August 26, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler at 0900 hours with the Pledge of Allegiance. Present were Netzler, Benjamin Sitek, David Henderson, Ron Patton and Jean Heath. Attorney Mark Richmond was excused due to a court appearance. PATTON/HEATH HEARING Netzler - the Board understands that you are no longer conducting an auto repair business at 9450 Mohawk Road. Patton - we've been closed for over a year, the business was open for only 5 months. Mr. Patton expressed his displeasure at "being hassled" by the Township and his neighbors the Hausers. He said the vehicles parked on his property are all his, that they are his hobby. Netzler - you should have notified us when the business closed. We're having this hearing on the Solicitor's advice. Sitek to Patton - you are not the only one that we've received a complaint against. We're not picking on you. We're doing our elected duty. We have 2 or 3 other complaints besides yours that we're following up on. Henderson - there is a provision in the zoning ordinance that allows for 1 car that is not licensed or inspected. You can have as many cars on the property as you like as long as they are licensed and inspected. You can not have a junk yard. Netzler - if someone complains in writing, we have to follow up on it. Henderson moved to revoke the conditional use permit for Ron Patton, 9450 Mohawk Road, Girard, PA 16417. Sitek seconded. Carried. Ron Patton and Jean Heath left the meeting at 0915 hours. MINUTES Sitek moved to accept the minutes of July 22, 1993 as presented. Henderson seconded. Carried. VISITORS None. REPORTS Superintendent - Dave reported that grading is being done, the brine tanks were moved to the hill, several under road pipes have been changed. Blocks will be put along drain pipes on New and Falls roads. Discussion. Four Year Road Plan - Dave moved to hold a special meeting on Sept. 23rd at 0830 hrs. to discuss the plan. Netzler seconded. Carried. Milled Material - Herb reported that Russell Standard is forming a plan for bringing the material out here. He feels there is enough for 2 miles of road. It will have to be stored here. They will take 50% of it. Bob will figure the cost of putting it on the road. Snow Money Discrepancies - Dave moved to appeal the costs that were disallowed (towing, some dispatching). Ben seconded. Carried. Fry Road Paving - Dave reported that we need to show where we spent at least $10,000 from the general fund so we can file a completion form and get our county liquid fuels money. Dave moved to pay Washington Township $10,000 from the Permanent Improvement fund and to file a completion report with PennDOT. Ben seconded. Carried. FINANCIAL Bills - Dave reported that Gary Hoover said we could work out a deal on payment. He was impressed with Hoover's work, the operator did an excellent job. He dug 7562 yds. which is enough for us and Elk Creek (4,000 yds.). Elk Creek will mow our berms with the Tiger mower at $40/hr. in exchange for the gravel. Last year the operator mowed for 6 weeks. Netzler - are you keeping track so we don't lose out. Henderson - yes, he's taking gravel this year for last year's mowing. I'll give you a breakdown of costs for gravel and mowing. This year's mowing should go faster because he's only mowing new growth. Netzler - when did we discuss hiring Hoover, only after the fact. Sitek - I remember discussing hiring him prior to having him do the job. We'll have to document everything more specifically. I remember when you ran this place Herb, there were lots of things you never brought up. It was never brought up what pipes you would replace or what pipes you ordered. Netzler - yes it was. We always voted on the pipe order. I don't have any idea what's going on. Henderson - the pipe order was discussed and voted on in the budget sessions. Don't they count. What do you have a budget for? Netzler - pipe orders should come up before the Board. You only do what this Board tells you to do. Henderson - fine, I won't do a thing unless told. The second class township code says the authority for tending to the roads is delegated to the road master unless otherwise authorized. Netzler - I can't tell you what to do without knowing what you were doing. Henderson - you just made my point. What would you like me to do, ditch next Monday? Netzler - you should have had Russell Standard haul gravel instead of using our single axle trucks. That should have been a Board decision. Henderson - how can the Board give me direction on what to do tomorrow when the weather is involved. We're months behind on ditching because of the spring we had. We used 1500 yds. this spring plus more recently to get these roads back in shape. Henderson recommended paying Hoover Sand and Gravel $2,500 now and the rest in the fall. Henderson moved to pay the bills as indicated less Custom Clutch, Five Star, Hoover Sand and Gravel ($2,793.40) and RAK totaling $3,352.69 state fund, $2,563.88 equipment fund, $10,000 permanent improvement fund and $3,690.38 general fund. Sitek seconded. Carried. Dave stated that the jack has been to Custom Clutch four times and it still isn't right. EIT Claims - Ben moved to pay the EIT claims as listed totaling $2,355.15. Dave seconded. Carried. Payroll - Dave moved to approve payrolls #15, #16 and #17-93 as presented. Ben seconded. Carried. Computer Update - nothing. Honesty Bond - Dave will call June and see if she'll make Judy Cholak her deputy. This would solve the problem of the bond. Dave Wagner of Wagner Insurance Associates will be asked to review the bond and give his recommendations during an executive session. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Grants - O.T.M. was told what is available in grants. Henderson - the property on Rt. 98 could be a housing subdivision with a sewage plant. The Township could put in a small package plant with 50 2 acre lots. A housing subdivision would increase our tax base by $25,000. A big disadvantage would be a development in the middle of the township with increased traffic on our roads. At Rt. 98 and W. Stancliff the traffic problem is solved. The state road would take the traffic increase. You could look into connecting sewer lines with Fairview Twp. Discussion on water filtering system at ESTA and on storm water management. Netzler - I don't know if this township could sustain the amount of water needed for a housing development. Dave will continue checking on housing developments, Herb will continue checking on industrial grants. O.T.M. Variance - OTM needs a variance from the rear set back requirements. Dave moved to hold a hearing for OTM's request. Ben seconded. Carried. Hurley/Beck Complaint - Ben talked to Hurley who was concerned that children might go onto Becks property and get into the items stored there. Beck has mowed, cleaned up and nothing is visible from the road. Mr. Hurley was told to contact the Township or Ben if he was not satisfied. He has not contacted either. Matter is considered solved. Extend Kuligowski Building Permit - Ed has asked for an extension for the house he plans to build on lot 5.03. Discussion on building lots and whether taxes are being paid on his present home. Henderson moved to call the assessment office and tell them to investigate, something is confused there. Sitek seconded. Carried. Permit for Trailer on Old State/Simmons - Board feels the Simmons need a permit even though the trailer is to be on lot for only several months while their new home is being built. Permits to come before the Board and P.C. - Herb suggested postponing action until he can check the zoning ordinance again. Act 44/Workers Comp. for Contractors - Henderson moved to not accept building permit applications from contractors, only from the homeowner. Sitek seconded. Carried. SOLICITOR Mitchell House Fire - discussion on the Attorney's letter. Connecting Two Residential Structures - the Planning Commission wanted the words "and which were designed for such additions" added. The Solicitor doesn't agree. He feels that would prohibit any additions to existing homes because houses are not designed to be added on to. They have exterior walls that would have to be removed or altered for an addition to be added. Henderson moved to hold a hearing on September 13, 1993 at 7:30 p.m. on this ordinance and ask Planning Commission members to attend. Sitek seconded. Carried. OLD BUSINESS Sesquicentennial - Edith Swift asked for a date and time to be set. Late summer in 1994 was considered. Input from the fire dept. will be sought. A joint celebration with the fire dept. was considered as was a barbecue. Dave moved to authorize the sesquicentennial committee to apply for any available grants to support the cost of the book. Ben seconded. Carried. Ben moved to have Dave find out who caters the Walsh Equipment barbecue. Dave seconded. Carried. Clean Up Town Hall/Goodban School Site - nothing. Safety Meetings - if a safety meeting is held with the Township and fire dept. we can get a 5% reduction on our orkers comp. insurance. Dave will contact Dave Wagner of Wagner Insurance. DER Contract/Boy Scouts - a copy of the proposed contract will be sent to Rick Bain for his approval by next meeting. NEW BUSINESS Tones for FTVFD - Dave reported that the strength of the signals was checked. He called Camp Communications who did some adjustments. They are now waiting to see if the adjustments worked. Discussion. Morton Salt Contract - Dave moved to sign the form. Ben seconded. Carried. Tax Exempt Hearing/Blessed Hope Church Campground - Board recommended not contesting the appeal. Act 205 Form/Pensions - Netzler signed to form. New Second Class Township Code - Herb moved to support the new code and to write to all our legislators voicing our support. Dave seconded. Carried. E.S.T.A. - Dave reported that information on work being done has been placed in the Supervisor's boxes. They have asked to buy gravel and gas from the Township. Henderson moved to let E.S.T.A. purchase gravel and gasoline from the Township. Netzler seconded. Carried. The fire dept. gave ESTA a small corner of their property. CORRESPONDENCE Upcoming training sessions were reviewed. The Supervisors left the meeting at 1130 hours to check the damage done to Falls Road when a cement truck was forced off the road into the ditch by another vehicle. The Supervisors returned to the meeting at 1152 hours. EIT Quarterly Advance - Dave moved to approve payment of the quarterly advance to Northwestern School District for $1,452. Herb seconded. Carried. Dave reported that cement blocks will be put on either side of the inlet of the drain pipe on Falls road where the damage occurred.
