May 25, 2000 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar with the Pledge of Allegiance at 0804 hours. Present were Sachar, Denver Ireland, David Henderson and a representative from PCE Engineers. HEARING: ORDINANCE #1-00, SUBDIVISION ORDINANCE, 0805 HOURS No one was present for public comment. Henderson moved to adopt Ordinance #1-00, the new Subdivision Ordinance. Ireland seconded. Carried. VISITORS/PUBLIC COMMENT Ward and Carol Sanders, Small Flow Treatment Facility - M/M Sanders are planning on building a new home on 90 acres of their 100-acre parcel that will front at 8350 Carbury Road. They will subdivide off 10 acres with the existing house at 10827 Ivoray Road. The new home will be serviced by a small flow treatment facility. Discussion on the facility location and the agreement that stipulates that a $1,000 be put in escrow in case of a system failure. Henderson moved to pre-approve the Sanders Small Flow Treatment Facility pending approval by the Planning Commission and the arrival of the final documents. Ireland seconded. Carried. MINUTES Henderson moved to approve the minutes of 5/9/00 as presented. Ireland seconded. Carried. REPORTS Superintendent - Dave reported that the recent rains have prevented grading. Crew is grading today. Crew has installed driveway pipes, did odds and ends outside as weather permitted. The guide rail that was not in the bridge contract was removed and moved to Francis Road. Paving of the bridge may occur today or tomorrow. Ireland - are the 10-ton weight limit signs allowed? Henderson - yes, under the emergency provisions of the ordinance for frost season. We'll take them down next week. Caldwell Truck/A-1 Zone, 10191 Silverthorn Road - Mr. Caldwell called Rep. Boyes and PennDOT to see if we cited him legally. We are within our rights to do what we did. Sachar - even if the truck is empty, it's overweight. Henderson - there are two violations here, a zoning violation and an overweight truck. The State law is written on gross weight and is written that the Township can even eliminate local deliveries if needed. Further discussion pending the arrival of the Solicitor. Mager Tree Report - nothing. Generator - nothing. Plaque for Falls Road Bridge - price for aluminum is $295, price for bronze is $404. Henderson moved to authorize the purchase of a bronze commemorative plaque for the Falls Road Bridge #2. Ireland seconded. Carried. Agility - the mowing of state roads is progressing. Rt. 98 is done, Ray is on Crane today. Airport Millings - the contract has been let. We should hear something soon. We will have Russell Standard haul for us for half the millings. Quote/Oshkosh Spreader - Henderson said that he would recommend the quote from Walsh Equipment for a stainless steel spreader box with a 9-foot spreader and a cab protector for $8,600. Henderson - is anyone interested in a stainless steel walkway and fenders on the spreader for $492. Ireland - I don't think we need stainless rear fenders. Henderson - if you're not interested, we can use boards with angle iron to attach them to the spreader. Sachar - stainless would be a neater job and I don't think we can do it for under $500 if we do it ourselves. Buy the spreader if he gives us the walkways. If you add up the man-hours, it's a horse apiece. I'd rather see stainless on stainless. Buy it if he'll come down to $400, he should throw it in. Sachar moved to accept the quote from Walsh Equipment for a stainless steel spreader that should include stainless steel walkways and cab protector. Ireland seconded. Carried. Front Fenders/Oshkosh - the front fenders are fiberglass and are cracking and needing support. Gehrlein Welding can build two new steel fenders for $550, which is less than supports for the existing fenders. Henderson moved to have Gehrlein Welding build two new front fenders for the Oshkosh. Ireland seconded. Carried. One-Ton Purchase - a 1993 Ford 350 diesel 4x4 with dump box and plow was purchased at the Palmyra auction for $15,000. Sand Blast and Paint/Oshkosh, Spreader, Plows, International Chassis - quotes were received from C.W. Beal and Salt Painting in Saegertown. Salt was the least expensive at $2,283.40. Discussion on use of epoxy paint instead of enamel. Ireland moved to accept the Salt Painting quote and to use their epoxy paint. Henderson seconded. Carried. Logo for Trucks - vinyl decals are $30 each. We need twelve. Henderson moved to approve the logo as designed and the purchase of 12 decals. Ireland seconded. Carried. Discussion on the new one-ton. Our spreader is shot. One can be purchased for $400 from West County that should last several years. Repairs to Fry and Silverthorn - bids were advertised for opening on June 11th. August 4th will be the deadline for completion of repairs. PennDOT will seal coat the alligator cracks on Fry that the contractor does not do. Dave reported that he thinks Washington Township will split the cost of the Fry Road repair job. FINANCIAL AND TAXES Bills - Ireland moved to approve the bill list for payment totaling $74,664.35 general fund ($62,276.62 Shingledecker Welding); $5,420.10 EIT Claims fund. Sachar seconded. Carried. Payroll - Sachar moved to approve payrolls #10-00 and #11-00 as presented. Ireland seconded. Carried. Appoint Monahan and Monahan to Audit EIT Books - Sachar moved to appoint Monahan and Monahan to audit the earned income tax receiver's books for the fiscal year ending June 30, 2000 and to notify the School District of such. Ireland seconded. Carried. PLANNING, ZONING, HEALTH DEPARTMENT Planning Commission Minutes - none. Update Comprehensive Plan/Vision Committee - hearing is July 11th at 8 p.m. Industrial Park/KOZ - Sachar moved that Franklin Township supports a regional sewer authority and authorized sending a letter to David Milhous of DEP stating that support. Ireland seconded. Carried. Buren Subdivision - the Solicitor is working on the deeds. Roberts Zoning Hearing Board Appeal - nothing. SOLICITOR Western Trail/G. Antolik - should hear from Engineer Simmons soon. Discussion on the appeal. Impact Fee Ordinance - nothing. OLD BUSINESS Lights on for Safety - nothing. Census - nothing. Recycle Day - will contact the freon people. NEW BUSINESS Support for Local Fire Department - meeting soon with the fire department. Ireland - put something in the newsletter about supporting the department. Community Character Education - will add something to the newsletter. Sea Wolves Game/Recycle Day - free tickets are available through the Erie County Recycling Office. Denver asked for four tickets. Failure to Stop at Stop Signs/Letter to PSP - we have had two accidents this year caused by failure to stop at stop signs. The intersections of Old State and Rt. 98 and Rt. 98 and Crane are particularly bad. Discussion. Henderson moved to send PSP a letter notifying them of the problem. Sachar seconded. Carried. CORRESPONDENCE Upcoming training workshops were reviewed. Attorney Felicia Schroeck arrived at 0923 hours. Caldwell Truck on Silverthorn - Sachar suggested having the Solicitor send a letter to Mr. Caldwell stating that immediate enforcement action will be taken if he doesn't comply. Henderson - he's violating our regulations and the State's regulations also. The Solicitor was instructed to write a letter to Mr. Caldwell detailing the fines per day for violation and giving him a 10-day deadline for compliance.
