December 14, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler at 2000 hours with the Pledge of Allegiance. Present were Netzler, Benjamin Sitek and David Henderson. HEARING ON ORDINANCE #6-93, DWELLINGS AS CONDITIONAL USE IN B-1 No comments. Henderson moved to approve Ordinance #6-93, dwellings as a conditional use in B-1 zoned districts. Sitek seconded. Carried. MINUTES Ben moved to accept the minutes of November 18, 19, 1993 as presented. Herb seconded. Carried. VISITORS None. REPORTS Superintendent - Dave reported that employees are on lay off, cindering was done as needed. Four Year Road Plan - nothing. Milled Material - the Attorney sent a letter stating that he feels there are grounds for a lawsuit. Henderson - set up a meeting with the Attorney to discuss the matter further. All agreed. Will do. Bill Board I-79 and W. Stancliff - Dave reported that the sign is in the Township right-of-way. PennDOT has no record of a permit for the sign, nor do we. He said he will contact 3-M and ask them to move the sign. Plans are to cut back the banks along the bridge this spring. Hough 2 Engine - Dave reported that the turbo charger is bad and there may be parts in the engine. He feels that if the cylinders are bad it's not worth 3 or 4 thousand dollars in repair, will keep for parts. Netzler - after checking for parts in the engine, call me and I'll check without pulling the injectors. Discussion. Cinders - Herb said he called Beute and Bliley and they thought we'd received cinders. Dave said we haven't. He talked to the driver and told him he could load the truck fuller. Dan's reaction was not to deliver any cinders. Dave felt he overreacted to the short load query. Netzler - we can't afford to haul with our single axles. Henderson - if we can arrange to have Russell Standard haul in the winter, great, it's their off season. If not, we'll have to hire someone. I've ordered 4 loads of anti-skid from Bed Rock. We'll see if it stays on the road any better. We may eventually need a three sided building. Discussion on 2% money. FINANCIAL AND TAXES Bills - Dave moved to approve the bill list totaling $9,664.54 general fund. Ben seconded. Carried. Payroll - Ben moved to approve payroll #24-93 as presented. Dave seconded. Carried. Computer Update - nothing. Exonerate Taxes on Gresh, Kavelish Trailers - taxes are for 1991 on Kavelish and 1992 on Gresh. Gresh trailer was removed. Kavelish trailer is a small old camper type not lived in for years. Henderson moved to make the following resolution: c8RESOLUTION #3-93 BE IT HEREBY RESOLVED THAT the Supervisors of Franklin Township, Erie County do exonerate and forgive the municipal taxes owed on the trailer owned by William Gresh index #22-6-20.0-5.51 for the year 1992. Also, to exonerate and forgive the municipal taxes owed on the trailer owned by Esther Mae Kavelish index #22-2-13.0-4.51 for the year 1991. Sitek seconded. Carried. Accounting Program Update - Dave presented literature on an updated accounting program from Cougar Mountain. He added that no money was put in the budget for it but can adjust it to include the amount of $599.50 plus shipping and handling. Discussion. Dave moved to order the accounting package. Ben seconded. Carried. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Parks - meeting Monday, 20th at 1:30 in Twp. office. Matha/Teed - it was reported that they have moved out. Dave moved to file suit at D.J. Stuck's office and have the constable serve the suit. Ben seconded. Carried. BOCA Code for Rentals - code book from MDIA handed out. Supervisors will read it. Harman Sign - Mr. Harman told the Planning Commission that his neighbors refused to allow the sign on their property. He plans on erecting a large mailbox with the name on it. Supervisors agreed and a letter will be sent along with the approved mailbox design. The Harmans will then be in compliance with the stipulations on their home occupation. Billy Roberts Business in A-1 - Herb said he has a permit for his garage. Henderson - I'd like to see him move the business onto Rt. 98., less damage to the roads. I'd like to get grant money to move him. Netzler - we're working on grants to move him. I'd like to see him off the dirt road too. Are you changing that pipe on the end of Eureka and Crane next season? Henderson - there's money in the budget for it. We can do it. SOLICITOR Cable TV - nothing. Load Limits Ordinance - waiting for engineering study. Girl Scouts/Tax Exempt - letter received and reviewed. Eminent Domain - nothing. Intra-Global/Szymanowicz - Joe said his variance was for light industry not a home occupation. Will check back minutes. OLD BUSINESS Sesquicentennial - nothing. Safety Meetings - nothing. Health Care Provider List - nothing. Revised DER Grant Contract - reviewed. Ben moved to sign the documents. Dave seconded. Carried. Signed. NEW BUSINESS Mining License - Dave moved to complete the form and send the check for $300. Ben seconded. Carried. Acknowledgement of Employee Rights - form will be retyped and presented next meeting. National Heritage Inventory - reviewed the map. If adopted by the County it will restrict use of all areas listed. Henderson - a large chunk of the county will be eliminated from development. There are no clearly defined boundaries. E.C.A.T.O. has objected to county council about this study. They said they wouldn't sign until further study. The association feels this would take away from the municipalities the right to manage their own townships. This has the appearance of another wetlands issue. Door Operator Building #2 - proposal from Lake Erie Supply reviewed. Ben moved to purchase and bill one opener this year and purchase and bill one opener in 1994 for building #2. Herb seconded. Carried. Farmer Mylar - Ben moved to approve the Mylar. Dave seconded. Carried. Mylar signed. Cummins Engine - received offer to buy. Twp. will keep the engine. F.T.V.F.D. Contract for 1994 - Ben moved to sign the contract. Dave seconded. Carried. Attorney to Attend Organizational Meeting? - need not attend. VISITOR Ben Sitek, Jr. - said he fixed the end of his drive. Can you pick up the grader blade. Dave said he couldn't do it. CORRESPONDENCE PSATS - is asking for townships to request moving HB #2202-2214 from House Finance Committee to the floor. Ben moved to send our legislator a letter making this request. Dave seconded. Carried. F.T.V.F.D. Installation Banquet - Herb, Ben and Dave will attend.
