December 28, 2000 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar with the Pledge of Allegiance at 0813 hours. Present were Sachar, Denver Ireland and David Henderson. VISITORS/PUBLIC COMMENT No one was present. REPORTS Superintendent - Dave reported that the crew has been doing a lot of snowplowing, most of the time, twice a day. Ireland - advise the drivers not to swing wide around corners, they are leaving snow. Pull right up to the stop sign. Sachar - the west side is pushed back good. Intersections could be pushed back a little more. Mager Tree Report, Agility, Generator, Gravel Roads Program, Girard Road Agreement/Gudgeonville Road - nothing on any of these items. FINANCIAL AND TAXES Bills - discussion on various bills. Henderson moved to pay the bills as listed totaling $4,988.79 general fund; $1,127.00 fire department fund; holding Northshore Insurance Agency, Trustees Insurance Fund, Welka's Disposal and Better Roads magazine until their due dates in January. Ireland seconded. Sachar abstained from item #14, Keystone Diesel Engine because of a possible conflict of interest. Carried. Payroll - Sachar moved to approve payroll #26-00 as presented. Henderson seconded. Carried. Adjust TAN Amount to Cover Additional Snowplowing Expenses - Dave said that the TAN expenses for January and February need to be raised by $10,00 each month to reflect snowplowing expense which increases our deficit. We have to show no cash carry forward into next year. It shows that we have a significant cash deficit. By the time we get to March we'll be $73,000 in the hole. Ireland - in the past we haven't used $25,000 of the TAN. Henderson - yes we have. It all depends on the cash carry-over. Any extra expense comes out of the summer road program. Do you disagree with that Denver? Where else can the money come from? Ireland - you have 4 « people working. Sachar - if the Farmer's Almanac is correct, you won't need to plow in February and March. Henderson - if we don't use the money, we can pay it back on the loan or we can keep it in the bank in a C.D. At minimum we need $73,000. I think we should ask for $80,000. Sachar - we have to pay for trucking of the cinders yet. Henderson - yes and anti-skid. Sachar - that pile would never fit into the proposed new building. Girard's pile keeps growing also. Henderson - we could store the cinders in the building and anti-skid outside and mix it on the fly. Henderson moved to change the TAN amount requested to $80,000. Ireland seconded. Carried. Ireland - we need to save more money. Henderson - a lot of people are plowing snow across the road, how do you want me to handle it? Sachar - send them a letter of warning and if it continues, fine them. It's a violation of state law. If we have to use a hi-lift to move their pile, we will charge them $250. That is pretty close to the going rate for a hi-lift. Henderson - I can have Ray or Gerry take a clipboard and note the violators. We could do a newsletter. Sachar - notification needs to be out within the next few weeks. A letter to just the violators is faster and less expensive. Let them know they are creating a hazard for our plow drivers. Tell them that they must remove their pile and that if we have to remove it that we will charge them. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Review Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, Buren Update, Abandoned Gas Wells, Storage Trailers - nothing on any of these items. SOLICITOR Impact Fee Ordinance - nothing. Brine Co-Product Determination - Dave reported that we should have the brine test results back tomorrow. DEP said it would take them just several days to make their determination. Our Attorney could hurry that along. On the conference call last Monday, the northwest office of DEP said they inherited the problem. It wasn't of their making. The compromise position was to take a composite sample to be used for the co-product determination. We took six samples and sent them to the lab for them to blend. The lab said they couldn't do a ph and oil and grease test in a blended manner. They could do six oil and grease and ph tests and mathematically combine them. I don't know how many tests we will be charged for. Discussion on how the samples were taken. Ireland - if the brine is considered a co-product, what happens next? Henderson - we've already declared it a co-product and it's up to DEP to agree with us. We could spread now but I feel it is wisest to let them make their determination first. I explained all this to PennDOT. Jim Cooper, our Municipal Services rep has also been keeping PennDOT informed. As soon as we get the okay from DEP then we can start plowing again. Hopefully it will be resolved by the end of next week. Ireland - what happens if DEP says no? Henderson - we're stuck. If the material is a pollutant, we won't want to spread it anyway and we'd be out of plowing State roads. Why buy a product to spread, it's not cost effective. Sachar - do they have a bare-road policy? Henderson - there is a maintenance guide on how to plow their roads per road class. To PennDOT those roads are Class D and E roads. Sachar - we classify them as Class A roads. Henderson - that's why they like these contracts. Jim Cooper says if they keep plowing they will have to add a truck. They haven't done that yet. If we can't brine, we'd have to dedicate a truck to just those roads for spreading salt. We can't use salt on our roads. They've been spreading salt on Mitchell Hill and they told us not to. Sachar - why salt the whole road? Dave answered that PennDOT does on all their roads. Ireland - PennDOT needs to get the snow off the bridge over I-79 on Old State. Henderson - they have been hitting a lot of mailboxes. Oshkosh Registration - Dave reported that Jim Cooper from PennDOT is helping us with the problem. The Dept. of Transportation is in the process of trying to determine if it fits the description of special mobile equipment. Cooper let them know that we are not going to back off of this. OLD BUSINESS Lights on for Safety - nothing. NEW BUSINESS None. Western Trail/G. Antolik - there has been no response from our letter to Mr. Antolik but we did receive a copy of a letter to our Attorney from his Attorney asking about using the road bond for payment of the engineering bill. Ireland - the way I read the letter, Moorhead says Antolik has to ask us to release the bond. Henderson - they did that in a letter. The problem is what to do with the road deficiencies and does he want us to take it over. He implies but doesn't say he wants us to do it. Sachar - a landscaper would charge $1,200 to $1,500 to fix the north side berm, maybe $500 to fix the paving, it would take all of the bond and a little more to fix the three deficiencies and pay the engineering bill. Henderson - it could cost less if he did the work. We'll have Mark Corey work up a plan and we'll put an estimate of cost on it. Sachar - we still don't have a definitive letter on us taking it over.
