October 11, 1994 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman Benjamin Sitek with the Pledge of Allegiance at 2000 hours. Present were Sitek, Herbert Netzler and numerous residents. David Henderson was absent as he had to attend another meeting. Netzler announced that an executive session was held on Sept. 29, 1994 to discuss missing gravel from the Zessinger pit and the pit's boundary lines. MINUTES Netzler moved to accept the minutes of 9/29/94 and 10/24/94 as presented. Sitek seconded. Carried. VISITORS Ben Sitek, Jr. - I understand the petition for Silverthorn Road was turned in. Sitek - yes, but no action will be taken on it until Oct. 24th. The Solicitor is checking into whether the money is tax deductible. The bid will be let in 1996. If nothing happens with oil prices, the bid should be within a few cents of the price quoted. We can stop the paving if the bids come in high. Sitek, Jr. - any possibility for a grant? Could you approach the County Executive, Judy Lynch. Sitek - you'd have to go to your legislators for a low income loan but the road as a whole doesn't qualify. Netzler - you can approach her but the County doesn't have any money. We need to change the block grant funding regulations. Sitek - I tell every legislator every chance I get that it's wrong the way it's distributed. Netzler - it's a Federal program, the question is on who is doling it out, the State or the Feds. Sitek, Jr. - there is still time to change your vote until Oct. 24. Will you review on whether tar and chip could be used. What happens if you reconstruct in 1995 and the bid comes in high in 1996. Netzler - you'll be driving on a reconstructed road. Kyle LeSuer - how can the petition be valid if the information given out isn't valid. Netzler - the petition is valid whether the question on tax deduction is accurate or not. If it comes back as not deductible you can have a revote. Denver Ireland - are you still going to gravel West Stancliff to Fry? Did you buy the Tiger? Netzler - I have no plan in front of me, I can't say. The Tiger was leased until a 2% loan comes through for half, the rest will be financed. Sitek - Silverthorn was on the schedule for 4" of gravel in 1995. We pay around $12,000 a year for mowing, payments on our own Tiger will be around $8,000 a year for ten years. The Tiger will be in the 1995 budget when payments start. REPORTS Superintendent - no report, absent. Plows for Grader - nothing. Orders from the Board - nothing. Waterways - nothing. Driveway Pipes - nothing. Resolution on Salt Contract - no action until form is received. Back Bill for Yellow Bags - Netzler moved that if Waste Management does not pick up their yellow bags from the garbage bin, we will have Welka Disposal pick them up and we will back bill Waste Management. Sitek seconded. Carried. Netzler - the order size for bags was too large, the red tags are all right with me. Sitek - the bid was to provide bags. I think Welka should come up with something. We are considering stickers instead of red tags. He bid bags and now we only have the tags, it's not fair to the residents. Netzler - we were trying to work this through before the new contract took off but Baumann Disposal dropped it and then the fun started. Weiss Driveway Pipe - no action. FINANCIAL AND TAXES Bills - Netzler moved to pay the bills as presented less Anderson Equipment for the shifter and labor totaling $1,696.23 general fund. Sitek seconded. Carried. Payroll - Sitek moved to approve payroll #20-94. Netzler seconded. Carried. Copier - nothing. Minute Book - Herb moved to purchase a minute book. Ben seconded. Carried. PLANNING, ZONING, HEALTH DEPARTMENT Industrial Grants - nothing. Sewage/Washington Twp. - nothing. Soltys Replacement - nothing. George Burbules/Sketch Plan - Mr. Burbules was not present. Tina Johnson/Conditional Use - Ms. Johnson is requesting a conditional use permit to operate a notary public service from her home at 10771 Eureka Road. Sitek moved to advertise a hearing for November 8 at 7:45 p.m. Netzler seconded. Carried. SOLICITOR Most items on hold until the last meeting of the month. Nudity Ordinance #4-94 - Netzler moved to advertise the hearing for the ordinance. Sitek seconded. Carried. Netzler in answer to question - call the Liquor Control Board for noise control. Lost Gravel - Herb said he feels we need a meeting with the other two townships involved. Sitek - the meeting should be with all who got gravel, the townships, ESTA and Hoover. I can't see this Township taking the loss. Percentage of compaction was discussed. Netzler - the thing that worries me is we came up short twice. They crushed another 6,000 yards and still came up short 2,000 yards. I think the biggest share is at ESTA. There is a big difference in Hoover's compaction rate and the engineer's compaction rate. I think we're out close to $15,000 on this deal. Discussion. Sitek - we've never had problems before we started crushing gravel. We may have lost a load or two between townships but never this amount. Discussion. Netzler - it compacted to 2 1/2 inches. All we'd need to do is dig in the road and see where it's at. Sitek - the best thing is to get everyone together and figure it out. OLD BUSINESS Nothing on any of the items listed. NEW BUSINESS Nothing. CORRESPONDENCE Reviewed. Tony Donikowski - I think the cost on Silverthorn Road should be divided equally between all the residents using the road and not by front foot assessment. Netzler - the law says you must pay by lineal foot. There is no other way that is legal. The law says it's by front foot assessment. The law may not be right but we have to live with it. If the Attorney says it's not tax deductible, the petition will go back to the residents. Sitek - should the road paving not go through, I don't believe I want anyone to tell me the roads are bad. This Township was ridiculed during the bad spring of 1993 even though other townships had roads closed too. Our citizens are doing the bitching and giving us the bad press. Frank Servidio - the roads are better now than in the last 17 years I've been here. ADJOURN Sitek called the meeting adjourned at 2100 hours. Bonnie J. Bernhardt, Secretary
