March 13, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2008 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Andrew and Ella Buren, Jim Sherlock, Gary Truitt and Bill and Joy Greco. HEARING: ORDINANCE #1-01, EMERGENCY PARKING AND SNOW REMOVAL-2009 HOURS Henderson reviewed Ordinance #1-01, an ordinance regulating the parking of vehicles during periods of snowfall; prohibiting the dumping, shoveling, pushing or placement of any snow, ice, slush or water into the road rights-of-way within Franklin Township; and proscribing penalties for violation. E. Buren - the Township fills in driveways when they plow, you have to park your car on the road while you clean out your driveway. What about hunters? Ireland - this ordinance is if you leave the car set there for long periods of time. How are we handling fines? Sachar - that's a standard fee, it's up to the District Justice. Henderson - we as a Board determine the charge and authorize going to the D.J. and pay filing fees. The D.J. determines guilt. We don't have the right to issue a ticket. With no other comments, Sachar adjourned the hearing at 2012 hours. VISITORS/PUBLIC COMMENT E. Buren questioned the status of the proposed animal density ordinance. Henderson said that it has been referred back to the Planning Commission. MINUTES Henderson moved to approve the minutes of 2/22/01 as presented. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that we had an additional 18 inches of snow last week. Ditching stopped for now. Will take it back up as soon as possible. The roads are getting soft, we'll hope for the best this spring. E. Buren - when will we get gravel instead of slop? Clair Wright is muddy. Ireland - you live in the country, you expect it in the spring. Mager Tree Report - nothing to report. Agility - Dave reported that he had a discussion with the Agility Superintendent. We will have the same program this year as last, three rounds of mowing and brushing on the state roads. There is the possibility of doing three tail ditches on Old State; one is by Kruger's. Any difference, we'll bank to our credit. Ireland - what is on their agenda? Henderson - we could do some of their signs if we wanted, maybe litter removal. Ireland - if we don't do winter maintenance, can we do something else? Sachar - agility isn't the same program as winter maintenance. Wait until we get the final figures on snow removal for this winter. Generator - nothing to report. Gravel Road Program - training session April 4th and 5th. Girard Township/Boundary Road Agreement on Gudgeonville - their meeting is tonight. International Cab and Chassis - Dave suggested advertising in the Truck Trader. It would be at least a month before the ad would appear. Denver asked if it would be advertised as a group and unassembled. John suggested putting an ad in the local paper with the bid opening way out to take into consideration the Truck Trader ad time frame. Gravel and Trucking Bids - will wait to see what spring does to the roads. ESTA - Dave reported that the Northwest Technical Institute, the parent company of ESTA, is reorganizing themselves with the Dept. of Labor. The Township wanted to be assured that the property that we leased to ESTA remains ours and will not be involved in any legal problems. The County retains ownership of the facilities and we retain the land and can reclaim it back. Our property won't be involved in a bankruptcy. Joy Greco - the County hasn't discussed that part. ESTA is working to get hooked up with a community college and be operated as a satellite. Nothing is final yet. I agree with your Solicitor, the land is yours. Discussion on the history of ESTA. The County provided the seed money to get started. ESTA was reorganized under Northwest Technical Institute and is reorganizing again but not as fire training. The County owns the buildings and half of the property. The leased part of Township property is mostly parking and the retention pond etc. FINANCIAL AND TAXES Bills - discussion on various bills. Sachar moved to pay the bills as listed totaling $7,919.74 general fund. Henderson seconded. Carried. Payroll - Sachar moved to approve payroll #5-01 as presented. Henderson seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - no quorum for their March meeting. Update Comprehensive Plan - will meet with Joyce Berry next week to start the rewrite. Industrial Park/KOZ - nothing to report. Buren Update - nothing to report. Abandoned Gas Wells - Dave said that he talked with Matt Duckett of Gas Production and Service Consultants, the new owners of the field. They want to get production back up on the wells. G. Truitt - do I have to continue to be on their line? I don't want them on my property. Henderson - talk to your attorney. There are two parts to the field, east of Eureka Road and west of Eureka to Ivoray. The leases should be recorded at the Courthouse. The question is the validity of the leases. The new company is based in Erie. J. Sherlock - this is all market driven. Storage Trailers - nothing to report. Ordinance #1-01, Emergency Parking and Snow Removal - Henderson moved to adopt Ordinance #1-01 as presented. Ireland seconded. Carried. Ordinance #2-01, Animal Density - has been referred back to the Planning Commission. Their next meeting is April 3rd at 7 p.m. SOLICITOR Western Trail/G. Antolik - nothing new to report. Impact Fee Ordinance - nothing to report. Oshkosh Registration - Donna Mindek will take up the issue with the PSATS Executive Board. OLD BUSINESS Lights on for Safety - nothing to report. Recycle Day, June 23rd - Dave said that there is the possibility that we can hold the recycle day and not be granted retroactive reimbursement when we apply for a new grant. All agreed to continue on with this year's recycle day. We will be committed to hold it once the first newsletter goes out. NEW BUSINESS COG Meeting/GPU-First Energy Acquisition and Building Inspection System - Dave reported on the meeting. The end result is First Energy will acquire GPU if approved by the PUC. Gas and electric payments will be paid separately depending on market prices that are sure to rise and fall. The two companies are about equal in size. First Energy is a composite, a generation and transmission company combined. They will still have to buy power on the open market. Discussion. Northwestern RECA is generating their own power for their own benefit and are customer owned. A. Buren - they have a good racket going. Sherlock - this is all on hold for review. Our energy doesn't have to stay here. They can market it to California and tell us that they're short on power. That's why it's under review. Discussion on de-regulation. Henderson - you can be sure that electric prices won't go down. Edinboro Triathlon, June 2, 2001 - Henderson moved to approve the Triathlon's use of Township roads and to issue a letter to that effect when we receive their insurance certificate. Sachar seconded. Carried. Cancel PennDOT Winter Maintenance Agreement - Dave stated that we have to cancel the present agreement and sign a new one. RESOLUTION #1- 01 BE IT RESOLVED, by authority of the Board of Supervisors of Franklin Township, Erie County, and it is hereby resolved by authority of the same, that the Chairman of the Board of said Municipality be authorized and directed to sign the Agreement on its behalf. Resolution #1-01 adopted this 13th day of March 2001. Henderson moved to authorize the Chairman to sign the form. Ireland seconded. Carried. State-Wide Building Code - discussion. Mrs. Buren asked if the Amish wouldn't be allowed to come into this County with the Code requirements. All agreed that that was a good question. E. Buren - in the minutes of 2/22/01, I never said I'd hold regular KKK rallies. I said "how would you like to have them here". My trailer is for a church and school.
