September 12, 2000 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2000 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Dan Parker and Kathy Netzler. RECONVENED CONDITIONAL USE HEARING FOR A HOME OCCUPATION OF DAN AND KATHY NETZLER, 11401 SILVERTHORN ROAD Sachar - we received no public comments and the Planning Commission gave their recommendation for approval. The Board is concerned that the business will not expand beyond what you've proposed. K. Netzler - we will have one truck only. We have no intention of having more than one. We would like to have a detailing business at some point. We are going to build the building at maximum size. We may change our minds and go smaller but not bigger. Henderson - it's not wise for us to make a determination when you don't know what the business will be. The operation of your trucking business is the critical factor right now and any restrictions put on it. I would suggest one truck only used for the business and that truck is not to be operated on Silverthorn Road during spring thaw. Sachar - a home occupation is not to visibly affect the neighborhood. It should look like a farm area and not like a trucking business. Ireland - we don't want it to grow into 5 trucks. Netzler - I understand and agree completely. We like our farming also. The big building is to work on farm equipment and to park the truck in. Sachar moved to approve the conditional use request for a home occupation of Dan and Kathy Netzler, 11401 Silverthorn Road to operate a one truck trucking business. Restrictions are: 1. the home occupation business is limited to one truck, 2. the truck is to be stored inside a building as much as possible, 3. the truck is not to be operated on Silverthorn Road during spring thaw periods. Henderson seconded. Carried. VISITORS/PUBLIC COMMENT No comments. MINUTES Ireland moved to approve the minutes of 8/31/00 with corrections. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that the front bay is finished and things are being moved back in. Crew will mount the spreader on the Oshkosh, Ray is mowing. Plans were to mow the tail ditches for PennDOT but it rained. Fry Road was seal-coated by PennDOT. Request ditching was done. Crew will begin to grade and get ready for winter. Ireland - the intersection of West Stancliff and Eureka needs to be graded. Henderson - that intersection will always be a problem. The oiled strips are the same, the gravel eroded and the oiled part didn't. Mager Tree Report - nothing. Agility - we didn't get to the three days of tail ditching. Will put it into next year's program. This will put us further behind with PennDOT next year but it is too wet to do it now. The credit will work itself out next year. Falls Road Bridge #2 Dedication - all agreed that the dedication ceremony went very well. Henderson - rocks from the east side of the bridge washed to the west side and is causing flooding of the yard. We would have to have a dozer go in and move the rocks back up to where they can be removed. The area was clean before the last rainstorm. The question is whether it is necessary to remove the material. Sachar - call Mark Corey or Soil Conservation. Henderson - we could ask DEP also. Discussion. Ireland - ask Corey first and then Soil Conservation or DEP. Falls Road/Francis Road Speed Limit Ordinance #2-00 - Ireland asked why stop signs were included in the Ordinance. Henderson - we have ordinances for some stop signs but not all. The question is whether there is an ordinance in place for PennDOT's stop signs. Mark Corey said probably not. If a prosecutor had to have ammunition, this would cover it. I threw them all in there. We should put up a yield sign at New and Ivoray. You are suppose to use yield signs when you can. You have 500 feet of visibility each direction. Discussion on each type of sign. The book says to use yield when possible. Ireland argued for a stop sign adding that no one stops anyway. Sachar - everyone uses it as a yield sign. Henderson - people will blow through it if they think they can see. Generator - nothing. Gravel Roads Program - nothing. Girard Township Complaint/Gudgeonville Road - proposed letter written by Henderson in response to Girard's letter was reviewed. Ireland moved to send the letter. Sachar seconded. Carried. Pipe Cost Calculation - the under road pipe on Francis east of Brooks is gone on the bottom on the input side. The output side has a 20-foot extension that is good but the center part of the pipe is gone and split through the center. Water is running under the pipe. The job needs 120 feet of pipe. Dave questioned why an 84" squash pipe was used as it has 5 foot of cover. Dave feels that the job is probably too big for the Township crew as it is 10 foot down on one side and 20 foot down on the other side and is all on shale. Dave suggested using two 48" pipes on either side of a 60" pipe. Discussion. Henderson - we should consider doing this in short order. Ireland - why not use two 60" pipes? Henderson - 60" is darn hard to work with. A 42" is hard enough. The road would be closed for a month. We would have to hire a couple of guys and rent a hoe and collapse boxes and boom-mounted tampers. In the meantime, what about the guide-rail? My suggestion is using 2 long posts and a form and back fill for the time being and put up the guide-rail. When we replace the pipe we would take down a couple of lengths of rail. We wouldn't do this for several years. Sachar - how much water can run through there, will we get a hole in it? Henderson - that is exactly what will happen. It's a good thing it's sitting on shale. Sachar - that pipe was put in around 1968. FINANCIAL AND TAXES Bills - discussion on various bills. Henderson moved to approve the bill list for payment totaling $4,974.46 general fund; $2,593.94 state fund, $1,648.00 municipal building fund and $4,000 fire department fund. Sachar seconded. Carried. Payroll - none. Monahan and Monahan/Financial Analysis - Sachar moved to hire M&M to help with a year-end financial analysis. Henderson seconded. Carried. FTVFD Annual Contract - Henderson moved to pay the Fire Dept. their annual contract amount of $4,000. Sachar seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - nothing. Update Comprehensive Plan - nothing. Industrial Park/KOZ - nothing. Buren Subdivision - nothing. VFW Recreation Complex - Ireland reported on a meeting he and Henderson attended at the VFW to discuss a recreational complex. Their grounds committee is interested but first they want to determine the exact location of their buildings before they plan the location of soccer, softball and baseball fields. Henderson will attend a grant-writing seminar and Sachar will attend the REA wastewater treatment meeting. Recreational Complex at Dave's Pond - Dave suggested making an approach to Mr. Strong for a first right of refusal contract. Discussion on Hugh Crandall's letter. Sachar - you'd need someone to run it. We need to make contact with him and discuss it. Henderson will draft a letter to Mr. Strong. Abandoned Gas Wells - nothing new to report. Storage Trailers - nothing new to report. FTVFD/Supporting Volunteer Fire Departments - will attend the Sept. 28th meeting. Recycle Day/Junk Cars - will have to pick up one vehicle with the backhoe as it fell apart. Henderson moved to pay Jim Mischler $150 for pulling out 3 vehicles. Sachar seconded. Carried. Board will ride around after the leaves are gone to look for violations of the junk car ordinance. Walker Subdivision - nothing. SOLICITOR Western Trial/G. Antolik - no word from our Attorney on the final engineering cost tally. Ireland - the letter from Moorhead said Antolik was prepared to pay his bill. Sachar - send a letter to Moorhead saying we are waiting with bated breath for a check. Ireland - the maintenance agreement on the road, was it two years from paving or two years from acceptance? Henderson - we will have to check. There is a difference between accepting it and taking it as a public road. He hasn't met the subdivision ordinance regulations yet, the last thing is paying our engineering fees. When he does, we can send him a letter saying he met the regulations. Then he can come and ask for it to be taken over. Then we'd start the paperwork for it to become a public road. Sachar - the residents will want to see plows up there. Henderson - then we'd better get our act together. Maybe it would be a matter of just pulling all the information together. Sachar - send Attorney Moorhead a letter asking where the money is after we receive the final tally from Attorney Schroeck. Shirley Rickerson, 7766 Crane Road, Conditional Use Request for a Home Occupation - Henderson moved to approve the request for advertising and a hearing on October 10 at 8 p.m. Ireland seconded. Carried. Impact Fee Ordinance - nothing. OLD BUSINESS Lights on for Safety, Census - nothing. NEW BUSINESS None. CORRESPONDENCE Sachar will attend a seminar on Livestock and Poultry Operations. Will ask Hugh Crandall if he would like to attend. Annual ECATO Convention - Henderson and Bernhardt, all day; Ireland and Sachar dinner only. Waiting to hear from the tax collector.
