May 8, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2002 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, John and Kim Kosaniak, Gary Truitt, Jarrett Miller, Robert Stanley, George Antolik, Tom Strick and son. HEARING: CONDITIONAL USE REQUEST OF JOHN KOSANIAK, 10806 FRY ROAD, FOR THE EXPANSION OF A HOME OCCUPATION/2003 HOURS Sachar asked for comments from those in attendance. No comments were made. Hearing adjourned at 2004 hours. After discussion the following conditions were placed on the expansion request of Mr. and Mrs. Kosaniak for their home occupation: 1. The residential character of the neighborhood must be maintained. 2. A wooden fence must be erected and maintained on the north and east sides of the garage shielding it from view. 3. No vehicles may be stored for more than overnight outside of the garage. 4. All conditions for home occupations listed in the Franklin Township Zoning Ordinance Section 412 apply. 5. No further expansions of the home occupation will be permitted. 6. Allowed expansion is for a 30'x30' addition to an existing structure of 30'x30' of a pole building construction. Kosaniak - the north fence was erected for Russ Hall, my former neighbor. He no longer lives there. The expansion is for a 30'x30' addition. I don't expect to expand again. Henderson - he wants to expand 30' on the west side of the existing 30'x30' building so it will be 30'x60' with a pole construction. Sachar - we don't want to see a 6-bay repair garage in that neighborhood. Henderson moved to grant the conditional use request of John and Kim Kosaniak, 10806 Fry Road, for the expansion of a home occupation with the conditions listed above. Ireland seconded. Carried. VISITORS/PUBLIC COMMENT Tom Strick/ATV Damage to New Road - Mr. Strick stated that he does not own an ATV and has never allowed his children to own one or a motorbike. Henderson - who is going onto your property with ATV's. You can see the tracks where they came across your land. Young Mr. Strick - we have no ATV's. PSP checked our place last year and found none. We got this bill for $150 for ATV damage to the road and we have no ATV. Henderson - the bill is for damage to the road. We had to go out and regrade so we could apply road oil. They are doing donuts in the fresh grade. If you know who is doing it, tell them to stop it because it is costing the taxpayers money. You are not the only one to be billed for damages. Tom Strick - I see your point. Sachar - if you have no ATV's we'll put the bill aside. Ireland - we need a better policy on ATV damage. Henderson - if we see the tracks going into a driveway, what do we do? Antolik - you can't charge someone if you have no evidence. Discussion. Robert and Marilyn Stanley Mylar, 7767 Crane Road - Mylar was reviewed. It shows Lot 1 with 350 ft. of frontage and 10 acres. Lot 1 contains the existing house and outbuildings. Lot 2 is the residue with 58.6 acres and 499.99 ft. of frontage. M/M Stanley plan on building a new house on Lot 2. Mylar shows that Lot 2 has an approved area for placement of a grand fathered septic system. Henderson moved to accept the Stanley Mylar as presented. Ireland seconded. Carried. Mylar was signed. Western Trail/G. Antolik - George Antolik stated that he would be doing the work on Western Trail that Engineer Mark Corey wanted done in the next couple of weeks. Ireland - call Corey for an inspection. Antolik - I won't bring in any heavy loads until after May 15th. The 15th is McKean Township's rule. Henderson - that is not our rule, I am concerned over heavy loads on the roads. If it stays dry, the roads will still be powder. You won't have heavy loads coming in will you? Antolik - is June 5th all right? I probably will need to bring in some 2RC and rip rap up there. Henderson - no heavy loads before June 5th is good. MINUTES Henderson moved to approve the minutes of 4/10/01 and 4/26/01 as presented. Ireland seconded. Carried. REPORTS Superintendent - Dave reported that some of the road oiling has been done in areas without significant soft spots. Some areas of oiling have broken up at soft spots and we will have to re-oil those spots at our expense. Those left that want oil have soft spots in their road and will have to wait awhile. Last week 60,000 gallons of brine was applied to hold down the dust. Winter maintenance repairs have been done. One truck was painted and will be inspected tomorrow. The other truck will be painted tomorrow and is back from inspection. Ireland - will you grade tomorrow? Henderson - no, we need to let the soft spots tighten up. We need a soaking rain. Ireland - there is a soft spot by Liz Chilcott's on Eureka. Henderson - there is huge sinkhole right there and one on New Road. Ireland - I'd hit a few spots that are really bad. Henderson - if you think it is a safety problem, I'll go look at it. Summer Road Maintenance Program - Henderson moved to adopt the summer road maintenance program as presented. Ireland seconded. Carried. Ireland - what about the snow plow contract? Henderson - it's already discontinued unless you want to continue it again. To reinstate it you'd have to sign a new 5-year contract with PennDOT. Henderson - Gerry Caldwell quit so we are looking for someone part-time. Ireland - does PennDOT get a letter? They said they'd have to add another truck. Henderson - you did that with the agreement. Mager Tree Report - Denver reported that he has a fellow at his work who needs to do community service work. He will supervise him as he completes the Mager project. The individual has liability insurance when he is doing his community service. Agility, Generator Repair, Sale of International Cab and Chassis - nothing. FINANCIAL AND TAXES Bills - Antolik asked how much it would cost to oil the whole Township? Henderson - $79,500 to do the entire Township for one year. The roads hold together better with the oil. Antolik - you have no money to pave and the roads are getting in worse shape. Henderson - that all makes good sense. I have already looked into it. There is no money to do it. I have $250,000 a year for roads and that includes snow plowing, maintenance, payments, labor, other road repairs, pipes, etc. Discussion on various bills. Gehrlein Welding welded the rear beds on both trucks. The triangular pieces under the beds were replaced. He also repaired one wing and one front plow. Ireland - how are the carbide teeth working? Henderson - great, I'm sorry we didn't do it sooner. The Gravel and Dirt Road Program recommends using the stinger moldboard. Ireland moved to approve the bill list as presented totaling $7,551.33 general fund and $3,270.86 state fund. Henderson seconded. Carried. Payroll - none. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - minutes were reviewed. Henderson - we all received their draft on Ordinance #2-01. I put it in ordinance format; made some changes and we will pass it back to them. Bonnie will encourage them to finalize their ideas and get their final draft back to us. Update Comprehensive Plan - Dave said that he'd get in touch with Joyce Berry. He has his section rewritten. Industrial Park/KOZ - Dave reported that Rick Novotny would check with the Corry School District on an extension. He doesn't hold out much hope. Buren Update - they appear to be doing something with the property by Hetz's on Clair Wright Road. They have a 4.5-acre parcel there. They claim to be moving a doublewide mobile home onto that lot. There are surveyor stakes there. They said they want to increase the lot size to 10 acres. The Harry Aulenbacher family, a son-in-law and daughter, are to live there. They appear to be prepping the area for a driveway. They have no driveway permit or building permit. It appears they may have had a survey done but have not brought in a Mylar as yet. Storage Trailers - nothing. Ordinance #2-01/Animal Density - see above. SOLICITOR Western Trail/G. Antolik, Impact Fee Ordinance, Oshkosh Registration, Compare Anti-Nudity Ordinance - nothing. Zessinger Pit/Rudy Ivancic - draft letter received from Solicitor. Waste Management Ordinance Violation - Solicitor is working on it. OLD BUSINESS Lights on for Safety - nothing. Recycle Day, June 23rd - the next flyer is going out next week. Boundary Road Agreement with Washington Township/Fry Road - Washington Township does not like the section that we changed for Girard Township. They think it should be the way it was originally. They want a 60-day notice to dissolve the agreement. We can add that it can revert back to the previous agreement if a 60-day notice is received. Discussion on various possible scenarios for getting out of the agreement. Ireland - when do they want to take it over? Henderson - at a budget year because of the financial end. They've oiled other of their gravel roads. It's just part of their road maintenance. Only the part shared is under consideration. We plow up to Zessinger so we can turn around. Karl Boyes Local Tax Issues Briefing - John reported that the Finance Committee of the House of Representatives is looking at another tax act to replace Act 511. There are some interesting proposals. Henderson jokingly asked if taxes would be lowered. Sachar - my opinion is that every politician ever elected has been determined to take as much from the population as they can get. West County Comm. Center Grape Vines - Dave reported that the job is done. The Township crew was there on Friday. The remaining grape vines were taken out and hauled away. Washington Township will finish up the job this week. Sachar - you need to disc the area with a heavy disc to finish chopping up the remaining roots. Borough of Edinboro/GMSD Resource Police Officer - waiting for meeting notice. John stated that he still cannot see how it will benefit the Township. Dave added that only 180 students at those grade levels are from the Township. CORRESPONDENCE PSATS Planning Committee - Dave said that where a membership in the committee might be beneficial would be in the regular information that they put out but the Township News magazine contains it also. Open House/Washington Township - Henderson and Bernhardt will attend the dedication ceremony on May 17th. ECATO Yearbook Dedication Dinner - Ireland and Henderson will attend.
