August 31, 2000 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0800 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, and Engineer Steve Halmi. VISITORS/PUBLIC COMMENT Steve Halmi/William Walker Subdivision Sketch Plan - Mr. Halmi presented several sketch plans for a proposed subdivision of William Walker's property located between 10493 and 10605 Silverthorn Road. The parcel is approximately 70 acres and goes to I-79 at the rear. Mr. Walker has a prospective buyer for the northern 35 acres. The remainder of the property will be divided into at least 4 lots with a community small flow treatment facility servicing all the lots. The rear property will be dedicated to a homeowner's association to be used as bridle trails and green space. Three lots will have 250 ft. of frontage on Silverthorn, the 4th will be a flag lot with 50 ft. of frontage. One alternative sketch showed 5 lots with 2 being flag lots. The name of the subdivision is Trotters Trace. Estimated cost of the 4-5 acre lots may be $60,000 which includes septic and roadway costs. William Walker arrived at 0810 hours. Henderson - well water could be a problem. Walker - four is a bad number for a community organization. I have a prospect for the northern 35 acres and he may want additional acreage that could be at the rear of the other lots. Ireland - either plan looks good. Halmi - we had the land tested for septic. There is no suitable land for an on-lot system but it is okay for a community system. DEP can okay up to 5 lots on the system. Ireland - each lot would put up a $1,000 escrow for any repairs. Henderson - there are new systems on the horizon, REA's and others. Walker - the problem with a community system is the administration side and the maintenance side. With individual systems, the problem is easements for the 4-5 lots to the stream. Henderson - you could use a publicly dedicated private drive. If it was built to Township standards and dedicated, the Township could take it over and maintain it. Discussion. Mr. Walker will make a decision on which sketch he will go with. Mr. Walker and Mr. Halmi left the meeting at 0835 hours. MINUTES Henderson moved to accept the minutes of 8/8/00 with addition, Ireland - "I'm afraid Franklin Township is doing DEP's job". Sachar seconded. Carried. REPORTS Superintendent - Dave reported that the front bay is being painted today. The Oshkosh is ready for the spreader to be installed, Ray is mowing, 2 dry hydrants were installed. Ireland - Kathy and Dan Netzler will be here on September 12th. Why is the hydrant on Old State so high and the one on Fry so low. Henderson - the water level has to be below the freeze line. Either no hydrant on the Old State pond or the way we did it. They are suppose to be low, you're hydrant is too high. Ireland - do something different with the one on Old State. Henderson - you have to have the head height below the freeze line. The water level is 4 feet below the head. There is no better way unless you could go onto the neighbor's property and he wouldn't allow it. Mager Tree Report - Denver said he's looking at them. Agility - Dave reported that he has the final survey of Fry Road for PennDOT to seal coat. They can do all of the remainder of the road, that will put us $2,000 in the hole to PennDOT. We can make it up next year with mowing and there will be some left over to rent their track-hoe for use on Francis Road. They will seal coat Fry next week or the following week. Falls Bridge #2 Dedication/Sept. 12, 6 p.m. - proposed agenda was reviewed. Falls and Francis/Speed Limit/Ordinance #2-00 - hearing is Sept. 28th, 8 a.m. Dave will draft the ordinance. Generator - nothing. Airport Millings - our share was 31 loads of millings. Gravel Roads Program - nothing. Girard Township Complaint/Gudgeonville Road - their letter complained that we weren't repairing the section of Gudgeonville per our road agreement. On their own initiative, they tarred and chipped that section several years ago. Sachar - send them a letter saying that if they wish us to, we will be glad to scar fire it back to gravel and maintain it. Henderson - that section between Clair Wright and Francis is scheduled for graveling in 2002, the section between Old State and Francis is scheduled for 2001. They have repaired it and paved it. If we're suppose to maintain it, we have to decide to put money into it like they do or take it back to gravel. Ireland - how much to gravel it. Henderson - it is .72 miles, probably $8,000 to gravel it. They're putting that much in it every year. Sachar - read from the agreement. It does not include major reconstruction, it does include regular dirt road maintenance. State in the letter that we received their letter and will take the issue under consideration. FINANCIAL AND TAXES Bills - discussion on various bills. Henderson moved to pay the bills as listed totaling $17,758.74 general fund; $1,635.13 state fund; $1,904.05 fire dept. fund; $8,825 transfer from special money market fund; $11,403.09 EIT fund. Ireland seconded. Carried. Payroll - Henderson moved to approve payroll #17-00 and #18-00 as presented. Sachar seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Review Planning Commission Minutes - nothing. Update Comprehensive Plan - nothing. Buren Subdivision Progress - nothing. George Schroeck arrived at 0904 hours. George Antolik arrived at 0907 hours. Industrial Park/KOZ - we received a copy of a letter to Washington Township from Edinboro Borough proposing annexation of sections of Washington Township and Franklin Township by the Borough. Also received was Washington Township's reply, they were not in favor of discussing annexation. Discussion on the procedure to follow for annexation, merger and consolidation. Recreational Complex/VFW - Ireland and Henderson attended at meeting at the VFW. They are interested in a sports complex of several softball and soccer fields. Grants were discussed. Henderson - no one needs to attend the grant seminar if the VFW doesn't make the next move. Recreational Complex at Dave's Pond - Hugh Crandall suggested in his letter inquiring of Dave Strong for a first right of refusal contract on making his property into a recreational complex. Abandoned Gas Wells - no further information. Storage Trailers - Schroeck stated that there are no cases for or against on this issue. He cautioned to tread carefully, that any time trailers have wheels on them they are treated differently. They usually have a current inspection. Sachar - I was surprised at the price Birkmire gets for their trailers. Ireland - what about raising the permit fee? Henderson - there is no tax on them, just a permit fee. Schroeck - that covers trailers used for storage. Henderson - if they come in as an inspected trailer and they get two 6-month permit periods, we know at the end of the period, they will be off inspection. Supporting Volunteer Fire Departments - FTVFD will attend Sept. 28th. Recycle Day/Junk Cars - collection is in process. Jim Mischler pulled one out at Throop's on Silverthorn, one more to go at another location. SOLICITOR Western Trail/G. Antolik - discussion on the decision from the independent engineer. Sachar - is there no provision for appeal? Schroeck - you can always appeal. We lost around $4,000 plus the remainder of the retainer fee. We should independently read Mr. Simmons's opinion and do our own figuring. Sachar - first do we accept Simmons's arbitration on this? Ireland moved to accept the Bruce Simmons arbitration decision and to send George Antolik a bill for the amount determined after review and to pay the remainder of Mr. Simmons's retainer. Henderson seconded. Carried. Sachar - Attorney Schroeck will review the actual amount owed and give us a tally. Impact Fee Ordinance - nothing. OLD BUSINESS Lights on for Safety - nothing. Census - nothing. Community Character Education - nothing. NEW BUSINESS County Flag - discussion on purchasing a new county flag. No action. CORRESPONDENCE Reviewed. George Antolik/Western Trails Subdivision Expansion - Mr. Antolik presented a proposed sketch of an expansion of the existing roadway. Discussion on the name change from Western Trail to Dusty Trail. Henderson - we numbered the houses on a U-shaped drive. A 90-degree angle will mess up the whole thing. Antolik - I'll send this to Mark Corey for review. We started the preliminary work but won't develop it for a couple of years. This is just the expansion of the road. Henderson - there is a preliminary plan for the development in phases. You have to get your second phase approved first. Antolik - I'm just putting in the road now. Henderson - we'll have to research this, I think you're getting the cart before the horse. There's deed restrictions, a developers agreement, a builder's agreement, a bond, an escrow agreement, etc. To determine the specifications, we have to have an agreement for a bond. Antolik - you don't need the bond until the road is completed. I may keep this a private road. Sachar - something doesn't sound kosher to me, we'll research it and send you a letter. Henderson - all the rules have changed. We have new subdivision regulations now. Sachar - we'll review it and send Mr. Antolik a letter listing the steps he is to follow.
