August 25, 1994 HEARING/VFW The hearing on the conditional use request of VFW Post 740, held in the Township office, was called to order by Chairman Benjamin Sitek at 0847 hours. Present were Sitek, David Henderson and several neighbors of the Post site. Sitek - asked those present if they had any comments. Angela Horvath - said she was familiar with the VFW Post in Albion and was not happy with the way it is run. She said it attracts derelicts, the music is loud and they allow gambling. She was a social member of that post until she withdrew her membership. Herbert Netzler arrived at 0849 hours. Sitek - the post plans on constructing ball fields first then a building. He added that he has never been in a rowdy VFW. Bob Houghton - Albion post is run as a drinking place. Poker machines are illegal and you can't get a home association license any more. Some posts are open only 3 days a week. Albion post does nothing for the community. Currently we are not allowed to have social members. Our post has 110 regular members. Our intent is not to run a saloon. We will need some kind of income, perhaps by renting picnic shelters, banquet rooms, raffles, turkey shoots, etc. McKean is losing their ball fields and we would like to start them up again on this property. We want to put back into the community and we don't look for the post to be open 7 days a week. Mary Tipton - would you be able to get a liquor license. Houghton - if you have over 100 members you can get a license for members only. Tipton - I see nothing wrong with it, I think it's a good thing. Houghton - we are looking into getting a construction trailer so we can hold meetings in it and be able to expand from it. We will eventually get a liquor license for members. Presently we are not allowed to have social members. Sitek - I'm sure if it's run by members the neighbors will have no problems like they have with Albion. Hearing adjourned at 0902 hours. The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek with the Pledge of Allegiance at 0902 hours. Present were Sitek, Herbert Netzler and David Henderson. Attorney Prenatt will be late due to filing a motion in court. MINUTES Herb moved to approve the minutes of 8/09/94 as corrected (change driveway pipes to waterways). Dave seconded. Carried. VISITORS Nothing. REPORTS Superintendent - Dave reported that ditching and some minor equipment repair has been done. Four Year Road Plan - nothing. Plows for Grader - Herb will bring to Twp. building for inspection. Orders from the Board - Herb said he thinks the tail ditches and sluice pipes need to be cleaned so the water can get to the waterways. Sitek - feels the waterways need to be done first, ditches are filling in already. It's time to stop ditching and clean up what we've done. Henderson - Mohawk and Francis waterways are done already. We're on Eureka south of New. I want to do that end of Eureka and then stop. We will have done 15 miles of ditch by 9/1/94, nearly 1/2 of our roads. Some of the ditches on the other sections of road are all right. When I'm done ditching then we'll do waterways and driveway pipes. Sitek - clean the waterways back far enough so the water can move then clean the pipes. Netzler - do all of one section then move on. Sitek -no, waterways first then come back for driveway pipes. Tiger Mower/Tractor - Dave presented the proposal from Walsh Equipment for the purchase of a Tiger mower and ditcher. He said that it costs the Twp. $8,000 annually to mow ($6,500 fall mowing, $1,000-1,500 summer mowing). We don't get to use the machine when we want and can't make as good use of it as we could if we had our own. It would pay us to purchase our own mower. Netzler - I don't think we can afford it. We still have 6 years on the truck/grader loan. The cost is $40,000 plus interest, fuel, repairs, workers comp. etc. Put a freeze on purchasing and put that money into blacktopping and road improvements. Henderson - the payment schedule shown is based on 7 years, it will probably go lower than those figures shown. Most likely it would be a ten year loan. Sitek - if you can save $8,000 and not pay it out, I can see the logic. You still have to pay it out though for mowing. Henderson - it has other potential uses. With a cab we can tow the York rake and use it for ditching which would more than pay for itself. We can save a lot of time. What he did in two hours during the demonstration, we would take two days to do and use 3 guys to do it. Netzler - you still have to clean up after it. Henderson - once the ditch is in place, we can maintain it with the machine. The time savings is 2-3 fold. The only thing I would change is the time of delivery. We need it by the middle of Sept. to save the mowing that Elk Creek does. Sitek - there's another mowing attachment. Henderson - the 50" attachment is for brush, the 60" attachment is for grass only. Sitek - when we get new equipment it's not taken care of by the guys. Some people won't want the ditch material thrown up on their property. You can use it by fields but not lawns. I'd like more time to think about it. Henderson - I'm urging a decision today or we will need to shell out the money to Elk Creek. Sitek - I don't see a lot of other Twps. mowing in the fall. I don't care if Elk Creek mows this fall. On hold until the Sept. 13th meeting. Salt Bid/Millcreek Twp. - last years bid was $34.15 delivered/$35.00 picked up. Will wait for Morton's quote. Driveway Pipes/Trimble - Both the driveway pipes on the Trimble property on Silverthorn need to be replaced. The south pipe won't take water and the north pipe is buried. Netzler moved to send the Trimbles a letter telling them they need two new pipes. Sitek seconded. Carried. Hough Repairs - Herb will do. FINANCIAL AND TAXES Bills - Ben moved to pay the bills as listed excluding Anderson Equipment (shifter) and including the EIT claims totaling $9,830.69 general fund and $5,991.25 EIT fund. Herb seconded. Carried. Payroll - Dave moved to approve payroll #16-94, #17-94. Ben seconded. Carried. Copier - nothing. PLANNING, ZONING, HEALTH DEPARTMENT Industrial Grants - Herb reported on a training session he attended on capital improvements and grant money. Netzler moved to authorize himself to apply for any grant money available for playgrounds for the V.F.W. property. Sitek seconded. Carried. Sewage/Washington Twp. - Herb said that Earl Koon told him that Washington Twp. would no way consider Franklin Twp. hooking into their lines. Dave said that that was not what their Authority told him. Discussion. Herb feels that Washington Twp. seems to want to cut down on building in the lake side area. Dave added that their Sewer and Water Authority will reach 80% capacity soon and the law says they must have an expansion plan in place for future needs. Herb said that D.E.R. and PennVest has the last word. V.F.W. Conditional Use - Sitek moved to grant the conditional use request of the Veterans of Foreign Wars Post 740. Henderson seconded. Carried. Replacement for Soltys - nothing yet. Travel Trailer/Keener - Herb said he was told someone moved a travel trailer onto the Keener property on Eureka and is living there permanently. There is only one septic system. Dave moved to send the Keeners a letter asking what's going on. Ben seconded. Carried. Junk Cars/Pekelnicky on Old State - neighbors are complaining about the number of unlicensed, uninsured vehicles on the property. Supervisors will check into it. OLD BUSINESS Sesquicentennial - will call Bob Berry to check on the book. Safety Meetings - nothing. Provider List - nothing. Employee Rights - nothing. Neighborhood Crime Watch - nothing. NEW BUSINESS Nothing. CORRESPONDENCE Secretaries Dinner Meeting - Dave authorized the secretary and any Supervisor to attend. Ben seconded. Carried. Upcoming training sessions were reviewed. Antolik/Western Trails Subdivision - Mr. Antolik asked for a one year extension on paving Western Trail. He would like to pave in the fall of 1995 after he puts another layer of gravel on the road. Henderson - how do the residents on that road feel about it? Antolik - they don't care, one is selling his property. Netzler - get a letter from the residents on how they feel. I'll go along with it if the residents don't care. Solicitor arrived at 1004 hours. SOLICITOR Cable TV - nothing. IntraGlobal - having trouble getting in touch with the Health Dept. Airport Milled Material - will reschedule a meeting. Front Foot Assessment/Silverthorn - Sitek said that any changes made in the price should be told to the people up front before the meeting gets underway. Henderson - the $7 includes the base, crushed, pipes, ditching, brush removal, berms, driveways and paving. At $5/ft. it would mean two years of Permanent Improvement and fund raisers. Netzler - have the Solicitor check the law and see if we can put any general fund money in a paving project based on front foot assessment. The way I interpret the law, they get up a petition, we tell them how much and they pay. I don't think the Township can put into it. Prenatt - I can research it but I don't see anything wrong with it. The petition is to tell us who wants it done. It's a major decision and whatever the cost comes out to, they pay that amount. Sitek - if there is a price change tell them, if not tell them. We should pay for the base, we would do the base anyway. My way of looking at it is we pay for 12" of Zessinger base and the trucking and they pay for the blacktop. I'll not vote for anything that will stick them for the base, the Township should do the base. Henderson - you're saying the assessment is for the blacktop only. That's not the only costs involved. If you're saying the Township pays for all but the blacktop, I'll run those figures for the meeting on the 30th. Alan from Hoover Sand and Gravel arrived at 1016 hours. Netzler - I'm afraid of those cards. Prenatt - the purpose of the cards is to see if there's an interest in circulating a petition. You'll have to start all over again if there is a price change. The residents must get up a petition and take it around. Sitek - no petition at the meeting, they need time to think it over. Man in Travel Trailer/Mohawk - the Health Dept. needs to get out there and check it out. Nudity Ordinance - Supervisors will review the draft for the next meeting. Netzler - I gave a copy to the Methodist Church and would like to hear from them stating their opinion. The church is less than 300 feet from a tavern. The tavern got away with that years ago by moving their front entrance to the side of the building. Sitek - it's up to us to look out for them and all our residents and we will with an ordinance. Girl Scout Tax Exempt Appeal - Prenatt said the Board of Assessment has denied tax exemption on all their parcels. The hearing is to give their attorney a chance to talk. Netzler moved to authorize Attorney Prenatt to attend the hearing. Henderson seconded. Carried. Lost Crushed Gravel/5,000 Yards - Alan from Hoover Sand and Gravel presented a copy of Hoover's daily log of gravel crushed and a photo taken of the 5,000 yard pile. They ran 21,000 yards and billed us for 20,000 yards. Discussion. Alan added that they crushed bank yards not compacted yards. Henderson - we hauled bank yards. Discussion on the amount of gravel put on New Road by the Township. Sitek - each truck would have had to haul double. Netzler - I estimate 5,907 compacted yards on New Road. Antolik - most gravel compacts 20%, 12" equals 8" compacted. Netzler - no one else has hauled out of there since Alan's picture was taken of the remaining pile. That gravel is on a road somewhere. Sitek - where are the truck slips? How can you accuse two townships of taking that much gravel. Netzler - we're in hock for about $12,500 to make up for ESTA. Henderson - Alan's picture shows the remaining gravel, that is what's missing. The Supervisors, Attorney Prenatt and Alan from Hoover Sand and Gravel left at 1045 hours to check New Road and the portion of Eureka that Washington Twp. and Elk Creek Twp. graveled this summer. Supervisors, Attorney and Alan returned at 1120 hours. Netzler moved to authorize Hoover Sand and Gravel to crush 6,000 yards of gravel at the Zessinger Pit (whatever is needed to supply ESTA for the amount already agreed upon.) Henderson seconded. Carried. Sitek - did anyone take gravel somewhere else from the pit? Henderson - Elk Creek was in the pit for 1/2 day and took some from our pile for pipes. Netzler - they should never be in that pit. Henderson - have Ben take the lead in the investigation because he is a doubting Thomas. Ben refused saying Dave was the one dealing with them. Netzler - have Dave get the facts together then we'll have an executive session to decide what to do. Sitek - I think you'll find it in different places. First thing, find out how that road (Eureka south of Crane) got twice as much gravel as they contracted for. Netzler - that road has at least eight inches of crushed on it with a sixteen inch crown and they contracted for four inches. ADJOURN Sitek called the meeting adjourned at 1131 hours. Bonnie J.
