September 29, 1994 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek at 0900 hours with the Pledge of Allegiance. Present were Sitek, Herbert Netzler, David Henderson, Attorney Mark Prenatt, Ken Cowher from Walsh Equipment, Ken Seigworth from Seigworth Road Supply, Harry Welka/Welka Disposal, Mr. Locke/Waste Management, Jim Barrett, Sr., Denver Ireland and Tim Kuntz. BID OPENING - BOOM MOWER, 9:00 A.M. Two bids were received. Seigworth Road Supply - $47,444.74 for an Alamo mower/ditcher with Ford tractor. Walsh Equipment - $47,881.50 for a Tiger mower/ditcher with Massey Ferguson tractor. Netzler moved to table bid acceptance. Sitek seconded. Carried. MINUTES Netzler moved to accept the minutes of 9/13/94 as presented. Henderson seconded. Carried. Don Baumann/Baumann Disposal arrived at 0912 hours. VISITORS Jim Barrett, Sr. - my driveway was torn up by the plow last winter. When it was repaired they cut off a piece and didn't put in a replacement piece. I want it replaced and put back to it's original state so I can get my R.V. in and out that drive. An extension of several feet would be acceptable to me. Henderson - we cut off 12 inches. Sitek moved to put an extension of 2 or 3 feet on the Barrett pipe. Netzler seconded. Carried. Barrett left the meeting. BID OPENING - GARBAGE CONTRACT, 9:15 A.M. Four bids were received. No bid No bid No bid Welka Disposal 32.75 1.65 1.50 Henderson asked Welka if he had any problem with getting started. He said no. Mr. Locke and Mr. Baumann said they would cease pick up as of today, 9/29/94. Discussion on bags on hand and in the residents hands. Welka - set a deadline and I will honor the bags in that time frame. The other two bidders said they honored bags for a month. Netzler - I'm not in favor of curbside bags and won't accept any bid with curbside in it. Henderson - whether they have bags at curbside, they must be in a container. Residents need to know that. Sitek - I don't think we should have bags at curbside. It's just a mess. Netzler moved to accept the three year bid of Welka Disposal and to scrub curbside bag pickup. Sitek seconded. Carried. Welka - bin and curbside pickup will be on Fridays. We have a satellite truck to pick up during frost time. We will honor the yellow bags until October 24, 1994. We will use the tag system until the bags come in. Netzler - the quarterly fee is between the contractor and the homeowner. It does not involve the Township. VISITORS cont. Henderson told Denver Ireland that he should use a plastic pipe for a replacement in his driveway. If the Twp. is lowering the pipe and it is still usable there is no installation fee. If it's no good, the fee is charged. Tim Kuntz - will there be anything in the books that all roads will be paved by front foot assessment, same as Silverthorn. Netzler said the Board voted to pave the north end of Fry. Henderson disagreed saying the Board voted to gravel it, not pave it. Sitek added that he understood the Twp. would do the prep work in case it was paved. Henderson - all three Supervisors on the Board now are in favor of paving by front foot assessment. A new Board can change the rules. Netzler - the Second Class Twp. Code says one Board can not bind another. Sitek - I see nothing in the future where we'd ever be able to pave. Kuntz - said a C.P.A. told him a private individual can not use an assessment such as this as a tax write off. Netzler - when you buy bonds they're tax deductible. Use it as a municipal bond which is deductible. I would think you could call this a donation just like to the fire department. You had the choice to vote yes or no. Prenatt - I can check into that. Sitek - no one should be told to sell their land and move out or to get a second job to pay for this. We have a combination of old timers and city people on that road. I've lived there forever and I'm sick and tired of the dust. The city people haven't gotten sick enough yet. Ireland - what about speed signs. There are over 30 kids on the road. Henderson - we need a traffic study done and PSP determines the correct speed for an area. Sitek - even if PSP enforced 55 mph, it would be an improvement. Some are going 65 mph at least. Find out the qualifications. Netzler - enforcement is a problem. You might as well talk to the wall. The code book says the constable enforces parking. PSP told us they can't arrest unless they see them parking illegally. They suggest we get the constable to enforce our ordinance that says so many parking spaces per customer. Can a constable enforce speeding violations. Prenatt - probably not, that's PSP's job. REPORTS Superintendent - Dave reported that ditching and pipe replacement has been done. Four Year Road Plan - nothing. Plows for Grader - the plow on the lot is offered at $1,000 and is for the front of the grader. Dave questioned whether it is strong enough for pushing back snow. Herb said it is the same as the one on the Oshkosh and that if you use the blade on the grader then have a single axle come by, it works great. Discussion on putting a ram on it. Henderson - I'm concerned about the strength of the plow. The plowing frame can't handle the stress. Frosty's plow needs the moldboard repaired and returned to him. We need one made for a grader with strength of frame. For straight plowing that plow is all right but for pushing back we'd turn that plow frame into a pretzel. Orders from the Board - Herb asked what we've heard on the Gledhill plows. Ken Cowher - we've spoken to the manufacturer and should have them in 2-3 weeks. They will abide by the spoken deal. The plows were promised for the middle of October. Henderson - we're doing clean up ditching. One truck will be ready the first of November. Everything will be ready by Thanksgiving. Waterways - Dave reported that he has talked to Dick Crandall about applying to Soil Conservation for a waterway improvement grant for his property on West Stancliff. If a field is farmed they will pay for bulldozing etc. They do all except seeding. Plugged Driveway Pipes - Dave checked with the company that blows them out. The price of $80 each is prohibitive. The fire department is interested. The homeowner would pay the fire dept. to do the job. Ben said to tell the homeowners first that they must unplug their pipes. If they are unable to do so, the fire dept. will do it for them for a fee. Henderson - we can send a letter to everyone or do an individual survey. Then tell them they must clear it. We will do the paperwork for the fire dept. and collect the charge of $30 each for them. New Road Paving - the work will be done next week. Dave moved to allow Russell Standard to take our pile of millings and replace it with brand new material which will be used on New Road. Herb seconded. Carried. FINANCIAL AND TAXES Netzler - on October 10 the county human relations committee for sexual harassment will be in effect. Do I get paid mileage for all the meetings I will be attending. The committee goes wherever the charges are. Sitek - I'd hate to see us paying $500-600 a month in mileage. Netzler - by the county having a committee, it saves each municipality from having one. Bills - Sitek moved to pay the bills as listed excluding Anderson Equipment for the shifter and mileage/labor totaling $3,063.51 general fund and $2,563.88 equipment fund. Henderson seconded. Carried. Payroll - Sitek moved to approve payroll #19-94 as presented. Henderson seconded. Carried. Foreign Fire Check - Herb moved to authorize signing a check for $5,462.73 to FTVFD for foreign fire reimbursement. Dave seconded. Carried. Copier - nothing. PLANNING, ZONING, HEALTH DEPARTMENT Industrial Grants - Herb said he is applying for one before November. Sewer/Washington Twp. - nothing. Soltys Replacement - nothing. Pekelnicky/Old State - no word from residents. Drop from agenda. Print Zoning Ordinances - Herb said the price is $2.50/100. Herb moved to print 100 copies. Ben seconded. Carried. Parking at Businesses - Herb said PSP says their hands are tied. Our zoning ordinance says so many parking spaces per patrons. Henderson - is it based on patrons or square feet. Sitek - we've notified PSP, it's off our hands. Prenatt - if they're parking on state roads and they put up "no parking" signs, it's off your hands. It's the responsibility of the state if their parking on state roads. Henderson - our ordinance applies to off street parking only. Netzler - if Bogacki rents the old Town Hall, this Board must make sure he has adequate parking to keep them off the street. Discussion. Prenatt - I will give PSP a call on the problem. Patton Porch/No Permit - Dave moved to send the owner a letter stating that a permit is needed for a porch. Herb seconded. Carried. SOLICITOR Cable TV - Prenatt reported that only Coaxial seems to be interested and sent a franchise agreement and suggested ordinance amendment. They will only do a portion of the Twp. Mark and Board will review the franchise and amendment. Milled Material - Prenatt said the airport just received a 3 million dollar grant to redo the rest of their runways. He suggested approaching them to see if we can make a deal for those millings. Mark will contact the airport authority and ask to see the contract. Front Foot Assessment/Silverthorn - it appears the section from W. Stancliff to Old State voted yes and want to meet with the Board and Solicitor in private. They don't want the confusion of others living on other sections of Silverthorn present. Sitek - if we meet to get questions and make no decisions, is that all right? Henderson - we already made our decision in a public meeting. Netzler - the Sunshine Law won't allow it. Sitek - I'll tell them to get their questions together and we will answer them in a public meeting. Man on Mohawk - nothing. Nudity Ordinance - Herb said he has told people who inquired that according to the ordinance you can make pornographic movies but you can't sell them. What you do in your own home is your business as long as you don't sell it. Girl Scout Appeal Hearing - Mark reported that no decision has been made yet. We told them that the Township had no problem with the camp being tax exempt but not the other properties. Henderson - that is what the decision was with Hamot Hospital. Lost Gravel Property Line Problem/Zessinger Pit - an executive session will be held on these two items. OLD BUSINESS Sesquicentennial - nothing this year. Safety Meetings - nothing. Provider List - nothing. Employee Rights - nothing. Neighborhood Crime Watch - nothing. NEW BUSINESS Garbage Billing Changeover - nothing else. Dial and Save - is a competitor to A.T. & T., M.C.I. CORRESPONDENCE Annual Convention - Herb, Dave, Bonnie and June will attend all, Ben will let us know. Capital Improvements - Herb will attend. Review of Specs/Boom Mower - Herb said that whatever machine we buy, we need to apply for 2% money. All agreed. A call was placed to DCA to question whether we finance and they reimburse us if we receive a 2% loan. Netzler - why take the machine until we see about the loan. Henderson - we wanted to mow this fall but this is certainly worth looking into. Sitek - I have no qualm with giving up mowing this fall to get a favorable loan rate. Ken Seigworth reviewed the specs of his mower which is with an 86 h.p. deluxe model Ford tractor. Ken Cowher reviewed the specs of his mower which is with a Massey Ferguson tractor. Netzler - it all goes back to service. I'd go with a clutch pack any day but when they break down they're a real problem. Both dealers want to bring their mowers and tractors up for a demonstration. Ben Sitek turned the meeting over to Vice Chairman Netzler and left the meeting at 1200 hours. A special meeting will be advertised for October 7, 1994 at 9 a.m. for a mower and ditcher demonstration. Netzler, Henderson and Attorney Prenatt left for an executive session at 1215 hours.
