November 9, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler at 1945 hours with the Pledge of Allegiance. Present were Netzler, Benjamin Sitek, David Henderson and residents of Silverthorn Road south. HEARING ON CONDITIONAL USE REQUEST OF JERRY LECHEFSKY/1945 HOURS Mr. Lechefsky, 11211 Silverthorn Road, is requesting a variance from the side yard requirement of 15 feet. Mr. Lechefsky also owns the adjoining property. No comments, no objections. HEARING ON THE ZONING CHANGE REQUEST OF TIM VANCO/1948 HOURS Mr. Vanco is requesting that his property at 11881 Silverthorn Road be rezoned from A-1 to I-1. In 1990 Mr. Vanco requested and received a zoning change from I-1 to A-1 on the same parcel. Vanco plans on establishing a wooden pellet and pelletized animal feed business. Pete Gregan - every time there is property zoning changes, it effects my property. Don Mead - expressed concern over increased traffic. He said Washington Twp. recommends using weight restrictions. Netzler - I don't think Tim has the backing anymore in light of recent events. Henderson - this piece is the only one that's not I-1. That whole section of Silverthorn is I-1. In light of Mr. Vanco's present situation, I would recommend just leaving the issue set until we must make a decision. Mary Newhall - I'm concerned with the neighbors he gets in that trailer. Sitek - we will notify you when the issue is raised again. The following neighbors of Mr. Vanco went on record with their opinion of the zoning change request: Don Mead - opposed to the change because of increased traffic. Mary Newhall - opposed for the same reason. Dana Volkman - opposed for the same reason. Pete Gregan - opposed for the same reason. Jim Pfadt - is not opposed, sees no problem with the change. Ben Sitek, Jr. - voiced his objection with some of the materials Vanco said he would use in the process, like plastic. The regular meeting schedule began at 2007 hours. VANCO REZONING REQUEST Henderson moved to table the issue. Sitek seconded. Carried. LECHEFSKY VARIANCE REQUEST Netzler moved to approve the request. Sitek seconded. Carried. MINUTES Sitek moved to approve the minutes of October 28, 1993 as presented but noted that the Thursday morning meeting mentioned is on Friday the 19th. Henderson seconded. Carried. VISITORS Denver Ireland - don't grade Silverthorn. Sitek, Jr. - don't grade Silverthorn, there's not enough base. Until it's graveled, leave it alone. It seems to be holding up now even with all the rain. Henderson - we top spread 30 loads of gravel on it this spring. The residents should get up a petition and sign up 51% of the front footage on the road, present it to this Board and we have to pave it. Front foot assessment for paving is a one time cost. Maintenance is up to the Township. The cost is $7 per foot spread over several years. We'd have to get a bond for 10 years plus interest. Figure out your cost per foot and spread that cost over ten years. For those who can't pay, a lien would be placed on the property. Whenever it was sold, the lien would have to be paid. Discussion on corner properties. Netzler - we'd have to make sure you residents had the required 51%. Henderson - each section of the road stands on it's own. Ireland - I'm opposed to front foot assessment. Sitek - in my opinion, the next section of road to be paved is Fry to the McKean Twp. line. Discussion. Henderson - Silverthorn is scheduled for gravel in 1995. Sitek, Jr. - my driveway has a 8-12" drop. Henderson - your pipe is too high. We need to ditch up past your sister, take out the pipe and reset it. We lose a half inch of road a year. The more often you work it the faster the erosion. Netzler - when roads are graded, we are not allowed to pick up the blade for driveways, it's the law. Ireland - do more ditching. Ditch my property and put the dirt in my yard. I'll move it myself. Henderson - we have been spot ditching. Discussion. REPORTS Superintendent - Dave reported that snow was plowed, roads cindered, equipment is being readied, p.m.'s done, potholes patched on Falls and Francis. We lost an injector on the Hough. No parts are available and we're looking for alternatives. The mechanic from Anderson Equipment said he will pull the injectors and turbo and put it back together for $500. The parts will be sent out for rebuild. Herb added that Erie Diesel can do the work. 4-Year Road Plan - Dave said that for the budget process, we will work with what's there. Earl Koon, Washington Twp., said they will ditch Koman by OTM. Milled Material - no action until the Attorney is present. FINANCIAL AND TAXES Bills - Sitek moved to pay the bills as listed totaling $3,917.27 general fund. Henderson seconded. Carried. Payroll - Ben moved to approve payroll #22-93. Dave seconded. Carried. Computer Update - nothing. Tax Anticipation Note, 1993 - Dave moved to pay off the T.A.N. with the snow plowing money, request forms for 1994, remaining cash to go into the general fund. Ben seconded. Carried. Confidential Tax Info. Agreement - Dave moved to sign the agreement. Ben seconded. Carried. Dave moved to authorize June Suhy as our representative to receive the info. and apprise her of the confidentiality rules. Ben seconded. Carried. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Parks Grants - coming along. Building Permits Before Sup./P.C. - nothing. Matha/Teed - certified letter will be sent, will bring up the issue at the 19th meeting. Koestel Rental/Cardullo - Herb reported that the Health Dept. ruled the house is uninhabitable until repairs are made. BOCA Code for Rental Units - Herb said the Health Dept. says you can adopt the BOCA code for rental units only. This could help solve the problem of trashy mobile homes also. Dave suggested getting Joe Franks from MDIA here for the 19th meeting. Will do. Water in Basement/Koestal Rental - Herb reported that the Solicitor feels the Township may be liable if someone drowns in the water filled basement. Dave asked about the Mitchell property. We will ask the Attorney what to do. Copies of Zoning Ordinances from Springfield, Girard, Washington Twp. - Dave moved to ask for copies of the above mentioned zoning ordinances. Ben seconded. Carried. P.C. Opinion on Res. as Cond. Use in B-1 - the P.C. recommended changing "single family residence" to "dwelling" thus keeping the wording the same as in I-1. Henderson moved to amend the proposed zoning amendment to "dwelling" instead of "single family residence" and to advertise for a hearing. Sitek seconded. Carried. SOLICITOR Cable TV - nothing. Load Limit Ordinance - nothing. Eminent Domain - nothing. Girl Scouts/Tax Exempt - Attorney's letter says he is waiting for a hearing to be set up by the Board of Assessment Appeals. OLD BUSINESS Sesquicentennial - nothing. Clean Up Goodban School - refer to eminent domain. Safety Meetings - nothing. DER Contract/Recycling - waiting for revised contract. FTVFD Tones - drop from agenda. Health Care Provider List - waiting for response from Jim Orth. Letter to Arthur Davis, DER - Dave reported that the letter to Arthur Davis, DER was sent. The reply received was a bureaucratic whitewash. No satisfaction. Discussion. NEW BUSINESS Appoint Gary Shelhamer as Deputy Tax Collector - Netzler moved to appoint Gary Shelhamer as June Suhy's deputy tax collector. Henderson seconded. Carried.
