April 28, 1994 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek at 0900 hours with the Pledge of Allegiance. Present were Sitek, Herbert Netzler, David Henderson and Attorney Mark Prenatt. MINUTES Minutes of April 12, 1994 were tabled. VISITORS None. REPORTS Superintendent - Dave reported that grading is being done, sink holes filled, road inspection this a.m., replaced pipes at Mohawk and New and at Eureka north of Old State. There is still one to do on Mohawk south of Francis. The Mack power steering is done but it needs seals on the rear axle which have been ordered. The tank needs some welding. Four Year Plan - nothing. Plow for Grader - Herb had information from Valk Mfg. for a new plow, Hovis has one, Canton, Ohio has a field full of them priced from $600-800. Herb suggested taking a trailer if someone goes to look at them. State surplus says if any are available they will be advertised in the PA Bulletin. First Responder Course/Hazmat - Joyce Berry will instruct, will schedule for rainy days in June. Buren Driveway/Clair Wright - letter signed. Letter to Pekelnicky - Ben moved to send a letter to Mr. Pekelnicky asking what he would charge if he would clean up his field that was damaged by the grader this winter. Dave seconded. Carried. Orders from the Board - Herb suggested that this be placed on the agenda as a reminder to the Board. Will hold up on any orders until after road inspection. Russell Standard Proposal - Proposal was on cost to fix Fry road. Dave said the road has three main bad spots that need to be dug up and the base replaced. He added that the right way to do the job is to cut out the bad area down to 18", put in B-19, seal the edges, put FB material back on and seal. The proposal is for FB but would recommend using cold patch and seal. We could do the patching and Russell Standard would seal it. Netzler - if you're undercutting, go down to the hard pan even if you have to go past 18". Henderson - I was just replacing the base with stone. Netzler - if you don't dig through the soft spots, you're wasting your time. Discussion on undercutting. I can agree with the plan but undercut to the hard pan, use crushed material from Zessinger pit for back fill and use our trucks. No decision at this time. Driveway Marking - Dave reported that several driveway pipes were damaged by the grader this winter when it was pushing snow back. These driveways were not near any homes or buildings and were not visible to the operator. Should we allow these drives or should we force the property owner to mark them. Sitek - you'd plow the marker down the first time you plowed. You should be more careful not to plow out so far. Netzler - the one on Carbury needs to be trimmed off. Henderson - we'll keep track of them on road inspection. We will have less trouble with them in the future with the wing on the grader. This season we had the front wheel by the ditch. Sitek - the wing is down on the ground and is throwing dirt 15 feet into yards. Discussion on plowing. Will ask property owners to mark drives. Weather Service - Dave reported that he had talked to Carl Ishman of PennDOT. Two important things to encourage them to do: they have weather forecasts prepared for specific areas one of which is Franklin Township, we would like to get that information; they have a computerized weather radar available, we need to tap into that information. Ishman didn't know any details. Dave proposed sending a letter to Ishman on how PennDOT can provide us with that information. Discussion on the weather service leaving Erie. Sitek moved to send a letter asking PennDOT to consider forwarding that above stated information to Franklin Township. Netzler seconded. Carried. JCB Pump - the factory warranted half the cost of the pump, $542.11. We will owe $1,197.86 on the bill. The machine is 4 years out of warranty. Netzler to Attorney Prenatt - I don't think there's a limit on material and workmanship no matter how long out of warranty. Research it and send them a letter. Henderson - we did ask them to pay and they allowed $542.11. They must think they were at fault. We signed the original warranty. The pump was 5 years old with 2400 work hours on it. Prenatt - protest before you pay the bill. I think you'd be bound by the one year warranty. The question is on the low work hours on it. Henderson - the low work hours may have affected JCB's decision. Anderson said the JCB rep. said they had no obligation to pay. The bill was for $1330.97 parts and shipping, $80.00 mileage, $329 labor. Att. Prenatt will research and report back for the next meeting. FINANCIAL AND TAXES Bills - Sitek moved to pay the bills as presented less Anderson Equipment (JCB) totaling $6516.12 general fund, $6656.88 state fund. Herb will also attend the ECLGSA meeting ($12.00). Netzler seconded. Carried. Payroll - Sitek moved to approve payroll #8-94, Netzler seconded. Carried. PLANNING, ZONING, HEALTH DEPARTMENT Industrial Park - nothing. Wolfe Variance - next meeting. Sewage/Washington Twp. - Dave said we need a combined sewer authority with Washington Twp. We would like to see them extend their sewer line down Crane to the west side of I-79 and 6N. Earl Koon is not happy with the idea as they are almost to their capacity. Sooner or later they will have to increase their capacity. Washington Twp. says it is not feasible to put lines under I-79. We wouldn't pay for their line, only for the line that comes into Franklin Twp. Sitek - I don't see the benefits to us. Netzler - we need to get our area farmers to file a class action suit and hang DER and get back the 10 acre law. Henderson - if they go under I-79, that's cheaper than going down Crane and around to 6-N on Silverthorn. You can eliminate the pumping station to pump our area to Washington Twp. We should make an official request to Washington Twp. Netzler moved to request Washington Twp. to consider our proposal for their future expansion plans. Henderson seconded. Carried. SOLICITOR Cable TV - Coaxial was the only response to our letter. Their attorney sent a proposal and agreement. They will only cable certain areas of the Township and suggested we review our ordinance. Henderson - they don't like our original ordinance because it requires them to reveal the Mead family finances and soon we won't need cable. You'll soon be able to go to Sears and buy a unit and have 150 channels. I recommend waiting for several months before we take any action. Henderson moved to table cable television. Sitek seconded. Carried. Eminent Domain - Prenatt reported that the county will take the property and hold it as trustee for the future buyer. When the township purchases the property, we are liable for clean up of any hazardous waste. The agreement indemnifies the county from the clean up. Henderson moved to sign the Release Indemnification Agreement. Netzler seconded. Carried. Agreement signed. IntraGlobal - Health Dept. is on strike. Man in Travel Trailer on Mohawk - Health Dept. is on strike. Airport Milled Material - will set up meeting for middle of May. Front Footage/Silverthorn - Mark said he is looking into the tax maps but can only estimate frontage using them. We can mark the assessment as estimated. I would suggest that when we need the exact frontage, the property owner pays to get theirs surveyed. Netzler - get the 51% first. If they want to challenge the estimate, they pay for surveying. Att. Prenatt will move ahead on the issue. Spec. for Garbage Contract - we need to advertise in July. Included will be curbside and bags with only one hauler. Henderson - our ordinance excludes curbside pickup. We need to amend the ordinance. The contract should exclude hazardous material and other things like refrigerators. I don't think leaves and grass clippings are acceptable at the land fill. Evacuation Plan - Mark called PEMA who said the only person to order an evacuation is the governor. His order leaves no choice on whether to leave. The Supervisors can advise or suggest that people leave but can not force them to go. The police chief and fire chief also have that power. Netzler - the law says the governing board. The fire chief is our employee. We need to move ahead on this and get it in black and white with McKean and Edinboro. Henderson - we already have it in black and white in our emergency plan that was passed by the Board. Netzler - we still need an agreement. Penn Lakes Girl Scouts - Herb said the rental houses in our township should be taxed. The camp is in Fairview Twp. and should be exempt. Henderson - the camp custodian lives in one of the rentals and they rent the other two. Attorney Prenatt was instructed to go for 100% taxable on the three rental houses. OLD BUSINESS Sesquicentennial - the book has hit a snag. Dave said he talked to Bob Berry who said he would get on it. Dave moved to send Bob a letter. Ben seconded. Carried. Safety Meetings - we will ask Dave Wagner of Wagner Insurance Associates to set up a meeting on a Thursday evening. Our employees will be paid to attend. Provider List - waiting for Erie Insurance provider list. Employee Rights - waiting for Erie Insurance provider list. NEW BUSINESS Crime Watch - Ben said he thinks it's a good idea to have a crime watch program in effect. Dave moved to have Ben contact Anne Firestone and have her attend one of our meetings. Ben seconded. Carried. CORRESPONDENCE Reviewed. Gledhill Plows - the factory reps. will come and look at them on May 11. BTN Article - Cheryl Cross asked if the Supervisors would be interested in running a column once a month or so on pertinent issues. Supervisors left for road inspection at 1100 hours.
