May 10, 1994 A hearing, held in the Township office, by the Supervisors of Franklin Township to hear the variance request of Larry Wolfe, 6159 Crane Road, Edinboro was called to order by Chairman Benjamin Sitek at 1945 hours with the Pledge of Allegiance. Present were Sitek, Herbert Netzler, David Henderson, William Smith, Mr. and Mrs. Wolfe, Joe Szymanowicz, Daniel E. Parker, and Pete Gregan. Mr. Wolfe is asking for relief from the side yard requirements for I-1 zoning of 50' to 15' and front set back requirements of 100' to 75' which are the setbacks for A-1 zoned property for the purpose of constructing a pole building. Bill Smith - presented a letter which opposes that area being zoned industrial. Larry Wolfe - stated he plans on running a business from the building. Netzler - there won't be toilet facilities in the building will there. Wolfe - no. Netzler - questioned why Mr. Smith is opposed. We have an inconsistency in our zoning ordinance. If it were consistent, Mr. Wolfe wouldn't need a variance. If he puts in a septic, that's the Health Dept.'s problem. It's just a pole building with no septic. I see no problem. Sitek to Smith - in your letter you question adequate soil, water, power and roads in that area. Smith - I question why it was ever zoned I-1. Netzler - a hearing was held before the ordinance was adopted. Smith to Wolfe - what kind of activity will go on in the pole building? Wolfe - I have a car lot on Rt. 99 but the lease will be up by July 1. I will move my license and business to my present location. I buy vehicles, repair them and sell them wholesale at an auto auction on a part-time basis only. The vehicles will be housed in the building, there will be very little painting, that's done elsewhere. I don't take vehicles in, only my own. Smith - I'm concerned with E.P.A. and D.E.R. rules and regulations on painting. Many of these restrictions are for our benefit. I would guess if you ran water samples in the area of his car lot you'd probably be in violation. We can't drink the water at my plant (Makco), we have to drink bottled water. The water that we do have is limited. I can't see how you could entice anyone in coming into that area for industrial purposes. Henderson - it's been zoned industrial for many years. Smith - this Township has a small tax base and no money. We need a better tax base with businesses and more homes. Do we need to scrutinize zoning a little better? Netzler - if zoning was treated equally, he wouldn't need a variance. I see no problem with it. Yatzor was given permission for those trailers because that property is I-1. Hearing adjourned at 2004 hours. The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Sitek at 2004 hours. Present - see above. MINUTES The minutes of 4/12/94 and 4/28/94 were approved as presented in a motion by Henderson and second by Netzler. Carried. VISITORS Joe Szymanowicz - what's happening with IntraGlobal. They're running a business. It's been 14 months since I sent a letter. The place is in A-1, is a mess, and he is running a business. Go after the property owner and tell him the business has to leave. I'm not sure the guy is living there now. Henderson - they're doing their best to stall us. Netzler - the name on the truck lists the Crane road address but his license plate is Ohio. That's a no-no. Henderson - we have to spend money on a hearing, ads, a D.J. We want the Health Dept. to throw them out. We're taking the cheap way out first. It will probably cost us $1,000 before it's settled. Netzler - the D.J. can throw it out and we're out the money. Henderson - we'd have to appeal to the County Court and there's more money. There is no teeth for the Township anymore, violators only have to come into compliance. Daniel E. Parker - what about sewage. Henderson - explained about possibly hooking into Washington Twp. sewage lines in the future. Discussion. REPORTS Superintendent - Dave reported that the Mack is running, work has been done on equipment, some painting done on winter equipment, Athey's main shaft is being welded and turned, and graveling sink holes is being done. The first grading is holding up well, some ditching done, some driveway pipes put in. We will straighten the corner of Rt. 98 and New and New and Mohawk. Any day the crushing will begin at Zessinger. We will spot gravel the rest of Silverthorn. Sitek - Ben Jr. is having his house washed and painted. Don't grade Silverthorn Road. Four Year Road Plan - nothing. Plow for Grader - nothing. Netzler - how far are you running the pipe on New and Mohawk. What's done now won't do anything. Henderson - we've already put in 50' of pipe. We're not done with it. Netzler - get rid of the ravine. Do it so you won't have to do it again. Henderson - if the radius of the corner is enlarged, I don't see a problem. Netzler - put 20 more feet on the north side. Henderson - the ditch on the south side is the same as on the north but they don't have a problem with the south. Will look into it tomorrow. Fry Road - Dave reported that Washington Twp. will use the tar buggy to seal the whole area after it's patched. I would recommend not seal coating it this season. If it holds up this winter then seal coat it. Netzler - if you undercut deep enough it will hold up. Henderson - we'll have Herb and Ben come up and figure out how deep to go. It will be a Board decision. Summer Youth Work Program - discussion on what the young people can and can not do. Decided what they can do is too restrictive and too regulated. Letter to Antolik/Road Material - Dave reported that it appears that Antolik is planning on using concrete chunks (uncrushed), steel and wood as base material. Ben moved to send Mr. Antolik a letter stating that he is not permitted to use the material stacked up as base material for his road expansion. Herb seconded. Carried. Dave will take a photo of the material in question. Stormwater - Herb attended a meeting on stormwater management and presented a flier concerning it. FINANCIAL AND TAXES Payroll #9-94 - Dave moved to approve payroll #9-94 as presented. Ben seconded. Carried. Bills - Dave reported that he couldn't reach the Attorney on the JCB bill but saw no reason not to pay it. Discussion on various bills. Dave moved to pay the bills as presented, $499.58 general fund; $289.96 building fund, $3,396.28 state fund. Ben seconded. Carried. Herb said he would vote for all but the Professional Communications bill for the same reason stated last month (he paid for his own beeper when he was road superintendent). Herb moved to pay the EIT quarterly claim for Northwestern S.D. totaling $1,358.00. Dave seconded. Carried. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Park - nothing. Wolfe Variance - Netzler moved to approve the variance request of Larry Wolfe. Henderson seconded. Carried. Szymanowicz Mylar - Netzler moved to accept the Szymanowicz Mylar as presented. Sitek seconded. Carried. Mylar was signed. Sewage/Washington Township - Dave will attend their water and sewer authority meeting. Letter from McDonald Law Group - Herb moved to send Attorney Prenatt a copy of the letter and ask for his comments on it for the May 26 meeting. Ben seconded. Carried. Letter to Bogacki - Herb moved to send Mr. Bogacki a letter thanking him for cleaning up the old town hall building and ask that he clean up the burn piles left from the clean up. Dave seconded. Carried. Letter to Whiskey River - Herb moved to send a letter to Tom Carr/Tommy's Whiskey River and ask him to tone down the band. Ben seconded. Carried. Neighbors have been complaining. SOLICITOR All items on hold. OLD BUSINESS Sesquicentennial - Ben moved to hold the party/picnic in September. Dave seconded. Carried. Grounds Beautification - Ben asked how much of a clean up should be done. He added that the Township needs to buy their own weedeater. He suggested putting flowers in the planter, between the shrubs and three red maple or pin oak trees planted on the north side of the property. Discussion. Dave moved to authorize spending up to $300 for beautification. Ben seconded. Carried. Safety Meetings - planning meeting with Dave Wagner of Wagner Insurance Associates, fire chief Terry Gebhardt and Dave Henderson will be held on May 19. Health Care Provider List - waiting. Employees Rights - waiting. Neighborhood Crime Watch - Ben reported that he made arrangements for Anne Firestone to attend the May 26 meeting at 9 a.m. She suggested starting small. Ben wants to start the program on Silverthorn Road. Needed is a coordinator. On June 25 an instructional meeting will be held. We will ask the newspaper to publicize a start up meeting. Ben reported that there were 24 reported crimes of different types in Franklin Township in 1993. NEW BUSINESS Municipal Financing for Fire Truck - Dave reported that the fire dept. is going to purchase a new fire truck which will cost $132,000 with $32,000 down and $66,000 eligible for 2% money. They need financing for $34,000. They can go with dealer financing, a bank loan or a municipal loan through the Township. They can save 2 or 3 % interest if we co-sign the loan. They would guarantee us to pay the loan and we would guarantee the bank to pay the loan. The bank is working up a proposal. The state would get the truck if the loan isn't paid. Sitek moved to authorize Dave Henderson to prepare the paperwork and have the solicitor sign the necessary letter. Henderson seconded. Carried. Badges/Fire Police - Ben moved to purchase 8 fire police badges with the Township responsible for distributing them and recovering them. Two cloth badges are kept on uniforms that stay in the squad for emergency use. Dave seconded. Carried. Position on Bills - Netzler moved to send letters to the appropriate legislators on the following: oppose senate bill #877 on tax exempt charities; oppose senate bill #182 as currently written concerning tax collection and distribution; support house bill #2202 version of tax collection and distribution; support house bill #1760 to eliminate entire property posting on zoning changes; support removal of gravel bars. Sitek seconded. Carried. CORRESPONDENCE Upcoming training sessions reviewed. Discussion on the article on cable television in the Independent. Discussion on the request for a donation from the Campaign for Independence (Barber Center). No action.
