February 22, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0801 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, and David Henderson. Members of the public present were, Erie Kicher, DEP; Linda King and Neil Bullock, REA; Gary Truitt and his son; PSP Cpl R Rupp; Ray Nutter, Microbac Labs; local residents Terry Rea, Andrew and Ella Buren; Matt Tighe, a local on-lot sewage system installer; and Mary Holt from BTN. VISITORS/PUBLIC COMMENT REA Wastewater Program - Ms. King presented the supervisors with a Summary of Sewage Management Program that includes steps necessary for implementation by REA and the Township. A one hour and twenty minute lively and productive discussion was held on all the ramifications of sewage management and the lack of maintenance on current township systems. Mr. Rea, who is a REALTORr, estimated as much as 50 percent of houses he sells fail the mortgaging bank's required sewage system check. It was noted that with the interest from a performance bond applied to the monthly cost and with the reimbursement from DEP applied to the monthly cost, the range of monthly costs to the property owner would be from $5 to $6. Further discussions will be held. Solicitor George Schroeck arrived about 0820 hours. MINUTES Henderson moved to approve the minutes of 2/13/01 as presented. Ireland seconded. Carried. REPORTS Superintendent - Henderson reported that we have caught up on our maintenance. We've had a little snow and some ice. The clunking in the Oshkosh was the locker in the transfer case, which is now repaired. A copy of the Bridge Safety Award submission was given to the Supervisors. The original will be given to Jim Cooper, PennDOT municipal services rep. on Monday. Mager Tree Report, Agility - nothing to report. Generator - nothing to report. Gravel and Dirt Road Program - nothing to report. Girard Township Boundary Road Agreement/Gudgeonville Road - The Solicitor presented a modified agreement with the changes suggested by Girard Township. It was noted that the termination clause would require that the two Townships mutually agree on a termination. This would essentially mean that they would have to agree on another or different agreement to dissolve this one. Henderson moved to accept the Boundary Road Agreement with changes and forward it to Girard Township for their signatures. Seconded by Ireland. Carried. The Secretary will attest the agreement and forward it with a copy of the PennDOT Township Road Map to Girard Township. All visitors left except the Burens and the Truitts. County 2001 Liquid Fuels Aid Application-The Supervisors signed the application that was previously approved at the Jan 25th meeting. Sale of International Cab and Chassis - nothing to report. The Roadmaster's report was suspended to hear from the Buren's. Buren Update - Ella Buren forcefully and with colorful language expressed her opinion that the Supervisors were harassing her and Andrew and using Nazi-like tactics to run their lives. She contends that there is still a legal school there, for which she was given a permit to have a second trailer on the parcel years ago, and we need to check with the State Department of Education who will verify that they still have a school. She and Andrew believe that they should not be forced to subdivide their property because it was in three lots before and through no fault of theirs it was made into one parcel. She indicated that her solution to stop this harassing treatment would be to regularly hold Ku Klux Klan rallies on her property. Following about ten minutes of expressive invectives, the Solicitor pointed out that he had researched the deeds and the single lot could not be returned to the original three parcels because of the other lots divided off them. The Solicitor noted that there are only two solutions-a complete survey or a knowledgeable person who could write a meets and bounds description of the original parcels taking into consideration the divisions that have occurred since the combination. He suggested that she use her nephew, John Lovin, to straighten out this problem. The Buren's left. Bids for gravel purchase and trucking - Ireland moved to authorized advertising for the purchase of gravel and for trucking gravel for the summer road graveling on Silverthorn between Old State and Crane and Eureka between New and Old State. Sachar seconded. Carried. FINANCIAL AND TAXES Bills - discussion on various bills. Sachar moved to pay the bills as listed totaling $13,150.81. Sachar seconded. Carried. Payroll - No payrolls were presented for approval at this meeting. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - none. Update Comprehensive Plan - nothing to report. Industrial Park/KOZ - nothing to report. Buren Subdivision Update - see the above visitors' section. Storage Trailers - nothing to report. Abandoned Gas Wells - Henderson reported that he has learned that a company called Gas Production and Services Consultants in Erie plans to buy the wells tomorrow. We can contact them soon and see what their plans are. Ordinance #1-01--Snow Emergency Parking and Snow Removal Ordinance Henderson noted that he had renumbered the Ordinances making this Ordinance No. 1 of 2001 because it will move forward quickly while the Agricultural Use Ordinance may take significantly more time. The Ordinance will have a public hearing at the March 13th meeting. SOLICITOR Western Trail/G. Antolik - The Solicitor reports that Attorney Moorhead has not been able to contact Antolik regarding using the balance of the escrow to make the repairs to the road. The Solicitor recommends this course of action if Antolik approves it. Impact Fee Ordinance - nothing. Brine Co-Product Determination - the well tests did not prove that the tank tests were wrong. Henderson recommended that the Supervisors reevaluate the snowplowing contract with the state immediately following the snow season. With figures available on this season, a comparison can be made that will reveal the true costs of plowing the state roads. Oshkosh Registration - A letter was received from PennDOT deigning the Township's request to register the Oshkosh as special mobile equipment. PennDOT contends that the Oshkosh is not a snowplow. The Supervisors, who thought they knew what a snowplow was, are now confused on what a snowplow is. The Solicitor and Henderson are to confer and create a reply letter and in the letter PennDOT will be requested to define a snowplow. It was also suggested that PSATS be contacted to seek their help regarding this issue. OLD BUSINESS Lights on for Safety - nothing. Recycle Day June 23rd - Dave Anthony, Manager of Washington Township, will be at the March 29th meeting to discuss cooperating on recycling. Additionally, some discussion was held on the boundary line road agreement with Washington Township. Mr. Anthony will be asked if Washington Township might consider an agreement similar to the one just approved with Girard Township. NEW BUSINESS COG Meeting March 7th/GPU-First Energy Acquisition & Building Inspection System - The meeting will be held March 7th with all three Supervisors attending. Ireland may be a little late. CORRESPONDENCE Firemen's Dinner Reservations - All three Supervisors will be attending the Fireman's Dinner, March 29th. Two fire department personnel are to be invited.
