June 12, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2000 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Joanne Markham, Rosemary Aulenbacher, Sandy Throop, Tara Miller and Jarrett Miller. VISITORS/PUBLIC COMMENT Terry and Sandy Throop Mylar - the Throop parcel at 11956 Silverthorn is being subdivided into two lots. Lot 1 will be 2.1 acres with 250 ft. of frontage by 375 ft. deep and has an existing house. Lot 2 will be a T shaped flag lot and will have 44 acres with 228 ft. of frontage. This flag lot is being subdivided for grandparents. Through an oversight, County Planning forgot to sign the Mylar while it was at their office. Sachar moved to approve the Throop Mylar as presented. Ireland seconded. Carried. Mylar was signed. Sandy Throop left the meeting at 2010 hours. Andrew and Ella Mae Buren Mylar - the Burens are subdividing their property at 8809 Gudgeonville Road. Lot A at 8291 Clair Wright will be expanded from 4.8 acres to 11 acres. Buren daughter Rosemary Aulenbacher and her family will live there. It has 600 ft. of frontage on Clair Wright. Lot B at the corner of Gudgeonville and Clair Wright, 8475 Clair Wright, will be 5 acres with 650 ft. of frontage on Clair Wright and 270 ft. of frontage on Gudgeonville. This lot has an existing old house and a mobile home on it. Buren daughter Joanne Markham and her family are living in the mobile home. The old house has been boarded up. M/M Buren had planned to convert it into a storage building. Lot C is 81 acres of vacant land that is to be sold to a Mr. Schaaf. Closing is to be 6/13/01. Henderson moved to approve the Andrew and Ella Mae Buren Mylar as presented. Ireland seconded. Carried. Mylar was signed. Joanne Markham - my husband and I would like to look at the old house on the corner. If it is fixable, we would like to fix it up, if not, we will tear it down. Can we do that? Ireland - yes. Sachar - remodel the old house, move in and then sell the mobile home. You can live in the mobile home as long as you are working on the old house. Lot A will have a grandfathered septic system. Discussion. Rosemary Aulenbacher - the existing septic tank is too close to the property line with Tim Buren and has to be moved. The Health Department has okayed it and flagged the new location. Henderson to Joanne Markham - the key thing to remember is there can only be one residence on a lot. Tara Miller said she was interested in the progress on the paving of Eureka section 4. She also expressed concern with 4-wheelers running on the road and in the fields. Henderson - 4-wheelers are a big problem all over the state. They and snowmobiles can easily outrun a police cruiser. Miller - what do we do when someone breaks into our house using one of them to get away? Sachar - there is nothing we can do to enforce the state law. Markham and Aulenbacher both expressed concern with 4-wheelers running Bateman Road and Clair Wright Road and trespassing on the Buren property. Sachar - we can suggest to the Girard PSP to patrol the area more often. Mrs. Markham and Mrs. Aulenbacher left the meeting at 2026 hours. MINUTES Henderson moved to approve the minutes of 5/31/01 as corrected. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that the crew has been grading as many of the roads as the weather allows. All of the north/south roads have been done. Crew was on vacation lay-off last week. Mohawk north of Old State is in bad shape. Russell Standard put down around $1,600 worth of stone on it to help stabilize it. We put down more stone today for stabilization. The problem is that section when it was last graveled, was graveled with Girard pit material that had a lot of sand in it. The gravel is gone now. Rick, Jr. is mowing on Rt. 98. We have been catching up on maintenance. Rick Sr. will be back from vacation tomorrow. Mager Tree Report - Denver reported that he has all of the trees that were marked down but feels there are more that need to come down. He thinks we should ask the property owner if we could cut the additional trees. There are four on the east side and one on the west. He would like to use the Township chain saw to cut the stumps down to ground level. Agility - mowing of the state roads is being done. International Cab and Chassis - nothing. Eureka Road Paving Project - Dave said that he would survey the road for driveways, pipes, sinkholes etc. and then he can do the project budget. The introductory letter to Rep. Karl Boyes was mailed today. Ireland - what year do you have planned for the project and will our normal graveling be pushed back additional years? Henderson - if the petition and final plan are done before budget time, next summer will be the rebuilding and the following year will be the paving. Yes normal graveling will be pushed back. FINANCIAL AND TAXES Bills - discussion on various bills including a bill for $400 to Hi-T Fence Systems. Henderson - the way I remember this fence issue is that when we were doing the bridge, the guide rail end on the southeast corner of Jim Hull's property would protrude into his pasture gate area. Jim wanted us to shorten the guide rail so he could get into his field. At the last minute he changed his mind. He wanted a driveway entrance up a ways and said if we would put in the driveway, he would pay to have his Hi-T fence moved. He just had the fence moved and we got the bill. It would have probably cost us at least $400 in last minute design changes. He has had several cars that lost control on that curve go through his fence. Now there is a guide rail there. Sachar - go ahead and pay the bill and send him a note saying that we understood he would take care of paying for moving the fence but that we did it. Sachar moved to pay the bills as listed including the Hi-T Fence System bill totaling $7,802.23 general fund; $1,783.29 state fund; $4,713.00 EIT fund. Ireland seconded. Sachar abstained from voting on #15, Keystone Diesel Engine. Carried. Payroll - Henderson moved to approve payroll #12-01 as presented. Sachar seconded. Carried. Ireland - I have a question on Resolution #2-01. Henderson - we approved it at the last meeting. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes - proposed Ordinance #2-01 is back from the Planning Commission with changes. Dave suggested that the Board study this proposed ordinance carefully. They made major changes to the original draft. Ireland - the sight line reference makes no sense. Sachar - it makes no sense to me either. Henderson - we shouldn't decide on anything yet. Let them decide what they want and we'll decide at the public hearing. Tara Miller - this is a hot issue. Sachar - I understand that, most of us who grew up in this Township never envisioned anything like this would ever be needed. Update Comprehensive Plan - nothing. Industrial Park/KOZ - nothing. Storage Trailers - nothing. Ordinance #2-01 - see above P.C. minutes. SOLICITOR Western Trail/G. Antolik - Denver reported that Antolik has been working on the road. Impact Fee Ordinance, Oshkosh Registration, Compare Nudity Ordinance, Zessinger Pit/R. Ivancic, Waste Management Ordinance Violation - nothing. OLD BUSINESS Lights on for Safety - nothing. Recycle Day, June 23rd - Dave reported that we need 30 volunteers working two shifts of 15 each. Volunteers should report for duty at 0745 hours. We took 20 compost bins over to Washington Township. They will buy some of the 200 bins just received if any are left over. Washington Township Boundary Road Agreement/Fry Road - Dave said that Council signed the agreement. Henderson moved to sign the Boundary Road Agreement with Washington Township for Fry Road. Sachar seconded. Ireland - they agree to maintain all of Fry Road, from Koman to West Stancliff? Henderson - no, from Koman to their north boundary line. Sachar - we only share a boundary road as far as the boundaries go. Motion carried. GMSD Resource Officer - nothing. Girard Gravel Pit Back Bill - nothing. Wooden Nickel Buffalo Farm Public Assembly Permit - Henderson moved to approve the permit. Ireland seconded. Henderson - one of his weekend events coincides with Bar None. Are you concerned with excess traffic? He estimates 499 people and so does Bar None. Sachar - I see no problem. One thousand cars is not a problem. Not all will come at the same time or have only one to a car. In the future if the events grow, it could be a problem. Motion carried. Sign Gravel and Dirt Road Contract - Henderson moved to sign the contract. Ireland seconded. Ireland - we're adding 12 inches of gravel. Did you measure under the bridge? Henderson - we're adding 8 inches of material. After the addition of the aggregate, the bridge will be 16 feet. Motion carried. Contract was signed. County Aid Application Form - revision was approved last meeting. An error was made in signing the form. A new form will be requested. NEW BUSINESS General McLane Budget Increase - the school board announced that they have lowered their budget increase from 18 mills to 14 mills. Henderson - we need to get all the municipalities in the school district together and rock the boat. That is more of an increase in one year than most municipalities collect. We should tell them that we're all going to raise our taxes twice what the school district raises theirs. That should create a stir. CORRESPONDENCE ESTA - John asked what the status of ESTA was. Dave said that they are being converted from the defunct Northwest PA Technical Institute and reincarnated into an organization under the Department of Labor. Possibly Butler Community College or one in Philadelphia will be responsible for the education certificate given out at this facility. They have been busy on the grounds. It is unknown how it will shake out. ABC's of Land Use Management - John attended the training session and reported that it was for those just getting started on the basics of land use. It was his opinion that we are ahead of the state in land use planning. One interesting comment was that zoning is a communistic idea. Sachar - you don't own your property. You rent it.
