January 27, 1994 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek with the Pledge of Allegiance at 0901 hours. Present were Sitek, Herbert Netzler, David Henderson and Attorney Mark Prenatt. MINUTES The minutes of January 3, 1994 were corrected to read on pg. 116 that the letter to the post master would include Silverthorn and Eureka roads. Dave Henderson moved to accept the minutes as corrected. Herb Netzler seconded. Carried. VISITORS None. REPORTS Superintendent - Dave reported that with the amount of plowing done, we are close to our budgeted amount for the year. Budget was $22,000, amount spent is $19,000. We may need to modify the summer road program. Sitek - before taking out of the gravel program, look into not cutting back the banks on West Stancliff. Henderson - those banks are more important, that road is dangerous. If we don't cut the banks back, we won't gravel that road. It was to be rebuilt this year. Discussion. Sitek - Dave has worked 32 days straight, we should look into getting relief for him on the weekends. It would give him a break so he could get some sleep. Have Herb take one weekend and Dave another. Netzler - it would help to cut down on overtime also. I'd take a weekend. Four Year Road Plan - nothing. Hough 2 Engine - Dave reported that no loose parts have been found in the engine, will try starting it soon. Phone Box Repair - Dave said the pedestal has been hit twice and neither time was by a township vehicle. Netzler - GTE said they would move it years ago. Send the bill back and tell them to move it. Herb moved to not pay the bill from GTE North for pedestal repair. Dave seconded. Carried. County Liquid Fuel Contract - hold until February. Snow Plowing Across or Onto Roads - Herb said to send the JCB out, move the snow and bill the homeowner for time needed to move the snow. Henderson - they're leaving piles the plows can't move and leaving humps of snow in the roadway. Only a couple of people clean up well after themselves. Most leave a mess in the road and cause humps. Sitek - should you inform the people through the media? Henderson - we should go around and observe problem areas then decide if we need to move it with the JCB. If we do, bill the homeowner. There must be 20 places on township and state roads. We need to tell the people not to do it. Netzler - for the people on Mohawk from Vincent to Vincent, clean it up and bill them. That area is really bad. Prenatt - do Mohawk if it's a safety hazard. Send a letter to the others that they will be billed if the JCB is needed to move the snow put onto the road and berms from their driveways. Herb will take the west side and Ben the east side and compile a list of offenders. Herb added that it's the homeowners liability if their snow causes an accident. The letter will say that the homeowner will be billed if the Township needs to use extra equipment and manpower to move snow put onto berms and roadways from driveways and that it's illegal to plow across the roadway. JCB Backhoe - Dave reported that the auctioneer says it's resale value is at it's peak this year and next. We should consider replacing it. It's been down several times which can be crucial. We can get caught and not be able to load cinders. Netzler - no way on replacing it. Sitek - it was abused twice last summer while replacing the tiles on Fry. Come up with figures and run them by us. Henderson - we should be able to get into a new one for $25,000. We should plan on continuing a replacement program that keeps the reliability factor high. Netzler - you dodged the bullet last year when the rear end went out of one of the trucks. Plow for Grader - Dave said the one we're using is Elk Creeks. We need one before next snow season so we can give theirs back. Netzler - will check with surplus. Overweight Ordinances - the engineer says to put a three ton limit on Fry road from March 1 to May 31 during frost season. Henderson - everyone posts a 10 ton limit. Sitek - we can't post 3 ton, that's too low. Netzler - Johnson has his liability. He isn't going to stick his neck out. Even posted, you can't stop someone from using that road to deliver. Henderson - the law says they'd have to post a bond. I think we should post for 10 ton. Netzler - Johnson went by the book. Discussion. Prenatt - you can give the milk hauler a permit and not require a bond because he has to pick up the milk. A construction company must post a bond because they can wait. Netzler - the hauler would be backing in blind at Olsavskys if we made him come onto Fry from Crane. Whose liability is it. Sitek - you'd save 90% of the road by coming in from Crane. That hauler runs Silverthorn in the spring when there are no farmers on that road. He's just avoiding other posted roads, that's not fair either. Have Mark check with PennDOT and other townships on wording for the sign. Sitek moved to approve both weight limit ordinances for advertising with a six ton limit on Fry Road, hold a hearing on February 24 and have Mark Prenatt get the wording for the sign from PennDOT. Henderson seconded. Carried. Postmaster/Silverthorn and Eureka - Herb will write another letter with limits on rerouting on those two roads. FINANCIAL AND TAXES Bills - Dave moved to pay the bills as listed excluding GTE repair bill ($278.44) totaling $14,659.77 general fund. Herb seconded. Carried. Payroll - Herb moved to approve payroll #1-94 and #2-94. Ben seconded. Carried. Computer Update - nothing. Ben asked if Bonnie could take over all computer functions if Dave was incapacitated. Dave answered no. PLANNING, ZONING, HEALTH DEPARTMENT Industrial Parks Grants - no update. BOCA Code for Rentals - Ben said it better be for rentals only, it would be a problem for homeowners. Netzler - it would be challenged on rentals only, leave it alone altogether. Henderson - there's one advantage, it would effect the situation 20-30 years down the road. That's called legislative foresight. Netzler moved to drop BOCA code for rentals off the agenda. Sitek seconded. Carried. Planning Commission Appointment - Herb moved to appoint one member, Clyde Porter. Ben seconded. Carried. Matha/Teed - Matha is long gone, Teed filed for bankruptcy. Herb moved to drop it, Dave seconded. Carried. SOLICITOR Mark Prenatt expressed his appreciation for the chance to work with the Township and asked that his list be prioritized. Done. Airport - Herb said that the Authority attorney Don Wright is to send Schroeck and Associates a letter on the situation. Wright says the airport had no right to give that material to us. It belonged to Chemung. Prenatt - we should get Chemung involved too. We should have a meeting with Chemung and Don Wright. Netzler - I think we should file charges first and negotiate later and serve Rosemary Palmer before she moves to Tallahassee. Prenatt - I will schedule a meeting as soon as possible before Palmer moves. I can file a writ at the Courthouse and get her served. Front Footage on Silverthorn - discussion on the letter from Bonnie Chernicky and problems with getting frontage on properties on Silverthorn. Prenatt - we can check all the deeds. Henderson - a surveyor or his helper could do it. IntraGlobal - waiting to hear from the Health Dept. Eminent Domain - Mark will do more research and get back to us for the next meeting. OLD BUSINESS Sesquicentennial, Safety Meetings, Health Care Provider List, Employee Rights - nothing. NEW BUSINESS Fire Department Request to Plow Lot - Herb said we can't overlook our legal responsibility to the taxpayers and do that parking lot first to the expense of the Township roads. Sitek - it's too much for the JCB. Netzler - to do it right you need the grader and JCB, that's 2 men. It's too much. Henderson - if we create a windrow with our plows, a little plow can't move it. Sitek - when we're done with the roads, how long to make 3 rounds around the building? Henderson - 15 minutes. Netzler - the problem with the request is for the lot to be cleaned before bingo and other functions. Ben will talk to President John Hudy and tell him what we're willing to do. FTVFD Fundraisers - Herb moved to approve the presented list plus bingo, Dave seconded. Carried. Evacuation Agreement - Mark will work on an emergency evacuation agreement between Franklin Township, McKean Township and Washington Township. CORRESPONDENCE Training sessions reviewed. Herb will attend "Workers Comp. for Fire Departments" and moved to talk to the fire dept. and the Township pay for those members wanting to attend. Dave seconded. Carried.
