September 14, 1993 The hearing for Ordinance #4-93/Structure to Structure, held in the Township office, was called to order by Chairman Herbert Netzler at 1945 hours. Present were Netzler, Benjamin Sitek, David Henderson and Greg Soltys. The Solicitor's opinion was read on the proposed change by the Planning Commission which would add the words, "and which were designed for such an addition". He was not in favor of that change. He feels that it does not help to clarify the issue. Henderson - the Supreme Court ruling says you can not discriminate against mobile homes. Netzler - the wording in the zoning ordinance is outdated because of the Supreme Court ruling. Henderson - mobile homes are not structurally designed to be added on to. Discussion. Soltys - the word dwelling holds a lot of weight. A single room designed to be an addition is all right. But a dwelling to a dwelling is not. An addition should be something less than a dwelling. Netzler - I think we should go with the Solicitor's wording. Netzler called the hearing adjourned at 2004 hours. The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Netzler at 2005 with the Pledge of Allegiance. MINUTES The minutes of August 26, 1993 were approved as presented in a motion by Ben Sitek and second by Dave Henderson. Carried. VISITORS Clarence Mischler - how does a township take over a road and do all roads have numbers? Netzler - by ordinance to vacate or accept and yes, all roads have numbers. Ben Sitek, Jr. - does DER handle all septic permits? Netzler - the Health Dept. does also through the S.E.O.'s. How many mobile homes is Ed Kuligowski putting in? Henderson - what he's doing is legal. That's a separate piece of property with a separate deed that he's buying from Norman Matthewson. Roy Lytle, Town and Country Realtors - showed a change on the original Shepegi Mylar which gives the Shepegi lot 8.95 acres and the Fulton lot 45.46 acres. The change was made after the Planning Commission signed the original Mylar. Supervisors determined that the change is inconsequential and does not make any difference to the Township. Soltys - questioned what the procedure would be if a Mylar was changed after the P.C. had signed it and the change was consequential. Sitek moved to approve the Shepegi/Fulton Mylar as presented with the change. Henderson seconded. Carried. Mylar was signed. Tim Vanco - stated that he plans on starting a pelletized fuel plant at his property on Silverthorn Road. Future plans are for a grain drying facility and an ethanol plant. He stated that the property is zoned I-1. He plans on making an office in his mobile home but will continue to live there. He was told to go ahead with his plans. (sec. note--upon research on 9/15/93 it was found that Mr. Vanco requested and was granted a zoning change from I-1 to A-1 on his property located at 11881 Silverthorn on March 13, 1990). Mr. Vanco also voiced his opinion on which roads should be paved. REPORTS Superintendent - Dave reported that grading, spot ditching and equipment repairs have been done. Blocks on Falls Rd. and New Rd. were installed. Supplies for winter have been ordered. He has called for cinders to be delivered. Netzler - the State feels they'll have to upgrade Old State because of the heavy equipment coming across it. Four Year Road Plan - on hold until special meeting on the 23rd. Milled Material - nothing. FINANCIAL AND TAXES Bills - Sitek moved to approve the bills as presented excluding Custom Clutch and Hoover Sand and Gravel totaling $3853.74 general fund and to pay the EIT claims as listed totaling $6,090.17. Henderson seconded. Carried. Payroll - Sitek moved to approve payroll #18-93. Henderson seconded. Carried. Computer Update - nothing. Blanket Honesty Bond - Dave Wagner, Wagner Ins. Assoc., will attend the Sept. 23rd meeting to discuss the bond issue, the safety meetings and the 5% workers comp. reduction for having safety meetings. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Grants - Herb reported that someone is interested in both pieces of Rodak property. Bldg. Permits Before Sup./P.C. - nothing. Letter to P.C. Members on Attendance - Dave reported that only Greg Soltys and Hugh Crandall are faithful in attending and arriving on time. A letter will be sent to the other members. Lechefsky Building Permit - Gerald Lechefsky wants to build a garage that will be 12 feet from the adjoining property line. He owns the adjoining property. Netzler - suggested that he take out a land contract for 3 feet of the adjoining property. Henderson - suggested he do a quick claim deed. Dave also said that a land contract between himself and himself should be recorded and then anyone buying in the future would find it in a title search. Netzler said he would talk to Gerry. SOLICITOR Mitchell Property - the Solicitor will draw up papers on the property. This will allow the Township to clean it up and receive payment from the $13,000 that is in escrow. The insurance company can clean it up or can pay us to do it. Girl Scouts/Tax Exempt - the Solicitor requested a copy of the minutes where the Board voted to object to their claim for tax exempt status on their rental properties. Ordinance #4-93/Structure to Structure - Henderson moved to adopt ordinance #4-93 as presented. Sitek seconded. Discussion on rewording it. Carried. OLD BUSINESS Sesquicentennial - update soon. Safety Meetings - see earlier mention. Tones Through Washington Twp. Tower - waiting for opinions. Clean Up - Town Hall has been sold and is being cleaned up. Nothing new on the Goodban School site. Boy Scouts Recycling/DER Contract - Dave suggested increasing the size of the present garbage area to include an area for the scouts and to fence and cover that section and our section. The Township will do the work "in kind". Dave moved to approve and sign the DER contract and to enlarge and cover the bin area. Sitek seconded. Carried. NEW BUSINESS Letter to Arthur Davis/DER - Ben moved to send Mr. Davis a letter stating that even though DER is revamping their operating procedures, they still have not addressed our problem of on lot sewage. Dave seconded. Carried. Storm Sewer Installation at FTVFD - Dave reported that the Township crew will install the storm sewer for the fire dept. including catch basins. The project should take 3 or 4 days. State Tax Convention - June Suhy will attend. Potholes on Silverthorn - Ben reported that there is a large hole by Donikowski's and Miller's.
