August 9, 1994 HEARING/BERNHARDT VARIANCE REQUEST 1950 HOURS Present were Benjamin Sitek, Herbert Netzler, David Henderson, Attorney Mark Prenatt, and several visitors. Sitek asked those present if there were any comments. No comments. Hearing adjourned at 1951 hours. HEARING/FTVFD TRUCK LOAN 2000 HOURS Attorney Prenatt stated that the fire department is securing a bridge loan of $100,000 from PNC Bank until they receive a PEMA loan. Sitek read the introductory statement required by Public Approval Requirements of Sec. 147 of the Internal Revenue Code of 1986. Bob Herman - stated that this is the first new truck purchased by the fire department and that they have a five year plan for improved effectiveness. The truck is an attack/tanker which carries 2,000 gal. of water and necessary attack equipment. It will be used primarily for daytime attack. The department saved $10,000 by purchasing a demonstrator. Purchase price was $135,000. They put $35,000 down and have made application for a municipal loan with low interest and a PEMA loan at 2% interest. There is no tax money going toward the purchase, all funds have been raised by donations and numerous fund raisers such as bingo and the Albion Fair. Most present went outdoors to look at the new attack tanker. Chairman Sitek signed the necessary documents for the loan. Hearing adjourned at 2010 hours. Representatives from the fire dept. and Attorney Prenatt left the meeting. The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek with the Pledge of Allegiance at 2010 hours. Present were Sitek, Herbert Netzler, David Henderson, representatives from V.F.W. Post 740 and various other residents. MINUTES Henderson moved to accept the minutes of 7/12/94 as presented. Sitek seconded. Carried. Henderson moved to accept the minutes of 7/28/94 as presented. Netzler seconded. Carried. VISITORS Bob Houghton/VFW - said that Edinboro/McKean Post 740 is purchasing 48 acres from Ellie Cilladi on Route 98. The post consists of 110 members and is a nonprofit community service organization. They plan on constructing ball fields first and a structure later when funds can be raised. He also stated that running a tavern is not their objective and that the I.R.S. is investigating posts that are run as a "home association." Henderson moved to hold a conditional use hearing on the request of the V.F.W. on August 25, 1994 at 8:45 a.m. Sitek seconded. Carried. Cable TV/Attorney Gary Eiben and Dave Westcott - Eiben stated that Coaxial Cable would like to recommence negotiations for the awarding of a cable franchise in Franklin Township. He added that they wouldn't wire all of the township but would wire 90% of the portion south of Old State. They are willing to wire at a rate of 10 houses per mile for this township instead of the 10 houses per quarter mile normally done. He will draft an agreement between Coaxial and Franklin Township and let the Supervisors and our Attorney review it. Sitek - why south and not north. Eiben - because of the density and where the wires are presently. The time frame for south of Old State would be wired by next summer season weather permitting. Netzler - I have no argument on drawing up an agreement. Sitek - no obligation to connect? Eiben - no, you can have a satellite, cable or any other system. Fiber optics will open up the information highway in Franklin Township. Ben Sitek, Jr. - said he wants to change his vote on front foot assessment on Silverthorn. He knows the township is short on money but so are the residents. He asked if the Supervisors could come up with alternative methods of payment. A committee will be formed to review and come up with ideas. He wants the deadline put off to let the committee come up with alternatives and to give people more time to get the cards back in after the meeting on the 30th. He feels things are moving too fast. Henderson - we can put it off several weeks. Netzler - we been kicking this around for 3 or 4 years. I don't think the cards are a legal way of doing it anyway. I think a petition needs to be taken around. Henderson - if you don't want the project, vote no. It's not up to us. Sitek, Jr. - we're not against the project but want to have other alternatives and fund raisers. Henderson - you can do that but be aware that 5 or 6 years from now the price will be even higher. Denver Ireland - which Supervisor initiated this plan. Sitek - there was interest shown by the residents. No one Supervisor initiated it. Henderson - we are all in favor of the methodology, we all signed the letter. The methods are prescribed by law. John Pekelnicky - change the law. Didn't you set a precedence on Fry Road. Netzler - it's next to impossible to change the Second Class Twp. Code. Sitek - we'll address all your questions at the meeting on the 30th. We can give residents more time after the meeting to return their cards and you can change your vote. Netzler - send us a letter asking to change your vote. Pekelnicky - we're still up for a nuclear waste site, will we be reimbursed for the assessed value after the property is condemned for the dump site. Netzler - I'll go on record that Franklin Township will be disqualified for a waste site. Discussion. Sitek, Jr. - tiles are plugged from the ditching. Henderson - we can take a quick round around and open the ends of the pipes so the road won't wash away. It's not meant to open tail ditches. If the pipe is plugged, the property owner is responsible and can be forced to open it. It would take 6 weeks to take care of all the drainage problems in that area. We've ditched a lot this year. Sitek - we need to drain off driveway pipes first. If you don't water run off from drives will have no place to go. We need to preserve what we've done and clean up after ourselves. Netzler - I won't be able to do tail ditches for 2 weeks. Sitek - get John Sachar to help us and put Rick on clean up. REPORTS Superintendent - Dave reported that the crew has been ditching. Plow for Grader - Herb will bring the plow here for inspection. Four Year Road Plan - Ireland - is the original road plan in effect. Dave answered that he has one but it's not approved. Sitek - I've questioned it but you tabled it. Sitek, Jr. - what are we getting on Silverthorn. Sitek - 4" of crushed gravel in 1995. Henderson - if the proposal is approved, we'll rebuild Silverthorn next year. Pekelnicky - Silverthorn gets slimy when it rains. Netzler - pulling ditches puts silt on the road. Henderson - a good portion of that end was Girard gravel. Reflective Stripes on Uniforms - Dave said that the employees would pay for them and that U-1st is cheaper than the present company. Herb thinks we should buy hard hats and vests and make workers wear them. Dave said the intent was to make the employees as visible as possible to provide additional safety, the workers don't like to mess with vests. Henderson moved to provide safety stripes on the uniforms for employees who want them. Motion died for lack of a second. Orders from the Board - Herb said to clean out pipes and correct what has already been done. Ben said to get another guy to work with the crew. Waterways Improvements - nothing. FTFVD Loan - Netzler moved to authorize the Chairman to sign all the necessary documents for the loan. Henderson seconded. Carried. State Snow Contract - Henderson moved to sign the snow removal contract. Netzler seconded. Carried. It was questioned what to do if PennDOT doesn't keep their word on the water problem on Old State. Netzler announced that an executive session was held on August 8, 1994 with PennDOT concerning the snow removal contract. FINANCIAL AND TAXES Bills - Dave moved to pay the bills as listed less the Anderson Equipment bill for the shifter totaling $1,661.01 general fund. Ben seconded. Carried. Payroll - none. Copier - nothing. PLANNING, ZONING AND HEALTH DEPARTMENT Industrial Grants - Herb reported that PennVest will give a 1% loan for septic system repairs to homeowners minimum of $1,500 maximum of $15,000 with 15 years to pay it back. The homeowner can't make over 150% of the state average income. Sewage/Washington Twp. - nothing. Bernhardt Variance - Sitek moved to grant the frontage variance. Henderson seconded. Carried. Dean Gebhardt Subdivision - Dave moved to approve the sketch plan. Herb seconded. Carried. V.F.W. - see visitor section. Replacement for Greg Soltys on P.C. - will ask Pat Platz if he is interested in coming back on the Board. SOLICITOR Cable TV addressed. All other items on hold. Ordinance/Naked Dancing - Ben feels the township needs an ordinance to prohibit naked dancing before the problem arises. Ben moved to have the Solicitor research an ordinance to prohibit naked dancing in business establishments within the Township. Herb seconded. Carried. OLD BUSINESS Sesquicentennial - Bob Berry is working on the book. We will check with him in several weeks to see if he needs help. Safety Meetings - information received. Health Care Provider List - nothing. Employee Rights - nothing. Crime Watch - Ben will get a committee started. Dave commented that the MEN WORKING signs were stolen when the crew was working on Silverthorn. The STOP sign on Silverthorn and West Stancliff will be replaced.
