July 13, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler at 2000 hours. Present were Netzler, David Henderson, Clarence Mischler, Ed and Winnifred Mumau and Dan Parker. Benjamin Sitek was absent due to taking his wife to the hospital. HEARING ON ORDINANCE #2-93 AND ORDINANCE #3-93 #2-93, Permittable Building Size - permittable size will be 100 sq. ft. and larger. No comments from visitors. #3-93 - amendment to the Holding Tank Ordinance deleting all reference to residential use. No comments from visitors. Dave Henderson moved to approve Ordinances #2-93 and #3-93. Herb Netzler seconded. Carried. Ordinances were signed. MINUTES Henderson moved to approve the minutes of June 24, 1993 as presented. Netzler seconded. Carried. VISITORS Clarence Mischler - there's a forage wagon in the ditch on Silverthorn. Dave said he would contact Dick Warnshius about it. REPORTS Superintendent - Dave reported that spot ditching has been done on the west side, Rick and Ray were on vacation last week, odds and ends were done in their absence. Also, a pass was dug through at the Girard pit. Hoover Sand and Gravel will dig at 70 cents a yard, approximately $4,000 worth. There will be no crushing this year. Four Year Road Plan - tabled until Ben is present. FINANCIAL AND TAXES Bills - discussion on the TPS bill, the final adjustment is in. Both Dave and Herb felt the manufacturer should have covered the defective tires and dated the wear from the time of complaint (8 months prior to the repair.) Custom Clutch bill - the jack is still not right. Five Star - their accounting dept. is confused and not taking into account the adjustments made by manager Randy Leighton. Dave feels the bill from Mowery for use of the forklift is excessive. Herb said he will talk to him about it and to hold the bill. The bill from MDIA will be held as we are not happy with their performance. Herb said he will call Mr. Franks and discuss the situation with him. Henderson moved to pay the bills as listed excluding Custom Clutch, Five Star, Mowery and MDIA totaling $1,145.57 general fund and $1,806.03 state fund. Netzler seconded. Carried. Payroll #13-93 - Dave moved to approve, Herb seconded. Carried. Computer Update - nothing. Blanket Honest Bond - hold until Ben is present. Industrial Parks Grant - Herb reported that we can apply for two different grants straight to Harrisburg instead of going through the local development organization. It would be fifty cents on the dollar. Wheeler Sign - nothing. Hurley/Beck Complaint - nothing. Matha/Teed Clean Up - the deadline of July 12th has passed and nothing has been done. Netzler moved to authorize the Solicitor to file charges with D.J. Stuck. Henderson seconded. Herb told visitors that Matha/Teed are in violation of the zoning ordinance and that they would be asked to appear or sign an affidavit on the issue. M.D.I.A. - Herb will talk to Mr. Franks. Old State Road/PennDOT - Herb talked to the manager and was told they were going to scab the berms which they have begun to do. He told them they needed to skin patch also. Dave said George Puskar had previously told him they would do the berms. No word on when they will meet with us. SOLICITOR Cable T.V. - Dave said there are two issues that need to be clarified, 1. Franchise - cable rates are to be regulated by the Township, 2. Phone Company - they are allowed to compete with cable companies. This has been illegal in PA. The law permitting competition has just been passed. In the future phone lines will be wired with fiber optic and cable service can travel over them. Discussion. Load Limit Ordinance - nothing. GMSD Confidential Tax Info - nothing. GMSD EIT Rules and Regulations - nothing. Mitchell House Fire - Herb reported that if the taxes are not paid by next month the property will go on the sheriff sale list. We still need to know who the insurance co. is and if the structure will be torn down. Ordinance--Fire Damaged Structures, Insurance - Dave reported that the Twp. needs to adopt an ordinance to be able to take advantage of a new law that requires insurance companies to hold a certain part of their payment for demolition of fire damaged structures. Dave moved to instruct the Solicitor to draft such an ordinance. Herb seconded. Carried. OLD BUSINESS Sesquicentennial - Dave met with Bob Berry and Edith Swift. The writing and research should be done by January 1, 1994. Print during the second quarter, distribute during the third quarter. He feels we should make a small profit from advertising which can be used for a celebration next summer. Expenses can be budgeted in November for 1994. Clean Up Old Town Hall, Goodban School - Steve Chivari says he has a buyer for the Town Hall. Discussion. It was felt that the Goodban school remains need to be burned again. Fire Dept/Twp. Safety Meetings - nothing. Federal Snow Money - some municipalities have received their money. We have not. Dave talked to Nick Sleptzoff who said that we will get it eventually. There can be a several month delay. We will wait until the middle of August and then send Congressman Tom Ridge a copy of all the documentation and ask for his help if our check has not been received. NEW BUSINESS Letter to FTVFD on Fireworks - Dave moved to send the fire dept. a letter stating that private displays of fireworks are not legal in PA. The Township will not authorize such displays and the fire dept. does not have the authority to do so. A copy of the letter will be sent to Frank Baumgarten. Dave - do we want an ordinance permitting public displays? Herb - no, there's too much liability if we give permission. 9-1-1 Errors - Dave reported that he received the list for Franklin Township from 9-1-1 which was updated from our road list. It will be mailed back to 9-1-1. GTE's data base is not released to 9-1-1 due to confidentiality. Discussion on the 756 exchange problem in light of our recent double drowning. Federal law says GTE's data base is not allowed to be given out to anyone, State law is not the problem. All 9-1-1 can do is send correct information to GTE and ask them to check their records. Dave said that cooperation between the two agencies should happen soon. CORRESPONDENCE Reviewed. Dave said that the West County Com. Center parking lot will be enlarged this Saturday.
