April 10, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2000 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Jim Carver, John and Kim Kosaniak, Gary Truitt and George Antolik. VISITORS/PUBLIC COMMENT John Kosaniak presented a request for an expansion of his conditional use for a home occupation. He would like to put a 30'x30' addition on his existing garage. Henderson - all we have to do tonight is to set up a hearing date. Kosaniak - why do you need to hold a hearing? All I want is an addition to my garage. Henderson - state law requires it. Everyone has to have due process under the law for a conditional use. Every conditional use has to have a hearing. Sachar - you're asking for a modification of a conditional use. Ireland moved to hold a hearing on the Kosaniak conditional use request for an expansion and advertise it for May 8th at 8 p.m. Henderson seconded. Carried. MINUTES Ireland moved to approve the minutes of 3/13/01 as presented. Henderson seconded. Carried. Henderson moved to approve the minutes of 3/29/01 as presented. Ireland seconded. Carried. REPORTS Superintendent - Dave reported that the roads are soft. Crew is putting down mixed stone today. The maintenance equipment is ready but we need dry weather before we break the surface of the roads. We will stone some of the softest spots, $2,000 worth. It costs $9.75/ton. Russell Standard is trucking it from their Union City plant to here. The stone is being tailgated by one of our trucks and spread by one truck from Russell Standard. Mager Tree Report, Agility, Generator - nothing to report. Gravel & Dirt Roads Program - Dave and Rick attended class on April 4th and 5th. Dave reported that most of what they learned was common practice but there is not enough money to do it. We are working on getting grant funds for repairing the underpass on West Stancliff by I-79 and the ditch on Eureka by Hammond's by the creek. There is $75,000 a year allotted to the whole county. We can only hope to plug away at it a little at a time. We'll do it piece by piece. There is an allotment of $10,000 that we can apply for but the grant application must be in by Thursday this week. We could do part of the project on West Stancliff, like terrace the banks, if the State will allow doing the project in pieces. Sachar moved to apply for the $10,000 grant. Ireland seconded. Carried. International Cab and Chassis - John will get a copy of the Truck Trader magazine to Dave so he can call in an ad. Bids for Gravel and Trucking - waiting for the spring road damage assessment. Dave stated that if it rains the next two weeks and we have to put more stone down, we will probably have to eliminate a mile of the graveling program for this summer. Henderson - if our quantity ordered is lowered, it's less of a deal. Ireland - who will haul the gravel and put it on the roads? Henderson - we do spot graveling. This is for summer graveling, not the spring repair work. Antolik - how much will you bid, 15,000 yards? Sachar - more like 7,000 yards. FINANCIAL AND TAXES Bills - discussion on various bills. Henderson moved to pay the bills as listed totaling $4,780.28 general fund; $1,336.03 state fund and $125.00 Silverthorn Road assessment fund. Ireland seconded. Carried. Payroll - none. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - minutes reviewed. Henderson - the Commission needs to write another draft on the Animal Density issue. Ireland - people should know that we are not taking away their animals, only setting levels of regulations. Update Comprehensive Plan - Joyce Berry and Dave are working on it. Joyce has land use issues that should tie in with the Vision Committee report and Dave has population etc. Industrial Park/KOZ, Buren Update, Storage Trailers - nothing. Ordinance #2-01, Animal Density - see P.C. Minutes. County Reassessment - Denver and Dave reviewed what they learned at a reassessment meeting. See 3/29/01 minutes for schedule. At the end of 2002 the final numbers will be certified and used to calculate the 2003 taxes. SOLICITOR Western Trail/G. Antolik, Impact Fee Ordinance - nothing. Oshkosh Registration - waiting for PSATS. OLD BUSINESS Lights on for Safety - Dave contacted Northwestern RECA and doesn't think they're keen on doing the intersection of Old State and Eureka. We have been waiting for them to come up with an estimate. If we want to do another intersection, we can do that. Dan Parker suggested Crane and Silverthorn. Discussion on other intersections in the Township. Ireland - Crane and Silverthorn is all right with me. Sachar - they pay the costs for 5 years and then charge for the light. Board will consider the intersections in RECA's district. Recycle Day, June 23rd - Dave reported that the Board approved a joint recycle day with Washington Township. Dave Anthony called and said that Council approved it also. Ireland - what are the details you're working on? Henderson - everything; costs, revenues, logistics. We could get a truckload of tires just from Washington Township. We need to work out details. Ireland - get a letter from Washington Township saying they want a joint venture. Get a commitment letter. Henderson - Anthony called and said they want to do it. Fry Road Boundary Agreement - Washington Township asked us to produce a draft agreement. Will send a revised copy of the Girard agreement form for Gudgeonville Road. Ireland - do we need a motion? Henderson - when we get to the execution stage. West County Comm. Center Grape Vines - removal job will take 2 weeks in May. Some citizens have been pulling some of the vines out. The prison crew will be pulling posts and snipping wires from April 23rd through May 4th. After this is done, municipal crews will use graders, backhoes and maybe scarifies to pull out plants and take them offsite. Junk, Koestel Property on Crane - we received a verbal complaint about the Koestel property on Crane Road. Ireland stated that the Koestel property is not the only place in the Township that needs to be cleaned up. Sachar - do you want to compile a list, Denver? Denver declined. Henderson - if you are talking about formal action, the letter must be mailed to Julia Koestel. The post office has no idea where Ron Koestel gets his mail. Sachar - his mother is in no shape to get a letter like that. I don't think the property is as bad as others. We'll investigate it. Waste Management Billing Practices - Dave reported that he learned that Waste Management isn't doing their collection program according to our ordinance. Their only competitor is Welka's Disposal. Recycling is not to be an option for residents. If residents are presented with a price difference for recycling or not, of course they will take the cheapest price. Then they call and ask how they can recycle. Sachar - have we talked directly with Waste Management? Ask them to explain what their program is in the Township. They are lower in price than Welka even though Welka is following the rules. Discussion. Henderson - I don't know how they would handle recyclables put out at curbside if the resident wasn't paying for the service. Sachar - ask what their practices are within the Township. CORRESPONDENCE Upcoming training sessions were reviewed. State Convention Expenses - Henderson moved to preapprove hotel expenses for the State Convention for Ireland and Henderson. Ireland seconded. Carried. Whiteman Group Home Letter - Planning Commission minutes on this issue were reviewed. Sachar questioned the number of unrelated individuals allowed to live in the same house. Henderson - the numbers listed in the Zoning Ordinance are the accepted state regulations on this issue. Sachar - I wondered why that stipulation was in the Ordinance. Sachar moved to send Mr. Whiteman a letter with the Planning Commission's indicated limits as stated in the Township's Zoning Ordinance. Henderson seconded. Carried.
