June 13, 2000 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar with the Pledge of Allegiance at 2002 hours. Present were Sachar, Denver Ireland and David Henderson. BID OPENING: ID-2 BITUMINOUS BINDER/SEAL COAT- 2004 HOURS One bid was received. Russell Standard Corp. bid $43,651.96 for work to be done on Fry and Silverthorn roads. Discussion on the state seal coating some spots on Fry. Ireland moved to accept the Russell Standard Corp. bid noting the clerical error in referencing Silverthorn and Fry. Henderson seconded. Carried. VISITORS/PUBLIC COMMENT No visitors present. MINUTES Sachar moved to accept the minutes of 5/25/00 as presented. Henderson seconded. Carried. REPORTS Superintendent - Dave reported that the rain has delayed grading. The areas to be oiled were graded but Russell Standard didn't get to it and they will need to be scuffed up again. The rest of this week will be spent getting ready for Recycle Day. The title work was done on the two new trucks. The one-ton was inspected and is in service. A radio was installed in it and more hydro work needs to be done for the spreader. Discussion on the fire at Gehrlein Welding. Luckily our Oshkosh fenders and plow were not in the building. In answer to Denver, the rocks by the gravel pile will be used to stabilize the ditches on Eureka by Crandall's and on West Stancliff by I-79. Mager Tree Report - nothing to report. Agility - Ray is done with the first round of mowing on state roads. Falls Road Bridge #2 - the bridge is done and open to traffic. Henderson moved to send thank-you letters to all who helped move the project along. Ireland seconded. Carried. Falls and Francis Road Signs/Speed Limit, Ordinance Required - Dave reported that Mark Corey will give us a warrant that the speed limit should be 35 mph. We'd have to draft an ordinance to that effect. Sachar - why so many signs? Henderson - jake brakes are used by trucks coming and going to Russell Standard and it's waking up the neighbors. Dennis Howard is asking that the signs be put up restricting their use during certain hours. The guys at Russell Standard aren't doing it, it's people who don't know the area doing it. Ireland - there are 30 signs listed here, what's the speed limit now? Henderson - 55 mph. Discussion on the need for various signs. Sachar - the roadway will look cluttered with all these signs. Henderson - we can eliminate the jake brake and 35 mph signs if you're not going to pass an ordinance. All the rest of the signs are required. The problem is, what is the proper speed limit for the terrain. Sachar - for now, scratch the jake brakes and speed limit signs and install the rest of them. We don't need an ordinance for the rest. Henderson - you'll have to be in the position to explain why you're going against the wishes of the neighbors and the recommendation of the engineer. Walsh's quote for all the signs is $771.56. Sachar - we're spending money hand over fist and I don't see where we have the income to do it. It wasn't a budgeted item. Henderson - we'll be doing a mid-season budget to see where we're at. Sachar - this will be sign-city. We spent the money on the bridge to make it blend into the area and then cover the area with signs. Fax this to Dennis Howard and see what he says. Issue was tabled. Generator - nothing. Airport Millings - nothing. Gravel Road Program - nothing. Repairs on Silverthorn and Fry - the crew has areas to dig out 3 to 4 inches deep on Silverthorn and fill with binder, will be overlayed with 2 inches of asphalt and seal coat by Russell Standard. They will just overlay Fry. Brine Road Spreading Permit - last fall the state changed the regulations on spreading brine and no municipalities were informed. They are now asking everyone to get a permit. This permit only applies during the summer, and not the winter. The application for a permit has been sent. Equipment Sandblasting and Painting - the total price is $2,781.16 and includes painting the outside as well as the inside of the spreaders and using their paint. The cost is $450 over the original quote. Work will begin on Monday. All agreed on doing the extra work on the spreaders. FINANCIAL AND TAXES Bills - discussion on various bills. Sachar moved to approve the bill list as presented totaling $105,134.86 general fund ($97,292.75 to Shingledecker Welding). Henderson seconded. Carried. Payroll - Sachar moved to approve payroll #12-00 as presented. Henderson seconded. Carried. PLANNING, ZONING, HEALTH DEPARTMENT Planning Commission Minutes - reviewed. Dan and Kathy Netzler Conditional Use Request for a Home Occupation - the home occupation is for Dan Netzler's semi-tractor and trailer. They hope to build a two story building 50'x100' to be used for hay storage on the upper level, house several horses and the front section would be used for family truck and farm equipment repair. Henderson - we have to treat everyone equally. Findley Horn has a trucking business on Eureka with one truck. Dan lives on the dirt section of Silverthorn. Jerry Caldwell is an extenuating circumstance. He is on the paved section of Silverthorn. Ireland - George Antolik is another one. Henderson - his loads are always heavy. Dan doesn't come in or out that much and he's lighter than the milk truck coming in every day. The difference between a conditional use and grandfathering is the restrictions put on it. For Findley, he can't sell to anyone else as a truck terminal. This home occupation business is just the tip of the iceberg. Trucking isn't the only thing. Sachar - are we saying we want to control every aspect of the citizen's lives? Henderson - just the opposite. We have zoning that says it's not allowed. We're allowing it with stipulations. We need to work with the Planning Commission to solve the problem of home occupations. The tax collector says 50% of our residents are filing a Schedule C using their homes as a tax write-off. Those that you don't know about is good, you can't tell there is a home occupation. Trucks are a prime example of a visible home occupation. Sachar - maybe the truck needs to be parked inside the 50x100 building. Henderson - the character of the neighborhood is rural residential. We don't want him running the truck up and down in the spring when the road is soft. Danny keeps his truck at Herb's in the spring. There must be uniformity. Sachar moved to advertise for a conditional use hearing for a home occupation for Dan and Kathy Netzler, 11401 Silverthorn Road, for July 27 at 8 a.m. Henderson seconded. Carried. Ward and Carol Sanders SFTF/Agreement and Resolution #1-00 - the forms for the small flow treatment facility that were previously approved were signed. RESOLUTION#1-00 Resolution of the Supervisors of Franklin Township, Erie County, PA for a Plan Revision for New Land Development. (see Sanders file for Resolution in it's entirety). Henderson moved to adopt Resolution #1-00 for the Sanders SFTF. Ireland seconded. Carried. Public Hearing on the Strategic Plan - legal ad is in for the July 11th hearing. Industrial Park/KOZ - nothing new to report. Legal maneuverings are going on. Buren Subdivision - no word from the Solicitor. Replacement for Ralph Breiding on the Planning Commission - Mr. Breiding's resignation was accepted with regret. Will ask Dave Knight if he would be interested in filling the position. SOLICITOR Western Trail/G. Antolik - Henderson stated that if Mr. Simmons is really doing a good job and reading all the information, it could take awhile. Sachar - the neighbors on that road will want an answer before winter. Impact Fee Ordinance - nothing. Roberts Zoning Hearing Appeal - update given. OLD BUSINESS Lights on for Safety - nothing. Census - currently the Township is at 76%. Recycle Day, June 17th - all will be ready by Saturday. A special letter will be sent to those who have more than one junk vehicle. A list will be compiled so the letters can go out by the first of July. NEW BUSINESS Supporting Volunteer Fire Departments Brochure - the brochure contains good ideas on helping to keep volunteer fire departments viable. Community Character Education - nothing. Failure to Stop/ATV Damage to Roads and Ditches - the original letter was revised to include damage caused to the roads and ditches by ATV's. Henderson moved to send the revised letter to PSP. Ireland seconded. Carried. PNC Sweep Account/Debit Card - discussion. No action. Ordinance #1-00/Subdivision Ordinance - several copies were signed. A letter will be sent to Erie County Planning asking them to have a large quantity printed and then we and those other municipalities adopting their ordinance by reference can purchase copies from them.
