March 29, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Vice Chairman Denver Ireland at 0807 with the Pledge of Allegiance. Present were Ireland, David Henderson, Gary Truitt and son, Lieutenant James Breth, PSP, Reporters Tim Hahn and Mary Holt, Dave and Deborah Anthony representing Washington Township. John Sachar was out of town on business. VISITORS/PUBLIC COMMENT Lieutenant Breth, Troop E, Erie Headquarters introduced himself and asked if we had any complaints. This was a courtesy visit. Dave Anthony, Washington Township - I'm pleased with your Recycle Day. Is there an opportunity for Washington Township to piggyback with your program? You have a good site. If so, I will present a draft copy of your garbage ordinance to Council and try to get curbside recycling started in Washington Township. Ireland - it's a good program. Henderson - to work together, both programs would have to coordinate. The problem is if we hold a joint recycle day here, your people may not want to come here. We could alternate it each year. You have space at your facility. Anthony - I don't think there would be a problem with them coming here. We'll be glad to assist with personnel. Henderson - the first year you will have a flush of items. Each year gets a little less. Anthony - I would like approval to combine and use your information on recycling in our newsletter. Can we recycle this year with your day? Sharing any income coming in is not a concern. We are not looking for a free ride. Henderson - who shares the loss, is most important. We can combine and share pro-rata. You could start curbside recycling and get that program up and running this year and do a recycle day next year. The first year we collected regular recyclables and that was a mistake. Do the regular recyclables curbside so you avoid them at a recycle day. Discussion. Anthony - don't you think there is a chance to be involved this year? Henderson - I'm not saying that, we need to work out the logistics. You don't have a grant and we are between grants. DEP may not retroactively allow this year's expenses. There is no priority ranking for the grants. Discussion on keeping separate statistics. Ireland - split the costs right down the middle and start a curbside program. Anthony - a 50/50 split is fair. But you have more of the burden because it's your site and I don't want it to be a burden. Ireland moved to hold a joint recycle day venture with Washington Township for June 23rd for those items listed in the recycle flyer and if appropriate file a joint grant application and split the costs and tonnage 50/50. Henderson seconded. Carried. Anthony - I have a concern with Ordinance #2-01 on animal density. We moved to Franklin Township because we like the rural characteristics. We raise show dogs. We do not operate as a traditional kennel and we do not breed as a puppy mill. We have 9 dogs and a litter due any day. Our dogs do not stay outside. My dogs are fenced in. In fact my neighbors dogs come over to bother mine. I feel that we are being punished and I don't feel that this ordinance is fair to me. Ireland - right now we have no ordinance to regulate the number of animals allowed. Henderson - what is not being discussed, you could be in compliance and have a litter and instantly be over the limit. Anthony - you could just add the wording "adult animals". Henderson - draft a letter to the Planning Commission with your concerns. It would help them in their revision of the first draft. Discussion on the State's "Best Management Practices". Henderson - we are waiting for the State to send us a letter on regulations at the state level on animal density. The perceived problem is with 2-acre lots. A person coming from the city perceives that they can raise any number of animals on that amount of land. Anthony - concerning Washington Township's maintenance agreement with Franklin Township on Fry Road, Franklin maintains between Crane and Old State and plows from the Washington Township line south to Zessinger. Washington Township does the summer maintenance on this section. Washington maintains from Zessinger south to Old State and from Crane south to the boundary line and on into Washington Township. Henderson - we would turn over the whole road and give you the liquid fuels allotment for it. That would amount to $4,050.55, state ($3,654.56) and county ($395.99) liquid fuels. Ireland - Girard wanted all of Gudgeonville and we gave it to them. If we turned Fry over to you, it may be able to be paved. We can't afford to pave it. Anthony - we would oil it first to secure the base and then put it on the paving list. It would be 4 or 5 years before it would be paved. It is sparsely populated. Henderson - but it is used as a through road to get to I-79. When you get the chance, you'd pave it. If you are trying to get a block grant to pave Zessinger, you could come around the corner and get Fry. Discussion. Anthony - would you just rescind the old agreement? We have a tough time finding places to spend block grant money other than on housing. Mr. and Mrs. Anthony left the meeting at 0837 hours. MINUTES No action on the minutes of 3/13/01. Will wait until next meeting when John Sachar will be in attendance. REPORTS Superintendent - Dave reported that we had another blast of snow. In the course of plowing, we did damage to the roads where they are soft. The grader was used as much as possible but it broke down on Fry Road. The next two weeks should tell the story on how much frost damage occurs. We need drying weather to get the planes on them. A pounding rain would help but we're not expected to get it. We're right on the verge of major problems. Discussion on the type of material to use in bad spots. The crew is out attempting to protect our roads; 10-ton weight limit signs are up. We are trying to catch heavy trucks transiting Fry and the milk tanker going to Olsavsky's. It should be coming in from the south end. Fry is posted 6-tons. We were doing well on ditching until the snow stopped it. Most of the west side is done. We have had 240.8 inches of snow this year. Ireland - is this the first year to have someone sit on Fry? Henderson - no, Fry is convenient to use as a shortcut. All the roads are posted 10-ton also Old State and Crane. Fry is 6-ton. People have no consideration for the damage they do on our roads. We may move to Silverthorn tomorrow. Mager Tree Report, Agility, Generator Repair, Bids for Trucking and Gravel - nothing to report. Gravel and Dirt Roads Program - Dave and Rick will attend a training session on April 4th and 5th in Waterford. Sale of International Cab and Chassis - Dave will get with John on the placement of an ad. FINANCIAL AND TAXES Payroll - Henderson moved to approve payroll #6-01 and #7-01 as presented. Ireland seconded. Carried. Bills - discussion on various bills. Henderson moved to approve the bill list as presented totaling $8,175.22 general fund, $510.00 fire dept. fund. Ireland seconded. Carried. Authorize Liquid Fuels Payment to Girard Twp. for Gudgeonville Rd. - Ireland moved to pay Girard Twp. for the Gudgeonville Road agreement for 2001 and each year thereafter until further notice. Henderson seconded. Carried. Warrant Tax Collector - Henderson moved to warrant the Tax Collector for $77,927.46. Ireland seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - residents in attendance but no quorum. Update Comprehensive Plan - working on it. Industrial Park/KOZ, Storage Trailers - nothing. Buren Update - they have until June 30th to comply. Gary Truitt - my neighbor has a camper trailer hooked into the mobile home's septic system. Henderson - Mrs. Buren wanted to change the use of the trailer on her property. Ireland moved to send Irvin Keener, 11066 Eureka Road, a letter concerning two trailers on one parcel of land. Henderson seconded. Carried. Ordinance #2-01, Animal Density - see visitor section. County Reassessment - Ireland and Henderson attended a Reassessment meeting Wednesday night. They were told where we are in the process. In the next 3 weeks everyone will get a data verification letter. It will tell the property owner what the data collector found in their house and on their property. The property owner can make corrections. After that the assessment values on all parcels will be created in late 2001. Notice will be given of the assessed value. Then the property owner can have an informal review of the assessment in late 2001, early 2002. After the informal review there is a formal review in the summer of 2002 and then a final certification in November of 2002. In 2003 assessment bills will have the new assessed amount. OLD BUSINESS Lights on for Safety - nothing. Recycle Day, June 23rd. - see visitor section. Edinboro Triathlon, June 2nd - nothing new to report. NEW BUSINESS Washington Township Maintenance Agreement for Fry Road - see visitor section. West County Comm. Center/Grape Vines - Dave reported that all municipalities involved with West County are being asked to help remove the grape vineyard on the property. Ireland - we need a vote on it. Henderson moved to authorize Franklin Township to participate in the removal of the grape vines on the West County Communications Center property. Ireland seconded. Carried. Ireland - how much total time? Henderson - it may be several days. That has not been determined yet. They need two or three crews with backhoes and graders. Thank You To-- Greene Township, PennDOT for Falls Road Bridge #1 - a thank you letter will be sent to Greene Township and PennDOT for cooperating and reorganizing their schedules so Falls Road Bridge #1 design phase could be moved into the first period of the 12-year Transportation Plan. Falls #1 will be moved up and their projects will be rescheduled to a latter date. Henderson - the bridge design is the State 80% - Township 20% split. Ireland - we need a vote on whether to move the bridge design up. Henderson - we had already asked Mark Corey to do that and this is the result of that determination. Henderson moved to move Falls Road Bridge #1 up to the first 4-year period of the 12-Year Transportation Plan and to send thank you letters to Greene Township and PennDOT. Ireland seconded. Carried. CORRESPONDENCE Upcoming training sessions were reviewed. ECATO Fireman's Dinner is tonight. Letter on Civil Justice Reform - Henderson moved to send a letter on lawsuit reform to the Governor. Ireland seconded. Carried. SOLICITOR Western Trail/G. Antolik - nothing. Impact Fee Ordinance - nothing. Oshkosh Registration - nothing. ADJOURN Ireland called the meeting adjourned at 0927 hours. Addendum to Minutes - Attorney George Schroeck arrived at 0930 hours after the meeting was adjourned. At the Supervisors request Attorney Schroeck called Attorney Doug Moorhead concerning the status of Western Trail. Attorney Moorhead said that George Antolik was leaving for Texas and would be back on Friday, April 6, 2001. Mr. Moorhead said he was aware that the Township would like to take over the road and he has discussed it with Mr. Antolik.
