February 13, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2003 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson and Gary Truitt. VISITORS/PUBLIC COMMENT No comments. MINUTES Henderson moved to approve the minutes of 1/25/01 as presented. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that we had a windstorm with 50 mph winds that brought down two trees. We've had a little snow and some ice. The clunking in the Oshkosh was the locker in the transfer case. The parts were rebuilt and have been installed today. We are waiting for a few other parts and the truck should be back in service by the end of the week. Ireland - was there any erosion from the melt down? Henderson - just minor, one is by John's house on Ivoray. Ireland - call the State and let them know that the berm on West Stancliff west of Bortzer's and east of Cousins' on the south side is nearly gone. Dave reported that he is working with Jim Cooper, PennDOT municipal services rep. on making application for the Bridge Safety Award. Mager Tree Report, Agility - nothing to report. Generator - it's in running order but no word from the repair specialist. Gravel and Dirt Road Program - Dave will attend a training session on April 3 and 4 in Waterford. After the training we can apply for a grant. The State will cost out the job. If we do some of the work in-kind, the money will go further. They are treating it like emergency repair funds. Girard Township Boundary Road Agreement/Gudgeonville Road - their meeting is tonight. New Refrigerator for Office - our old refrigerator quit working. Will get a small « size one to put under the microwave. No objections voiced. Sale of International Cab and Chassis - we may have a buyer. Will package it up so it can be towed to Sherman, NY. We have roughly $4,000 in the motor and $500 in painting the frame. Sachar - you can get $4,500 in just the engine. Offer it for $5,000. Henderson - we should be able to get $5,000 out of it. The buyer may go for $5,000 but not $5,500. He has a farmer who wants it for a field truck. We will have to bid it, it's over the limit. Henderson moved to advertise for bids for the International truck cab, chassis and motor. Ireland seconded. Carried. Crane Road Sign - the overhead sign for Crane Road was lost in the windstorm. Will get a new one. FINANCIAL AND TAXES Bills - discussion on various bills. Henderson moved to pay the bills as listed totaling $5,114.92. Sachar seconded. Ireland abstained from voting on #6, Creations by Barb. Carried. Payroll - Henderson moved to approve payroll #3-01 and #4-01 as presented. Sachar seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - minutes were reviewed. Update Comprehensive Plan - Dave reported that he talked with Joyce Berry and they will start working on rewriting the plan soon. Industrial Park/KOZ - Dave said that he talked with Rick Novotny about the 3- year extension. Novotny said that our individual KOZ is not eligible unless all of the sub-zones go along with it. Some of the KOZ in the Corry area was developed and the school district there won't go along with loosing out on 3 years of taxes. We will switch our KOZ to the West County zone. None of it has been developed. Will ask General McLane School District if they will agree to the extension. Henderson will proceed with this plan. Buren Subdivision Update - discussion on there being no record of a school located on their property on Gudgeonville Road. The school district office was told by the State that she is no longer eligible to have a school because of her prison record. There has been nothing filed with the school district concerning their operating a school at that location, yearly filing is required by law. Mrs. Buren applied for a building permit for a mobile home to be used as a school. The permit was issued for use as a school only, not to be used as a residence. Henderson - if she wants to keep one trailer, she must remove the second one and subdivide. Send a letter that they no longer have a school and no longer have that exemption. Give her until June 30th to subdivide. She can keep the school trailer as a residence only if she subdivides. Her daughter can have her lot and trailer. Each must have it's own lot. Sachar - I can see the old house being used as a barn or storage. It and the daughter's trailer can be one parcel. Henderson - mobile homes are not allowed to be used as storage. The second trailer cannot be used as barn or storage and can not remain on site unless it has it's own parcel. Sachar - the letter should state that we are revoking her permit for the mobile home used as a school because she does not have a school. By law if she wants to use the mobile home as a residence, she must subdivide. The second trailer must leave because it cannot be used for the stated usage. If she subdivides a third lot, she can put it there. Sachar moved to send the Buren's a letter saying that according to our Ordinance, the second trailer cannot be used as a barn/storage. Send her permit fee back. If she subdivides, she can keep the second trailer on a parcel of it's own. Ireland seconded. Carried. Abandoned Gas Wells, Storage Trailers - nothing. ORDINANCE #1-01 Agricultural Uses, Animal Density/Amendment to the Zoning Ordinance Dave said that the Board needs to brainstorm this issue before the ordinance is advertised. Discussion on animal units and the way the ordinance is written. Henderson - animals are not allowed to wander through creeks and streams anymore but that is an issue for Soil Conservation. Will review the ordinance further. ORDINANCE #2-01 Snow Emergency Parking and Snow Removal Ordinance Henderson - this is a standard ordinance from PSATS. Every place that I know of that has fire hydrants; the property owner is responsible for keeping it plowed. Ireland - I can see city hydrants but I can't move that much snow. Henderson - if someone doesn't clean it out, we will but we just don't have the time during heavy snowfalls. Sachar - it sticks in your craw, you allow a hydrant to be put in your pond and then get fined if you don't clean it out. Sounds like a Gestapo tactic. Henderson - by next year when we put in several more hydrants, the Fire Department should be able to file for a lower fire classification that will reduce fire insurance rates by 40%. We currently have 12 hydrants. It takes one man all day to clear them all. Sachar - establish a procedure for the fire department to do it. Henderson - the problem is time. When you need it cleared is when we're the busiest. Drop section 4 and approve it for advertising. Sachar - I don't think we have a sense of the importance of these hydrants. Maybe it should be a shared burden. The surrounding neighbors could take a turn at keeping it cleared. Approve Ordinance #2-01 for advertising but drop Section 4. A section on maintenance may need to be added. Discussion on legalities. Sachar moved to advertise Ordinance #2-01. Ireland seconded. Carried. SOLICITOR Western Trail/G. Antolik, Impact Fee Ordinance - nothing. Brine Co-Product Determination - we retested 7 wells, no results yet. Oshkosh Registration - the State is still thinking about it. OLD BUSINESS Lights on for Safety - nothing. Recycle Day June 23rd - Dave Anthony from Washington Township wants to do a combined program with us. Discussion on mosquitoes, the number of swamps in the Township and on spraying. Ireland - a combined program will be a lot more of everything. Henderson - another problem is how to divide up grant funds, etc. If we could make both programs work together it might be feasible but they don't have any curbside recycling. Discussion. Dave will invite Dave Anthony to our next meeting February 25th. NEW BUSINESS COG Meeting March 7th/GPU-First Energy Acquisition & Building Inspection System - Dave and John will attend, Denver will arrive as soon as possible. Discussion was held on the cost of electrical power. Henderson - we could easily be in the same situation as California except that Pennsylvania is an exporter of energy. They want everything in place when the statewide building code comes into effect in 2002. CORRESPONDENCE ECATO Schools - Denver will attend one session. Will send the information to the Planning Commission. Growing Smarter Conference March 18-20 in Hershey - will ask if one of the Planning Commission members wants to attend and bring back the knowledge to help in the rewrite of our ordinances.
