking Mr. Dolecki to meet with us. FINANCIAL AND TAXES Bills - Sitek moved to approve the bills as listed excluding PA One Call, American Safety Services (checking billing), TPS (mfg. adjustment), including the EIT payment to Northwestern S.D. Also moved to drop PA One Call from the bill list. Total - general fund, $5,002.80; state fund, $1,118.44; EIT fund, $1,452.00. Henderson seconded. Carried. Payroll - Sitek moved to approve payroll #10-93 as presented. Henderson seconded. Carried. Computer Update - nothing. G.M.S.D. Confidential Tax Info Agreement - Richmond reported that the state statute says the school district can go through June or their own person. If the district has the authority to hire someone to collect taxes, they have the power to do all the duties of a tax collector including receiving confidential tax information. Discussion on who should receive the info. Richmond said that the more people involved, the greater chance of leaks, the less control over the situation, and the greater the cost. Richmond was instructed to look into the confidentiality issue. Henderson moved that if the Township is absolved in the confidentiality issue in the Solicitors opinion, the Supervisors will sign the agreement. Sitek seconded. Carried. GMSD EIT Rules and Regulations - Richmond said he saw no problems. Henderson moved to contact June Suhy, if she saw no problems, to sign the rules and regulations and mail to the school district. Sitek seconded. Carried. Bond for Suhy Employee - Richmond reported that June can deputize an assistant with Board approval. The bond should be increased if she is collecting money. Henderson - the bill from the Rouse Agency will show the increase with half coming to us and half going to the school district. A bondable person isn't the issue. The big question is, if we approve her assistant do we pay the wages. Richmond - if Suhy is paid a commission, she pays from her commission. The assistant's money comes from Suhy's cut of the taxes. It is better to deputize her and get her on the bond. There is a risk both ways but it's more of a risk to ignore the issue. The bonding agency will do a background check. If June needs more help, the agreement with the Township says she is paid 4%, how it is divided is up to her. Henderson moved that June Suhy needs to submit her assistant's name to the Supervisors, the assistant comes in for a meeting with the Board for approval conditioned on the bonding agency approval. Sitek seconded. Carried. PLANNING, ZONING AND HEALTH DEPARTMENT Amendment to Zoning Law/Accessory Structures - Dave said the ordinance should contain a list of insignificant accessory structures that do not need a permit and suggested that Richmond call the assessment office to see what they feel is insignificant. Dave also suggested that the amendment specify where accessory structures can be placed within the setback on the property. Antolik Subdivision - Richmond will attend the lot closing on 5/28/93 to receive the bond money owed the Township. Netzler - we can sign the articles of agreement and the Mylar. If no bond money, Richmond will hold the documents, if he is given the money he can hand over the Mylar. Also, Mark will only accept a certified check. The bond money should be invested in whatever has the best interest rate, a long term C.D. or interest bearing savings account. Henderson - if we accept his job on the road and it goes through a winter with no problems, we accept the road only. We do not have to dedicate it. Who cares for it? Richmond said that Antolik cares for it for one year after the date of acceptance. Henderson - if there is no more than one house on it and it is not dedicated, who cares for it. Richmond said the agreement is silent on that issue, it is left up in the air. Mark also said that Antolik and his solicitor should be made aware that acceptance of the road and dedication of the road are two different things. Henderson - if we never dedicate that road, who cares for it. Mark answered that Antolik does, it's his road. Sitek moved to sign the articles of agreement and the Mylar contingent on receiving good and sure funds for the bond in the amount of $12,000. Henderson seconded. Carried. Antolik/Western Trails Subdivision Mylar and articles of agreement were signed. No Parking Ordinance - the ordinance draft was reviewed. Will check boundary lines to include ESTA (to the top of the hill on New). Henderson moved to approve the ordinance for no parking and to authorize Mark Richmond to advertise it and distribute it to the necessary agencies. The required hearing will be advertised for June 24, 1993. Sitek seconded. Carried. Industrial Park - Herb will talk to Bill Zelina about one driveway at Amtek with two parallel service roads off the Amtek drive. Wheeler Sign/Home Occupation - waiting for the P.C. opinion. Nuisance Complaint-Beck/Hurley - Netzler asked if we can advertise in the paper as we do not have an accurate address for young Bob Beck. Richmond reported that we must make an effort to locate Mr. Beck. Ben volunteered to ask the Beck renter if she knows his address. Herb will also try to get his address. SOLICITOR M.D.I.A. Agreement - Henderson moved to sign the agreement and the fee schedule. Sitek seconded. Carried. Netzler said M.D.I.A. has been holding up inspections until the fee schedule is signed. People are waiting. Cable T.V. - Richmond will check with Bill Welsh. Load Limit Ordinance - Dave said it will cost $400 for a load limit study and suggested that Mark write the ordinance as broad as possible. Mitchell House Fire - P.S.P. says the case is closed as far as they are concerned. Mark will check out the insurance law on clean up. Intra Global - Mark sent a letter asking Mr. Taylor if business will still be conducted at that location since the building burned. He is waiting for a reply. Herb mentioned that Joe Syzmanowicz was given permission several years ago for a home occupation in his hanger making windsocks. OLD BUSINESS Sesquicentennial - nothing. Clean Up - Town Hall/Goodban School - Chivari was in the Town Hall and left the door open after Greg Soltys had secured it. Nothing has been cleaned up on the outside, the windows have not been boarded up. Herb will talk to Steve. The Goodban school was burned by the fire dept. Hugh Crandall had volunteered to clean up the site. Discussion on orphan pieces of property. Back taxes are usually more that the property is worth. Henderson feels it is better for everyone to absolve the taxes owed and sell it to an interested party. Fire Dept./Safety Seminar - nothing. Roof Leaks - nothing. Boy Scout Grant - check will be presented next Tuesday meeting. Shrubs - Ben moved to purchase shrubs for around the building, approximately $200. Dave seconded. Carried, one nay Netzler. Paid Vacation Day for Working Supervisors - auditors set at 333 hrs/1 paid vacation day. Dave said we can use last years hours worked, that Ben could take a holiday before working the 333 hours. Ben said he would rather work the required hours then take the day. NEW BUSINESS F.T.V.F.D. Activities List - Dave moved to approve the list dated May 17, 1993. Ben seconded. Carried. Auditor for Suhy - Dave moved to approve Monahan and Monahan to audit June Suhy's books. Ben seconded. Carried. Shepegi Offer - Dave reported that the Township made ruts in Mr. Shepegi's field last fall when they installed a new driveway pipe. Mr. Shepegi has offered to fix the field in exchange for his last payment on the pipe ($64.40). Discussion. Henderson moved to have Mr. Shepegi do the repair work for the last pipe payment. Sitek seconded. Carried. Senate Bill #182/Tax Reform; House Bill #870/PSP Fines - county would have control over taxes, taking all control away from townships. Dave said part of the formula is based on per capita income which would hurt us. Discussion. Henderson moved to send letters to the appropriate congressmen opposing Senate Bill #182, House Bill #870 and the prevailing wage regulations. Netzler seconded. Carried. Senate Bill #1/Workers Compensation - Dave said the paperwork to assure comp. coverage on all work done in the Township would be prohibitive. This bill wants us to do the work of the Department of Labor and Industry. Henderson moved to oppose. Netzler seconded. Carried. CORRESPONDENCE Semi-Annual Convention - Sitek, Henderson and Bernhardt will attend. Soil Conservation Meeting/Storm Water - Richmond, Sitek and Netzler will attend. (Schroeck and Associates to reimburse Richmond fee.) Letter to Employees - the Attorney sent a letter addressed to Township employees concerning residents voicing problems to them. Ben said he feels employees should not tell residents anything but refer them to the Board. Henderson - no one told anyone on Silverthorn to turn in a claim to the insurance company. The resident did not know he had damage to his car until after the fact. Why did the Solicitor write an opinion on something we can do ourselves? Mark's time did not need to be spent writing that letter. Richmond said he would take his time for the letter off our bill. Netzler - I think the employees should sign the letter so we know they read it. It can be a good defense if anything comes back on the Supervisors. The letter should be rewritten saying all problems should be referred to the Board. Richmond will rewrite the letter. Harman Sign/Old State Road - Erika Harman has not moved the sign as required.
