January 3, 1994 The organizational meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Herbert Netzler with the Pledge of Allegiance at 0900 hours. Present were Netzler, Benjamin Sitek and David Henderson. ORGANIZATIONAL AGENDA APPOINTMENTS: Temporary Chairman - Sitek moved to appoint Herbert Netzler, Henderson seconded. Carried. Temporary Secretary - Sitek moved to appoint Bonnie Bernhardt, Henderson seconded. Carried. Chairman - Henderson moved to appoint Ben Sitek, Netzler seconded. Carried. Vice Chairman - Henderson moved to appoint Herb Netzler, Sitek seconded. Carried. Secretary/Treasurer - Henderson moved to appoint Bonnie Bernhardt, Netzler seconded. Carried. Vacancy Board - Henderson moved to appoint Paul Sachar, Sitek seconded. Carried. Solicitor - discussion on hiring a different firm. It was mentioned that we need to stay with someone involved with municipal work. Henderson moved to table the issue but to allow Schroeck and Associates to continue to act on our behalf until the first meeting in February. Netzler seconded. Carried. Herb will call George Schroeck and arrange a lunch meeting to discuss the issue. Secretary/Planning Commission and Zoning Hearing Board - Henderson moved to appoint Bonnie Bernhardt, Netzler seconded. Carried. Act 511 Tax Collector - Netzler moved to appoint June Suhy, Henderson seconded. Carried. Zoning Administrator - Netzler moved to appoint Bonnie Bernhardt, Henderson seconded. Carried. Planning Commission - Netzler moved to appoint Clyde Porter and Pat Platz, Sitek seconded. Carried. Zoning Hearing Board - Netzler moved to appoint Mary Jane Rodak, Sitek seconded. Carried. Executive Board of E.C.A.T.O., delegate and alternate - Henderson moved to appoint Sitek as delegate and Henderson as first alternate and Netzler as second alternate. Netzler seconded. Carried. State Convention Delegate - Netzler moved to appoint Ben Sitek, Henderson seconded. Carried. Roadmaster - Sitek moved to appoint Dave Henderson as Roadmaster, Ben Sitek as first assistant and Herb Netzler as second assistant, Netzler seconded. Carried. Equipment Operators and Laborers/Temporary Drivers and Substitutes - Netzler moved to approve Dave Henderson, Ben Sitek, Herb Netzler, Rick Gould, Ray Swift, John Sachar, Duane Taylor, Dennis Swift, Danny Swift, Wayne Cousins, Joe Johnson, Larry Pieper, Gary Simpson, and Jamie Sachar. Henderson seconded. Carried. Representative to Northwest PA Regional Planning and Development Commission - will leave open. Representative to Erie County Planning - will leave open, will ask Planning Commission members if anyone is interested. C.P.A. Firm Appointment - Henderson moved to appoint Monahan and Monahan, Sitek seconded. Carried. Appoint County to Collect Real Estate Transfer Tax - Netzler moved to appoint Erie County to collect the realty transfer tax, Henderson seconded. Carried. COMPENSATION AND MILEAGE RATE: Recommend to Auditors--Mileage - Henderson moved to recommend 28 cents (.28) to the auditors, Sitek seconded. Carried. Wages--Roadmaster - Henderson moved to recommend to the auditors a 3% cost-of-living raise for the Roadmaster (.32, $10.72) and Supervisor/Laborers (.28, $9.12), Sitek seconded. Carried. Wages--Laborers and Equipment Operators - Henderson moved to approve a 3% (.24, $7.80) cost-of-living raise, Sitek seconded. Carried. Wage Rate for New Drivers - Henderson moved to fix the wage rate for new drivers at $7.50 for 3 months, Sitek seconded. Carried. Zoning Administrator - Henderson moved to set the wage rate for the zoning administrator at $7.80/hr., Netzler seconded. Carried. Secretary/Treasurer - Henderson moved to set the wage rate for the secretary/treasurer at $7.80/hr., Netzler seconded. Carried. Act 511 Tax Collector - Henderson moved to pay the tax collector 4% of taxes collected plus expenses, Netzler seconded. Carried. Compensation for Selling Garbage Bags, Walter & Suhy - Henderson moved to pay Walter and Suhy five cents (.05) per bag sold, Sitek seconded. Carried. Set Solicitor Wage - hold until first meeting in February. OTHER: Roadmaster Duties - Henderson moved that the Roadmaster duties are as outlined in the Second Class Township Code and as determined by the Board of Supervisors, Netzler seconded. Carried. Ben mentioned that he would like to see the Roadmaster use his vehicle and check roads before they are graded or plowed. Do the worst roads first even if they are not scheduled to be done at that time. Duties of Other Employees - Netzler moved that the other employees duties will remain the same and as determined by the Roadmaster and the Board of Supervisors, Henderson seconded. Carried. Herb added that employees will be notified that when they are approached by taxpayers in the field, the only answer they are to give is to contact the Board with their problem. This will be added to the Acknowledgement of Employees Rights form. Meetings Dates and Time - Henderson moved to hold meetings on the second Tuesday of each month at 8 p.m. and on the last Thursday of each month at 9 a.m. in the Township office. Meetings will be moved to the F.T.V.F.D. social hall in case of an overflow crowd. The 1995 organizational meeting will be held on January 2, 1995 in the Township office at 9 a.m. Budget sessions will be held on November 14 and 17 at 9 a.m. in the Township office. The November last Thursday meeting will be moved to November 18 because of Thanksgiving. Netzler seconded. Carried. Office Hours - Henderson moved to hold office hours on Tuesdays and Thursdays from 8 a.m. to 4 p.m. excluding lunch, Sitek seconded. Carried. Recommend Treasurer Bond Limit - Henderson moved to recommend $100,000 to the auditors, Sitek seconded. Carried. Depository for Township Funds - Henderson moved to approve PNC Bank and PLGIT as the depositories for Township funds, Netzler seconded. Carried. Review Procedures for Selling Garbage Bags and Review Price - Henderson moved to let the price stand at $1.50/bag until the bidding process in the third quarter of 1994, Sitek seconded. Carried. Approve Advertising for Bids - see regular agenda. Review Charges for Ordinances, etc. - Henderson moved to charge $6.50 for ordinance books, Netzler seconded. Carried. Review Schedule of Fees for Highway Occupancy Permits - Henderson moved to set the fee at PennDOT rates. A $35 installation fee/no permit required for replacing an existing pipe; state road - $35 installation fee/no permit for new pipe; state road and township roads for replacement pipes - $35/install 20' pipe, $52.50/install 30' pipe, $70/install 40' pipe; new pipe on township roads - $25/permit $10/installation of 20' pipe, $25/permit $27.50/installation of 30' pipe, $25/permit $45/installation of 40' pipe. Sitek seconded. Carried. Custodian - Petty Cash - Henderson moved to appoint Bonnie Bernhardt, Netzler seconded. Carried. Attendance at Schools, as pertains to duties - will remove from agenda as attendance is allowed by the Second Class Township Code. REGULAR AGENDA MINUTES Netzler moved to accept the minutes of December 23, 1993 as presented. Henderson seconded. Carried. VISITORS None. REPORTS Superintendent - Dave reported that plowing has been done. We have received several complaints of mailboxes being hit. Norbie Hayes on Silverthorn had his box hit but it sits too close to the road. Henderson - if he would put the box in properly, we wouldn't need to weave around it. In most cases boxes are hit by snow coming off the plow. Netzler - the boxes on Silverthorn should be changed but it's the homeowners responsibility to tend to their box. Herb moved to write to the Postmaster in Edinboro and ask that the boxes on Silverthorn be changed to the east side of the road and change the delivery route. Ben seconded. Carried. Complaint on Pheffer - road was icy. Dave said it may have inadvertently been skipped. Ben added that it rained on that side of the route while it was snowing here. Herb said to send the Mack down that road when it's that icy. Dave said PennDOT asked us not to use brine on it. Damaged Vehicle - Dave said he dinged a vehicle while rounding off the corner of Carbury and Rt. 98. He put the wing down on a car parked on the corner. Our insurance company has been notified. Discussion. Four Year Road Plan - Ben wants to start discussing it soon. Milled Material - waiting. Hough Engine - work on it when we get a break in the weather. Cinders - Dave reported that we received 3 loads. For 1995 we should look into a three sided shed. Netzler - check into 2% money and build it this year if possible. Discussion on how to build it. Dave will check into 2% money. FINANCIAL AND TAXES Payroll - Ben moved to approve payrolls #26-93 and #27-93, Dave seconded. Carried. Bills - Herb questioned the price difference between Carlson and West County for towing. Dave said he called Carlson before he called West County but Carlson was snowed in. West County is his last choice because of the expense. He added that in the spring we will pipe trouble spots New and Mohawk and Eureka and Crane. Ben moved to pay the bills as listed in 1993 except for Orth Insurance and Trustees Insurance Fund which will be paid in 1994 totaling $4,032.04 general fund. Dave seconded. Carried. Computer Update - nothing. June Suhy's Bond - situation was discussed. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Park Grants - waiting. BOCA Code for Rentals - still reading. SOLICITOR No action on any items. OLD BUSINESS Sesquicentennial - Edith Swift and Bob Berry will gear up soon. Health Care List - waiting. Employee Rights - waiting. Safety Meeting - Dave said we can have Jim Orth send out their safety man to discuss general safety. He feels simple injuries should go to Prompt Care instead of the emergency room. NEW BUSINESS Bid--Fuel - Dave moved to bid for gas and diesel fuel in the same amounts as last year. Ben seconded. Carried. Bid--General Trucking - trucking will amount to a minor amount and will not need to be bid. Bid--Gravel Crushing and Trucking - will entail crushing and hauling to road. Herb feels the bid should be split. Dave feels that Hoover, Woods and Arendash will bid as it stands. Herb said he would like to see McKenrick haul for general trucking. Dave added that our gravel trucking won't fit into Russell Standard's schedule. Dave moved to bid for gravel trucking, crushing of 10,000 cu. yd. of gravel and to get quotes for general trucking and bank removal. Ben seconded. Carried. Netzler - I'm against using a shovel on the banks. We should use a bulldozer. Sitek - get the letters out first and the response back then discuss it. State Convention - Ben and Dave will attend. Microwave Oven for Office - Ben moved to approve up to $150 for the purchase, Dave seconded. Carried. CORRESPONDENCE Upcoming training sessions reviewed.
