July 22, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler with the Pledge of Allegiance at 0902 hours. Present were Netzler, Benjamin Sitek, David Henderson and Attorney Mark Richmond. MINUTES Henderson moved to accept the minutes of July 13, 1993 with the following correction on page 30 under correspondence, change "$3000 worth of gravel" to "300 yards of dirty gravel." Sitek seconded. Carried. VISITORS None. REPORTS Superintendent - Dave reported that spot graveling of sink holes is being done using our equipment and manpower. There is no extra money to hire Russell Standard to haul. Netzler - it costs twice as much to haul with a single axle. Henderson - that's right but there's no extra money to hire. It's either keep the crew on and use our equipment or lay off and gather up enough money to hire Russell Standard. It's a personnel decision. Sitek - we need to stockpile gravel at the building. If Russell Standard stockpiles, we'd still have the expense of loading and hauling from the building. People don't understand that all our money has to go to temporary repairs to the roads that the spring weather ruined. Discussion on mowing berms. New Frac Tank, $1,500 - Dave reported that several used tanks are available. We will need one soon as ours has leaked and been repaired. The present tank is used by the gas company exclusively. Netzler - the present two tanks are not owned by the Township. Henderson - that changes things and complicates the disposal of the tank when we decide to get rid of it. Sitek - give the haulers the word that we're in need of a tank and see if they'll donate one. Discussion. Henderson - the problem is that storage becomes exclusive to the company donating the tank. Sitek - if they can't supply water then others should be able to use it. See if the three companies will share the cost and use of a tank. Dave will do. Fry Road Paving - paving begins today, the 22nd. Four Year Plan - Dave presented the proposed plan for road improvement. Netzler - I'm opposed to paving the remaining section of Fry road. There's not enough homes to warrant doing it. It would be the last section I'd pave. Sitek - that would be the only section not paved. It would take traffic off some of our other roads that are graveled. Henderson - don't forget that this improvement money is accumulating in our Permanent Improvement fund. Netzler - I don't think the taxpayers of this Township should be forced to pay taxes on Fry road. Francis gets more traffic than any road. Henderson - if you pave Silverthorn from Old State to West Stancliff, it draws traffic and ruins the sections of gravel road beyond the paved. There's not enough money to do the key collector roads. Paving the other roads are all ours 100% not a shared cost like on Fry. In the new second class code there are provisions for a front foot assessment for road improvements. Discussion. Tabled for a month or so for review. Milled Material/Airport - Herb said he hasn't heard back on tonnage and on how much the airport will keep for themselves. Hauling must be done at night. Our best bet is to have Russell Standard haul and split the material with them. Discussion. Graveling Sink Holes - George Antolik offered to haul gravel for his section of road. Dave will check with George. Community Block Grant Funds - Discussion on rocking the boat to get the system changed on who qualifies. FINANCIAL AND TAXES Bills - MDIA permits are up to date. Mowery was told by Herb that his bill was excessive. Herb recommended paying $300 of it. Sitek moved to pay the bills as listed including MDIA and $300 to Mowery, excluding Five Star and Custom Clutch (bills need to be adjusted), totaling $2,917.11 general fund, $2,563.88 equipment fund and $186.21 state fund. Henderson seconded. Carried. Payroll - Ben moved to approve payroll #14-93, Dave seconded. Carried. Computer Update - nothing. Blanket Honesty Bond - Dave said he feels Dave Wagner of Wagner Insurance Assoc. should advise us. Netzler - thinks we're all right on our own employees. We have the option to deny her having a deputy and an assistant. Richmond - you can give her the OK or not but it's better to let her have a deputy. A clerical person could embezzle just as easily as someone handling money. The decision can not be made on a financial basis. Combine the deputy and clerical positions. Sitek - we should tell June that we will bond her assistant as a deputy and have her do the clerical work also. Herb moved to have the secretary call the insurance co. to find out how much a deputy would increase June's bond. Dave seconded. Carried. Richmond - gather all the information and have a personnel meeting with June. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Grants - information coming in the mail. Wheeler Sign - sign was removed. Hurley/Beck Complaint - Ben reported that Bob and Bobby Beck have been cleaning up the property. Dave moved to have Ben contact the Hurleys and see if they are happy with the clean up. Ben seconded. Carried. Matha/Teed Zoning Violation - Ben moved to have the secretary call the neighbors and see if they have cleaned up. The Attorney will be advised on whether he should file papers with DJ Stuck. Dave seconded. Carried. Building Applications in Supervisor's Boxes - Dave recommended having a list that can be updated. Revoke Ron Patton's Conditional Use Permit - Dave stated that Mr. Patton has a junk yard going at the property on Mohawk Rd. He was told he couldn't have cars and parts stored outside. Dave feels a letter should be sent informing him that a hearing will be held for the revocation of his conditional use permit. Richmond - take a dated photo of the property before he receives the letter. Dave moved to hold a hearing on August 26, 1993 on the Patton issue. Ben seconded. Carried. SOLICITOR Cable TV - Bill Welch is working on it. Load Limits Ordinance - working on it. Hallett Clean Up - DJ Stuck said there was no "clean up" on the court orders, it was fines and costs only. Richmond will get back to DJ Saxton with a copy of the letter from Attorney Agresti which gave the case to him instead of Stuck. Mitchell House Fire - Herb reported that he heard that the insurance company gave them until August to clean it up. Richmond said he will contact PSP and see if they know the name of the insurance co. GMSD Confidential Tax Info - the revised agreement includes a tax info rotation system. Richmond recommended signing the agreement but to recommend that it be reviewed in a few years. Dave said he did not like the rotation system or that there were no provisions for review or time limit/term on the agreement. Ben added that he doesn't agree with it but the tax collector needs the tax information. Sitek moved to sign the Confidential Tax Information Agreement. Netzler seconded. Carried, one nay, Henderson. GMSD EIT Rules and Regulations - haven't heard back from the school district on our opposition to several sections in the document. Ordinance on Fire Damaged Structures - the Attorney was instructed to send for a sample ordinance. Letter to ATF - Dave moved to authorize the Chairman to sign the letter to the Bureau of Alcohol, Tobacco and Firearms. Ben seconded. Carried. Letter was signed. Girl Scouts Tax Exempt Status - the latest letter from Vendetti, Talarico and McNair lists the rental properties as tax exempt. The Township is opposed to this. Dave moved to have Richmond address the letter from Vendetti, Talarico and McNair on the tax status of the Girl Scout rental properties. Ben seconded. Carried. Eminent Domain/Goodban School - Discussion on taxes owed and property value. If taxes are higher than the property value at the time of a sheriff sale, the taxing districts get nothing. Henderson to Richmond - go to the Court House and find out how much is owed in back taxes, do a title search. When we know what the assessed value is versus the amount owed, we can make a decision. Residential Structures Amendment - Dave said that the proposed ordinance amendment says you can't connect structures by any means. What we're trying to say is that you can't set one unit next to another unit and connect them by a breezeway. They must have a common wall. Discussion. Henderson - we must determine what is designed to be put together and what isn't. Richmond - you want to outlaw a breezeway or hallway connection but not eliminate additions. Richmond will research the proper wording further. OLD BUSINESS Sesquicentennial - nothing. Clean Up Town Hall/Goodban School - nothing. Safety Meetings - nothing. Old State Road - nothing. NEW BUSINESS FTVFD Tones Through Washington Twp. - Herb asked why FTVFD isn't being tapped directly through West County. Through the Washington Twp. tower, tones are not going off. Henderson - the tones were tested the other day. The fire dept. is working on it and should make a decision soon. We don't have the right to tell them how to run their fire dept. It's the same way the system has been run for ten years. Netzler - I'm worried about the people in this Township. What Edinboro does is their business. I feel we should be tapped through West County. Henderson - I suggest we let the fire dept. handle it since they're working on it. Low Level Nuclear Waste/Municipal Parks - write back and say we have no municipal parks. CORRESPONDENCE Upcoming training sessions were reviewed. SCI Albion Impact Study - discussion. Dave said he will write a letter to Erie County Planning stating that the impact study falsely assumes that our Township will be impacted. Not so since we have no municipal sewerage system. Dennis Swift, President of FTVFD arrived at 1140 hours. Dennis said he feels the fire dept. is having a problem with the Washington Twp. tower. Ultimately the decision is with the Chief. Members say the pagers open up but nothing comes through. Henderson - suggested doing a field test on the two towers. Radio waves are reluctant to go around hills and we have a hill between Franklin Township and the Edinboro tower and none between West County and the Township. Dennis - I can't seem to convince Terry. Maybe the field strength tests would convince him. Dave volunteered to get the equipment to do the tests.
