September 23, 1993 The special meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler at 0834 hours with the Pledge of Allegiance. Present were Netzler, Benjamin Sitek and David Henderson. FOUR YEAR ROAD PLAN Discussion on paving the remaining section of Fry Road and New Road east. Henderson - that section of Fry is cost shared with Washington Twp, only 7/10's of a mile is ours alone. It would take traffic off Silverthorn and put it onto Fry. Netzler - paving should be done to benefit taxpayers in the Township. It's cheaper to grade. Henderson - if we pave there's less maintenance. We would save money on grading. In the long term, it's not cheaper to grade. Discussion on requiring bonding for heavy trucks using the road. Tim Vanco arrived at 0845 hours. Vanco - I would like to see the south end of Silverthorn paved. There will be more heavy trucks over that end when my business goes in. Henderson - there is a provision in the law that says a specific bond can be required. The question is whether the Washington Twp. section would hold up. Netzler - I object to rezoning that section. To take the rest of the taxpayers money for that section isn't right. Henderson - it's a good spot. It will limit maintenance over our end of Silverthorn. Vanco is just a short drive to a state road. There's grant money available for that. It's hard to project 4 years into the future. Maybe we should consider front foot assessment. Sitek - I can understand Herb's opinion on Fry but it will relieve the traffic on Silverthorn and will finish that road off. Tim Vanco left the meeting at 0856 hours. The regular meeting of the Supervisors began at 0906 hours. Tom Findley, Findley Realtors, arrived at 0907 hours. Attorney Mark Richmond arrived at 0908 hours. Discussion on the 106 acre farm on Rt. 98 and W. Stancliff. Findley - let's explore the Township's involvement in a sewage plant. Henderson - there is grant money available for sewers. The problem would be water. We would have an advantage as far as storm water and the Lake Erie water shed. The system would be brand new and storm water wouldn't be added. Findley - said he would contact the property owners on the northeast side of Rt. 98 and W. Stancliff to see if they were interested in development. He would also contact our legislators to see what's available in grants and get back to us. Discussion on grants, PennVest and the need for a water feasibility study. Dave Wagner, Wagner Insurance Associates arrived at 0930 hours. Tom Findley left the meeting at 0940 hours. SAFETY MEETINGS--TWP./F.D. Wager - the requirements for a cost savings on workers compensation insurance isn't worth the effort needed. My recommendation is for a statement of commitment to a safe work area. Each Supervisor could take turns being the inspection agent. A committee on safe practices must be formed. You can post a physicians panel. The employee must go to one of the panel within five days of any injury to be paid by workers comp. I also recommend sending an employee to a quick care facility like Prompt Care or Immediate Care instead of the emergency room. The new attitude is on preventative care instead of waiting until you're sick. Wagner said that the cost of workers comp. for the fire department can be passed along to them. He also suggested that each incident be investigated. The injured party can be made to sit before a safety committee and explain the situation. Richmond - you don't want to create an inquisition and scare people off, you have to be reasonable. Wagner - you can make it clear that any work related injury must be reported and the employer can take the person to the health care facility. Dave will send us information pertaining to safety. HONESTY BOND Wagner - June Suhy's bonds for R.E. and E.I.T. are faithful performance bonds which includes June and anyone working at her direction. Any assistant is covered. It's a moot issue. The fire department members are employees. The Relief treasurer is bonded. The only Township exposure is on the $4,000 donation and you receive a listing of how the money was spent. The Board agreed with Wagner that nothing needs to be changed. The issue is settled. MINUTES Henderson moved to accept the minutes of September 14, 1993 as presented. Sitek seconded. Carried. VISITORS None present. REPORTS Superintendent - Dave reported that repairs have been made on pipes and equipment. Start on storm drains at FTVFD as soon as donated pipe from Zurns arrives. Some sign work done also. Dave suggested stockpiling 750 yds. of Girard gravel and 500 yds. of Zessinger with Russell Standard hauling. It was decided to haul in 1,500 yds. of Girard gravel with Russell Standard hauling and 150 yds. of Zessinger using our trucks. Milled Material from Airport - nothing to report. Henderson reported that he will be on vacation starting October 9 and returning on October 25. Sitek will be in charge in his absence. Fry Road Incident - Dave reported that Scott Sayers says his wife hit a rock on Fry at 2:30 p.m. and blew a new tire. Dave said at the time he had half the road raked. Richmond - have them send a bill and send it on to the insurance company. FINANCIAL AND TAXES Bills - Fry Road expenses to be paid to Washington Twp. will be as follows: $40,000 from Permanent Improvement, $9,357 from County Liquid Fuels, balance from General Fund. Total owed was $61,510.02 with $10,000 already paid from Permanent Improvement. Discussion on cost. Dave said the project is over budget by $2,400 over a two year period. Most of that expense was in B-19 laid in soft spots in 3 major areas that we put down before the paving. Dave also suggested holding payment of the $9,357 until the liquid fuel check comes. Dave moved to pay the bills as listed excluding Custom Clutch (jack is back there to be repaired correctly) and Hoover Sand and Gravel totaling $5,499.88 general fund, $2,563.88 equipment fund and $40,000 permanent improvement fund. Green Distributors (storm drains) will be held until the fire dept. can be billed, hold $9,357 from Washington Twp. bill until liquid fuel check is received. Ben seconded. Carried. Payroll - Ben moved to approve payroll #19-93 as presented. Dave seconded. Carried. Thank You to Fry Rd. Residents - letter was signed. Computer Update - nothing. Smith Billboard Fee - Dave moved to return Bill Smith's $15 billboard fee. Ben seconded. Carried. His request was shot down by Harrisburg. Monahan and Monahan - fee increase to $1,800. No argument. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Park Grant - Herb reported that DER reps. said a sewage plant can be installed and water would be no problem. Herb will call engineer Dave Johnson to come out. Henderson - questioned how DER finds out about water, could they check on the water at Rt. 98 and W. Stancliff. Discussion on sewage lift stations. Building Permits Before P.C./Sup. - nothing. Kuligowski Building Permit - Ben moved to extend Ed Kuligowski's building permit for the lot behind his present home on Old State. Dave seconded. Carried. Matha/Teed Building Permit - after the work was done on their building permit, they stated they didn't want it and didn't pay the $20 owed. Dave moved to pay MDIA the $20 owed them for work done, to collect building permit fees up front and to send Matha/Teed a letter requesting they pay for their permit or the bill will be turned over to DJ Stuck for collection. Ben seconded. Carried. SOLICITOR Cable TV - waiting for Bill Welsh. Coaxial is still interested in coming into the Township. Henderson - with the new cable regs. the whole ordinance needs revised. We're hanging in limbo. Netzler - REA said they have no plans to get into the cable business. Load Limit Ordinance - an engineering study needs to be done. Dave said at present we're just looking at Fry road which should cost $400. There are two ways to look at it, as a permanent posting and under emergency situations. No study is needed for an emergency. Dave moved to authorize D.A. Johnson to do an engineering study on Fry Road. Ben seconded. Carried. Dave suggested the traffic patterns on all our roads be considered. Netzler - we may only be able to post in March, April and May and not all year long. Mitchell House Fire - Lakeland Mutual sent a check for back taxes owed to the Mitchells. Tax Claim Bureau was paid. Netzler - I'm concerned about leaving the mess as it is. We need to make sure the $13,000 in escrow is not paid out until the property is cleaned up. The law says it's their duty to clean it up, if not, the Board can inform the insurance company that we'll clean it up and they have to pay. Ordinance #5-93/Fire Damaged Structures - Herb moved to advertise a hearing for the ordinance. Dave seconded. Carried. Girl Scouts/Tax Exempt - letter was sent to Talarico law firm. Eminent Domain - nothing. Hallett Clean Up - discussion on citing Mr. Hallett for clean up of his property. Netzler moved to have the Solicitor draw up charges, have Ben file them and take a check to cover the filing fee. Henderson seconded. Carried. OLD BUSINESS Sesquicentennial - Dave reported that a beef barbecue would be $10 per with a minimum of 500 people. A chicken barbecue by the people who do the Albion fair would be $5. A reservation system is needed. Dave suggested forgetting about the beef barbecue. Goodban Clean Up - nothing. Tones Through Washington Twp. Tower - nothing DER Grant/Garbage Fence - the grant gives $2,000 for the facility, we pay 10%, they pay 90%, the rest is for public education. Dave moved to hire Erie Fence to do the fencing for $1,900 and the Township do the concrete work. Ben seconded. Carried. NEW BUSINESS Storm Sewer/FTVFD - nothing. Legislative Dinner - all attending. CORRESPONDENCE Letter from Mrs. Cardullo - Dave moved to send a letter to Mrs. Cardullo saying she's done the right thing by involving the Health Dept. and to follow up with them. Ben seconded. Carried. Trash by Brine Tanks - Ben suggested having the fire dept. burn and bury what's up there. Herb said it would be better to burn and take the remains to a land fill. That is what will be done. Ben questioned whether a cable should be placed across the end of the drive. Herb said it wouldn't be necessary when ESTA comes in.
