October 26, 2000 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0810 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland and David Henderson. HEARING: RECREATION GRANT/VFW-0810 HOURS. No one present to make comment. Henderson - if the VFW decides they want to apply for a grant, we should approve it. Right now they are going to do it on their own. Approve the grant but not submit it. Ireland moved to approve the grant application and to continue on with it if the VFW desires. Henderson seconded. Carried. VISITORS/PUBLIC COMMENT No one present. MINUTES Ireland moved to approve the minutes of 10/10/00 as presented. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that we are behind schedule. Larry Pieper has been off work for three weeks with a back injury received at home. Rick and Dave have been pushing hard but need help. General help is needed. Dave Malone was asked but is not interested. We can hire interim help. Two were interviewed this week. Ireland - I don't think Gerry Caldwell is working, you could call him. Discussion on who may be available with a CDL. Henderson - we could get a temporary in here now and if someone else comes along, get them to fill in for Larry. Ireland moved to hire a temporary worker as needed. Sachar seconded. Carried. Henderson - the Oshkosh is ready to go. The box is not crooked, it's the way it's sitting on the truck. I want to take the cab protector off and have it bent down 4 more inches for more door clearance. All agreed to have this done. Crew is getting ready for plowing. The one-ton is almost ready but will have to reduce the flow on the spreader. Sachar - there are several washboards on some of the roads. Will they be graded again? Henderson - yes, if the weather permits. Agility - Ray is finishing mowing for the year. Falls Road Bridge #2 - waiting for the last payment from the State. Generator - nothing. Gravel Road Program - there is a class coming up that Dave will attend so we can apply for a grant. Girard Township/Gudgeonville Road - in their letter to us, Girard Township requested our share of liquid fuels money if they take over Gudgeonville Road. Dave said a point of clarification is needed, are they taking over just the one section of the road or the whole road. A new agreement would need to be drawn up. Discussion on the money lost for the next 10 years if we give up our share of liquid fuels money. Discussion on the value of that money for the next 10 years. Ireland - find out if they want the whole road or just the one section. Let them take the whole thing if they will. Sachar - maybe they'll pave the whole thing. Henderson - there are three points that need clarified: 1. what section or sections are they talking about, 2. what are they talking about, per capita or mileage, 3. are they talking about tar and chipping the entire length. Sachar - does it matter to us if they tar and chip the whole thing? If they take it over, it's their business. Ireland - ask all the questions at once. Attorney Felicia Schroeck arrived at 0835 hours. FINANCIAL AND TAXES Bills - Sachar moved to pay the bills as listed totaling $5,641.50 general fund; $2,521.16 equipment fund; $193.60 municipal building fund. Ireland seconded. Carried. Payroll - Sachar moved to approve payrolls #21-00 and #22-00 as presented. Ireland seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, VFW/Recreation Grant, Dave's Pond/Recreation Area, Abandoned Gas Wells - nothing. Buren Update - Mrs. Buren applied for a building permit for the newer mobile home as a replacement for the existing mobile home used as a school that was removed. She signed a statement on the application that the mobile home would not be used as a residence. Henderson - as long as there is only one residence on the property they are allowed to have other outbuildings. Storage Trailers - Ireland stated that we should charge a yearly fee even if the trailer is in on a temporary permit. SOLICITOR Western Trail/G. Antolik - Felicia Schroeck reported that Attorney Moorhead asked if the money owed for our engineering fees can come from the bond money held in escrow. Ireland - then there is no money if the road needs repairs. Would we need to go back to court? Schroeck - he'd have to sign an agreement that he agrees to forfeit a portion of his bond money. I don't think we'd need to go back to court. Moorhead says the paving occurred on November 9, 1998. Discussion on the cul-de-sac. Ireland left the meeting at 0845 hours. Henderson moved to have an inspection of the road done by our engineer before we agree to anything. Sachar seconded. Carried. Henderson moved to direct the Solicitor to prepare the necessary documents to have Western Trail taken over as a Township road. Sachar seconded. Carried. Ms. Schroeck will call Attorney Moorhead and inform him of the engineer's inspection. Schroeck - he has a whole year yet. I'll let Moorhead know that he hasn't met all the requirements so we can't release the bond money yet. Sachar - Mr. Antolik never came to the Planning Commission with his plans for an extension of the road. Impact Fee Ordinance - nothing. OLD BUSINESS Lights on for Safety - nothing. November Meeting Schedule - budget meetings are November 13 and 15. Last meeting of the month is November 30th. Will pass a tentative budget on the 15th and advertise so that final budget can be passed on December 12th. NEW BUSINESS Conditional Use for Cousins Property on West Stancliff - the property was given a conditional use not the property owner for a home occupation. The property has a new owner. Sachar - I would think the conditional use stays with the property. Henderson - I don't want the future owners thinking they can operate the storage buildings as a business and/or expand without coming back to us. I think he needs another conditional use. Can we declare a new one for the new owner? Nothing else can be added without a conditional use. Normally a conditional use is null and void when ownership changes. Henderson moved to direct the Zoning Officer to send the new owners a letter. Sachar seconded. Carried. Letter to OTM/Burning - a complaint was received from a neighbor of OTM about their burning and trash from the burning blowing into their field. Dave suggested that she call the District Justice and file a complaint. When she did, she was told that it wasn't within the Justice's jurisdiction. Henderson - it would be good to know exactly what DEP and the State's regulations are on burning and litter. The Zoning Officer was authorized to send OTM a letter after Henderson and Sachar have a chance to read and approve it. Veteran's Day Ceremony - the Chairman of the Board was requested to speak at the ceremony on November 11 at 11 a.m. Bill Westerburg Dinner - all have previous commitments. CORRESPONDENCE Reviewed.
