July 12, 1994 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek at 2000 hours with the Pledge of Allegiance. Present were Sitek, Herbert Netzler, David Henderson, Christine Ellis, Ben Sitek, Jr. and Clarence Mischler. MINUTES The minutes of June 30, 1994 were approved as presented in a motion by Netzler and second by Henderson. Carried. VISITORS Clarence Mischler - what about the garbage contract, will there be just one pick up? Sitek - yes, just one hauler and the bag sales and drop off. We have three haulers in the Township now and in the spring it makes the roads much worse. REPORTS Superintendent - Dave reported that ditching is being done. Netzler - on Eureka the ditch is lower than the pipes. There's no place for the water to go. Cut out the pipes before we have a downpour. I don't see why you're in the ditch with the grader. Stay on the road and cut the ditch. The ditches are deeper than they need to be. Henderson - the pipes are open and all need to be cleaned on both sides with the backhoe. I hate to stop to clean pipes and let good weather go and miss the opportunity to do more ditching. Rain fills the ditches with 4 or 5 inches of silt right away. Sitek - the backhoe is free but what will you do with the dirt with no truck available. If it rains send the backhoe down to open up the pipes. Netzler - Mark Mills mows right to the gravel. We need a decent ditch through there because of ice problems in the winter with the water coming down those drives. When it gets to Munches driveway it has no place to go and freezes. Sitek - I had to rework mine so the water wouldn't go into the road. Henderson - it you don't want to mow, before the grass comes up use a weed killer so you end up with bare ditch dirt. Sitek - each property owner can take care of their own ditch. Hugh Crandall arrived at 2015 hours. Four Year Road Plan - nothing. Plows for Grader - nothing. Safety Stripes - nothing. Majba Guide Rails - Ben reported that Mr. Majba has 21 good guide rails, some posts. Discussion. Herb moved to purchase the ribbons for $3.00 each and the long posts for $2.00 each and not to purchase any short posts. Dave seconded. Carried. Orders from the Board - Herb said the STOP sign at Pekelnickys on West Stancliff and Silverthorn is faded and needs to be replaced. FINANCIAL AND TAXES Payroll - none. Copier - nothing. Bills - Dave moved to pay the bills as listed totaling $7,340.48 general fund and $9,517.41 state fund excluding Anderson for the shifter. Ben seconded. Carried. PLANNING, ZONING AND HEALTH DEPARTMENT Christine Ellis - showed plans for putting a trailer in by the woods line on her parents property at 10908 Eureka Road. Her sister already has a trailer on the site. There is an existing second septic and well on the property. The Health Dept. is due out to check the second septic. She reported that the site was her parents summer home but they moved off 10-12 years ago. Sitek - this is the same deal as Barlotti's, no subdivision. Henderson - the question is a well and septic system in the front and another in the back. The snake raises its head sooner or later and says let's put another trailer in here. Sitek - once this happens, this Township will be a mess. When the Barlotti trailer goes that should be it. Two homes on one property isn't allowed. Somewhere along the line the system changed and we should change too. Why do we even have zoning. Let the people do whatever they want. It would be easier to have it subdivided. Ellis - I'm trying to save the surveying fee. Sitek - if the Health Dept. says the septic is all right you should survey and subdivide. No problem then, there's nothing we can do about it. Netzler - you could make a land contract between you and your sister. No surveyor is needed, just write it up from stake to stake. Sitek - I want a meeting set up with the Health Dept. We get no reports from them. Hugh Crandall - we need a representative present each time Pete does a percolation test. Henderson - we have no control. DER guidelines have been given to the S.E.O.'s. Even if you don't like it there's nothing we can do. Netzler - if the Health Dept. and the Planning Commission okay it, I have no problem with it. There's no law that says when you move out that you can't sell it. Along comes a granddaughter on Eureka that moves in and the Health Dept. approved it but they made Farmer's son move out. Henderson - we asked the Attorney to research this problem, he'll get back to us. Pete can set here and tell you one thing but if it's not backed up by law it's not worth anything. Chris Ellis left the meeting at 2035 hours. Industrial Park Grant - Herb met with the Realtor. Property at West Stancliff and Eureka/Eminent Domain - Herb told Crandall that the Township paid $300 for the parcel. If he reimburses the $300 and cleans it up it's his. The taxes are clear and there are no liens. Crandall - how do I get rid of the eight drums of concrete. Netzler - if we get rid of the drums will you buy it? Henderson - pay the $300, clean it up and pay the $3 transfer fee. Crandall - when are you going to remove the dirt from my field put there when you did emergency ditching. Sitek - it's on our right-of-way. Henderson - obviously if it was a field in cultivation, we wouldn't do it. Netzler - if it's done, write a letter within 6 months and we'd have to clean it up. Pull it out with the grader, take the loader through and zip zip you're done. Sitek - zip zip hell, it takes longer than zip zip. Netzler moved to sell the property to Hugh Crandall for $300, the Township removes the cement drums, Hugh cleans up the rest of the site and pays the realty transfer fee. Sitek seconded. Carried. Sewage/Washington Twp. - nothing. Variance Request/Bernhardt - Herb moved to advertise for a variance hearing on August 9, 1994 at 7:50 p.m. Ben seconded. Carried. SOLICITOR Front Foot Assessment/Silverthorn - Dave said he revamped the letter which explains the assessment. Sitek - I think we should try Silverthorn north of Old State first then the other sections. Take a small bite and chew it. Once you start and others see how good it is it will convince them to go along. Henderson - it's 4 1/2 miles for the whole road excluding the south section. Some between Old State and Crane are interested but I don't think it will fly because of the farmers with lots of frontage. Give me some guidance here. Netzler - you can only go section by section. Do the whole road boundary to boundary. All agreed. All other Solicitor items on hold. OLD BUSINESS Sesquicentennial - Dave reported that it's coming along. Bob Berry and Bob Herman will sit down and come up with an updated history of the fire department. Netzler - I want to read that before it's printed. Safety Meetings - nothing. Health Care Provider List - nothing. Employee Rights - nothing. Crime Watch - Ben will set up a meeting. NEW BUSINESS Nothing. CORRESPONDENCE Dave will attend the Legislators Dinner.
