December 23, 1993 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler at 0900 hours with the Pledge of Allegiance. Present were Netzler, Benjamin Sitek, David Henderson and Attorney Mark Richmond. MINUTES The minutes of December 14 were accepted as presented in a motion by Ben and second by Herb. Motion Carried. Discussion on whose pipe is at the corner of Eureka and Crane, ours or PennDOT's. Herb will call Don Dolecki of PennDOT. VISITORS None. REPORTS Superintendent - Dave reported cindering and plowing has been done as needed. Cost for removal of our truck from the ditch will be expensive, two wreckers were needed. Sitek - should we plow when the drivers can't see? Someone may be seriously injured some day. Should we widen the corners? Netzler - it's hard to call. I think those plows are the problem. When they bite in and trip, you can be right in the ditch. When they're down there's no feel for the front end. Maybe the tires are too wide for the plows. Discussion on complaint callers not giving their names. All agreed, no name, no complaint. Four Year Road Plan - nothing. Milled Material from Airport - it was announced that an executive session was held on Friday, December 17 at 2 p.m. with Attorney Richmond. Henderson moved to authorize Mark Richmond to make initial contact with the defendant officials and corporations to make claim for damages for Franklin Township regarding the milled material from the airport that was not received. Sitek seconded. Carried. Billboard/W. Stancliff - Dave reported that the billboard is grandfathered in. There is no permit as it was erected prior to the Act. The problem is it's in the Township right-of-way and Bizzarros are getting money for it. We need Bizzarro's permission to feather dirt removed from the banks onto their property. Discussion. Dave said 3-M would want to remove the sign, we'll do the work and they will replace it. He will get that agreement in writing. Dave added that the Township cannot afford to haul away all that dirt. Hough Engine - nothing. Cinders - salt and cinder mix is working well. Traffic Count on Crane - Dave reported that he feels Crane gets as much traffic as Old State and it's status should be upgraded by PennDOT from E to D. If it is, our snow plow contract amount would increase. Herb moved to authorize Henderson to write to PennDOT requesting a traffic count be done in April. Ben seconded. Carried. FINANCIAL AND TAXES Bills - Dave reported that the bill for one door operator is in from Lake Erie Supply. He suggested cutting the check in 1993 but holding it until the work is done. Ben moved to pay the bills as listed totaling $5,820.02 general fund and to include EIT claims listed totaling $6,106.12 eit fund. Herb seconded. Carried. Payroll - Ben moved to approve payroll #25-93 as presented. Herb seconded. Carried. Computer Update - nothing. F.D. Fund Transfer Checks - Dave moved to authorize the transfers and sign the checks. Ben seconded. Carried. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Park Grants - the meeting on grants was held on Monday the 20th. Discussion on a plastics recycling plant. Henderson - we would put in the infrastructure. The plant would be run by a private establishment. You need to put together a business proposal to request information needed from companies. Richmond - presented a letter he received from Recovery Systems Technologies. He explained that Bill Welsh had contacted them asking for information but would not tell the company why he needed it or who wanted it. The letter from the president of that company addressed his concern over Bill's request. Netzler - any costs known ahead of time will be brought before the Board. BOCA Code for Rentals - Dave said that consideration must be given before any code is passed. It's big government, an intrusion, extra cost to the Township and charge to residents. It's advantage is that by starting small problems can be corrected as we go along. Netzler - the disadvantage is that it involves everyone if passed. I can live with the status quo. Richmond - I can see a legal challenge if restricted to rentals only. You want to see everything maintained. Henderson - renters do not have control over a structure, owners do. We don't want to tell a homeowner how he should live in his own home. Richmond - it would be for all residents heath, safety and concern. I can see more MDIA inspections, more legal action if passed. Henderson - think on it. This code is for existing structures. If we adopt this we need to adopt a new structure code also to equalize the playing field. The cost would be considerable. Think 20 years into the future. SOLICITOR Cable TV - Bill Welsh is to give us a list of potential cable carriers. Load Limit Ordinances - Dave moved to advertise both ordinances. Herb seconded. Carried. The engineering study should be done soon. Girl Scout/Tax Exempt - letter says 1993 taxes are forgiven due to County mistake but taxes will be owed thereafter. Eminent Domain - the school district said they will forgive their portion of taxes owed if county does also. Mark reported that Barry Drew of the county suggested another route. Because taxes owed are in excess of ten years, the county can sell the property at private sale. With eminent domain it must be used for a public purpose. Richmond - if the property owner won't sell to us then we need to eminent domain but will cost over $300. I will contact the county again for more information. Sitek - if we buy, we can do anything we want with it including selling it to the neighbor. Henderson - if the money is for expenses involved, all right, but if it goes toward the county portion of back taxes, it's not fair to the school district. IntraGlobal - Joe Szymanowicz has a variance for light industry from the Zoning Hearing Board. Netzler - if Joe was given a variance, IntraGlobal should be given the same consideration. Henderson - the difference is the public had a chance to comment on Joe's request. He went through the proper channels. These people didn't. It's a different story entirely. Netzler- if they come and ask, we will consider the request. Henderson - call the Health Dept. and see if they checked on the septic. If they won't do anything, Mark should send a letter telling IntraGlobal they need a variance and be more forceful. OLD BUSINESS Sesquicentennial - committee will step up activities. Safety Meetings - nothing. Health Care Provider List - waiting for Erie Insurance. Acknowledgement of Employee Rights - read form, wait for list. NEW BUSINESS c8RESOLUTION #4-93 BE IT HEREBY RESOLVED THAT the Supervisors of Franklin Township do adopt the tentative budget for 1994 as advertised and amended. Henderson moved to adopt resolution #4-93. Sitek seconded. Carried. Amend 1993 Budget - Henderson moved to amend the 1993 budget to reflect actual revenues and expenses including adjustments and auditors adjustments. Sitek seconded. Carried. RESOLUTION #5-93 BE IT HEREBY RESOLVED THAT the Supervisors of Franklin Township authorize the securing of a Tax Anticipation Note for $25,000 from PNC Bank for 1994 and the signing of all necessary documents related to said note. Henderson moved to adopt resolution #5-93. Sitek seconded. Carried. Authorize Henderson to Sign Treasurer's Bond - Sitek moved to authorize David Henderson to sign as a witness the Treasurer's Bond. Netzler seconded. Carried, one abstention, Henderson. c8RESOLUTION #6-93 BE IT HEREBY RESOLVED THAT the Supervisors of Franklin Township set the tax levy for 1994 at seventeen (17) mills: General Fund, 9.0 mills, Fire Department, 2.5 mills, Municipal Building, 0.5 mills, Equipment, 2.0 mills, Permanent Improvement, 3.0 mills. Henderson moved to adopt resolution #6-93. Sitek seconded. Carried. c8RESOLUTION #7-93 BE IT HEREBY RESOLVED THAT the Supervisors of Franklin Township appoint the certified public accounting firm of Monahan and Monahan to conduct the audit of the financial accounts of Franklin Township and the Township officers in accordance with the laws of the state of Pennsylvania. Henderson moved to adopt resolution #7-93. Sitek seconded. Carried. CORRESPONDENCE Upcoming training sessions reviewed. Netzler will attend Erosion Control on Feb. 10, 1994.
