April 11, 2000 Chairman John Sachar called the meeting of the Supervisors of Franklin Township, held in the Township office, to order at 2004 hours with the Pledge of Allegiance. Present were Sachar and Supervisor David Henderson. Secretary Bonnie Bernhardt was on vacation and Vice Chairman Denver Ireland was attending the Pennsylvania Association of Township Supervisors Convention in Hershey, PA VISITORS/PUBLIC COMMENT There were no visitors present. HEARING-CONDITIONAL USE, MIKE PONTORE, HOME OCCUPATION There were no visitors present to give comments. The Supervisors reviewed the Planning Commission's record. Sachar moved to grant a conditional use permit for a home occupation to Mike Pontore under the conditions described by Mr. Pontore to the Planning Commission. Seconded by Henderson. Carried. MINUTES Sachar made a motion to approve the minutes of the March 30, 2000 meeting as presented. Seconded by Henderson. Carried. REPORTS Roadmaster-Henderson reported that the roads were suffering from the excessive rain and many potholes were appearing. Grading will have to wait for a dry spell. Repairs were in progress on the #5 Truck spreader. A new lower hopper assembly has been ordered for both trucks to replace the rusted original equipment. Also the chain is being welded to secure the pins in the chain. It is expected that the #6 Truck spreader chain will also have to be welded. The crew also prepared and cleaned the equipment that went to the auction. The auction was held Saturday and the equipment went for very low values. Mager Tree Report-nothing Agility-The Roadmaster had a meeting with George Bacho, the PennDOT Assistant Manager for this area. We will be doing the mowing and ditching as in previous years plus digging two or three tail ditches. In return we will utilize PennDOT's seal coating crew for repairs on Fry and Silverthorn. The amount of seal coating resulting from this trade of services will probably not be enough for the needed repairs on Silverthorn and Fry and will have to be supplemented by Russell Standard. Next year we will be planning to use PennDOT's track hoe for doing the inlet work on the Francis pipe. Francis Rd Pipe and Falls Road Bridge-Russell Standard had two trucks, a loader and bulldozer working for three days last week to move the pile of spoils from the Falls Road Bridge project to the Francis Road Pipe. In addition, Shingledecker also had their bulldozer and a truck hauling directly from the bridge to the pipe. The fill has considerably widened the road through the dip. With the large safety zone now established on the north side of the road, less guide rail will be needed. It is expected that the guide rail can begin just east of the telephone pole and west across the pipe to the west end of the dip. The south side will continue to have guide rail the entire length of the dip but it will be set back considerably allowing the road to be straightened through the area. The end result will be a significant increase in the safety of the area for the motoring public. Generator-nothing. Airport Millings-nothing. One-ton Purchase-The Gerry, NY auction this Saturday is not expected to have any one-ton diesels. However, the Palmyra Auction on May 20th is expected to have several. The Supervisors are planning to attend. Oshkosh-The Supervisors will travel to Williamstown, NY to inspect a 1984 Oshkosh that Williamstown has for sale. Information was received via Teitsworth Auction on this vehicle. Also, the Roadmaster has been informed that the Erie Airport may have an Oshkosh for sale. He was unable to get information on the airport Oshkosh for this meeting but is expecting it soon. Summer Road Program-nothing. Pavement Repairs Fry and Silverthorn-nothing. Scott and Marilyn Tait arrived at 2020 hours. Gravel and Dirt Roads Program-The Roadmaster was requested by the Erie County Conservation District to provide them with locations on Township roads where significant erosion of gravel road surface or ditches was causing silt to be discharged into streams and creeks. Gene Clemente and the Roadmaster visited all the sites and identified the characteristics of each subject area. This information will be used to request funding for repairs through the new state program designed to reduce sedimentation and erosion from gravel roads. The Roadmaster noted that two of the eight sites-Stancliff at I-79, and Eureka north of Blount's and South of Crandall's-were particularly bad and would be near the top of the Counties list based on sites that Clemente has visited. This funding would be available in 2001. The Roadmaster noted that he had been planning repairs this year to the two areas mentioned. Since this funding is likely to be available, the repairs this year could be scaled back to just include lining the bottom of the ditches with riprap to prevent further scouring of the sides and bottoms of the ditches. Next year the funds could be used for pipes and cross pipes, bank stabilization and graveling. The Roadmaster will have to attend a school in the fall on erosion and sedimentation control to qualify the Township to receive the funds. Western Trails/Antolik-The Tait's inquired about the progress on the independent engineer Bruce Simmons review of the Antolik bill. Henderson noted that he and the attorney were preparing a rebuttal to Moorhead's memo. Once Simmons receives this rebuttal in about a week, a swift decision is expected. According to the law, Antolik is required to immediately pay the engineering fees as determined by Simmons. If he does not pay as he agreed in the last court order, the Township will have to go back to court in a contempt action. Discussion. The Tait's left at 2035 hours. FINANCIAL AND TAXES Bills-discussion on various bills. The cost of the Zoning Hearing Board action with Roberts was discussed while reviewing the Elderkin law firm bill. Attorney Steadman's bill has not yet been received. Sachar made a motion to pay the bills as presented. Henderson seconded. Carried. Payroll-Sachar made a motion to approve payroll #8-00 as presented. Henderson seconded. Carried. Sachar noted that he felt our pay rates were low considering that there were no other benefits being paid to employees except vacations. PLANNING, ZONING AND HEALTH DEPARTMENT Review Planning Commission Minutes-The Supervisors reviewed the Planning Commission minutes and took note of the request of Don Kuhn to reduce the rear yard setback on the rental property he is planning to sell to the renters. The proper way for Mr. Kuhn to request this action would be a variance through the Zoning Hearing Board. The Planning Commission exceeded their authority in this matter. Supervisor Henderson said he would talk to Mr. Kuhn. The easiest solution would be for Mr. Kuhn to observe the setback. The property owners by mutual agreement could ignore the location of the fence. This would be far less costly than a Zoning Hearing Board action. Henderson made a motion to recommend to Mr. Kuhn to establish his rear yard line at 50' from the barn and ignore the fence. Sachar seconded. Carried. Update Comprehensive Plan/Vision Committee Report-It was expected that the Vision Committee would be presenting their final report at this meeting. However, no one from the Vision Committee was present. Industrial Park @ I-79 and Crane Road/KOZ-Supervisor Henderson indicated that he attended the Regional Sewer meeting on Friday. Unfortunately, the Borough has sued DEP over the DEP's most recent requirements levied against the borough. Further, an official action by some developers regarding Edinboro's 537 Plan is also now in the legal arena. Consequently, Borough representatives were not present. They sent their attorney. This leaves the progress up in the air for the time being. Harvey Craft Show-The application for a Public Assemblies Permit has been received and must be approved or rejected at the April 27th meeting. The Supervisors are to review the material and be prepared to make a decision. Adopt Erie County Subdivision Ordinance/Ordinance #1-2000-The Supervisors are to review the Ordinance in their boxes. The hearing and adoption is scheduled for May 25th. Review Andrew/Ella Buren Subdivision-It was noted that a letter had been sent to the Buren's. No response yet. SOLICITOR No action taken on the solicitor's agenda items. OLD BUSINESS Lights on for Safety-nothing. Census-A meeting is still being planned with Congressman English. The Census Bureau web site shows that Franklin Township is above average in returns. The mail back target is 84 percent. The remaining 16 percent will be enumerated in person. Recycle Day-The best date seems to be Saturday, June 17. Since neither Supervisor could think of any conflicts, it will be held that day. NEW BUSINESS None.
