July 26, 2001 The meeting of the Board of Supervisors of Franklin Township, held in the Township office, was called to order by Vice Chairman Denver Ireland at 0806 hours with the Pledge of Allegiance. Present were Ireland, David Henderson, Jarrett Miller, Gary Truitt, Stanley and Alice Hudy, John and Chris Hudy, Rod Brandon, and Dennis Cholak. John Sachar was absent. VISITORS/PUBLIC COMMENT No comments. MINUTES Tabled until next meeting. REPORTS Superintendent - Dave reported that the crew has been mowing and working on the West Stancliff/I-79 project. Mager Tree Report - Denver reported that he is working on it. International Cab and Chassis - nothing. Agility - the next round of State mowing will begin in a couple of weeks. West Stancliff/I-79 Project - Dave reported that the project is going well and will probably be finished at the end of next week. The bid opening for the special aggregate is to be opened August 14th. We can get a quote on trucking after the opening. The application of the driving surface will be done the second week of September. Dave felt that more big stone and more millings are needed. Ireland - I've had some good compliments on the job. Discussion. Shadduck/I-79 Dumping Incident - someone dumped roofing shingles at the turn-around on Shadduck and I-79. The PA State Police are investigating. Township crew cleaned it up because once someone starts to dump others will do it too. FINANCIAL AND TAXES Bills - discussion on various bills. Ireland moved to pay the bills as listed totaling $5,968.29 general fund; $587.45 state fund; $7,869.68 from Gravel and Dirt Roads grant to general fund for project costs; $4,000 fire dept. fund. Henderson seconded. Carried. Payroll - Henderson moved to approve payroll #15-01 as presented. Ireland seconded. Carried. FTVFD Contract - Ireland moved to pay the fire department the contract amount of $4,000 for the year 2001. Henderson seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Review Planning Commission Minutes - nothing. Update Comprehensive Plan - nothing. Industrial Park/KOZ - nothing. Storage Trailers - nothing. Ordinance #2-01/Animal Density - nothing. OLD BUSINESS Lights on for Safety - nothing. Recycle Day Wrap-Up - freon has been removed, will smash the appliances and take them away. Girard Pit Back Bill - no word from Mr. Summerville on a proposal. Census Undercount Appeal - no new news. Dave is still looking. Recycle Grant/No Burning Ordinance - Denver explained the State's news release concerning the no burning of recyclables to those present. Ireland - would we have to create a whole new ordinance or revise an existing one? Henderson - we would have to create a new no burning ordinance specifically banning burning of any recyclables that are currently on our list of items being collected. Ireland moved to create a no burning of recyclables ordinance. Henderson seconded. Carried. NEW BUSINESS Platea Request for a Representative to Attend August 6th Meeting - because on ongoing problems between Platea Borough Council and their volunteer fire department, Council is asking surrounding municipalities and fire departments to attend a meeting to discuss their working relationships with their fire departments/municipalities. This is in an effort to solve their problems. CORRESPONDENCE Henderson moved to send the Township crew to the Winter Maintenance training session to be held in Erie on October 9th. Ireland seconded. Carried. Meeting was recessed for 15 minutes to wait for the Solicitor to arrive. Attorney George Schroeck arrived at 0847 hours. Meeting was reconvened at 0853 hours. SOLICITOR Western Trail/G. Antolik - Denver stated that he recently went by Western Trail and no additional work has been done. The Solicitor was authorized to contact Attorney Doug Moorhead and ask about the status of the road, reminding him that Mr. Antolik said he would have the road completed by June 15th of this year. Impact Fee Ordinance - nothing. Oshkosh Registration - Dave will check to see if any progress is being made. Comparison of Nudity Ordinance - Attorney Schroeck reported that Felicia is almost done with the comparison. Zessinger Pit/R. Ivancic - no word has been received from Mr. Ivancic's attorney. Waste Management Ordinance Violation - suit was filed and a hearing is scheduled for August 20th at 10 a.m. A representative from Waste Management is due to arrive to discuss the issue and seek some remedial solution. Weight Limit Ordinance/Act 33 of 2001 - nothing. Eureka Road Paving Project - Attorney Schroeck said that the paperwork to go out to the residents looks pretty thorough. Cholak - in the estimate you have a 10% contingency. How sure are you that you will need a contingency? The extra 10% may be the swing to deciding yes or no. The 10% contingency is added on to the total cost which would become the homeowner's cost. Henderson - I think the 10% contingency will be a guaranteed expense. Things happen that we have no control over. This is also a projected cost at this year's rate. The 20.55% will be borne by the property owners. Hopefully Representative Boyes will kick in more money. The geo-textile that will be used is a much-improved version of what was used on Silverthorn. This fabric doubles the cost of the project. Ireland - how thick will the pavement be? Henderson - 20 feet by 4 inches of ID pavement. We used 20 feet by 31/2 inches on Silverthorn and did not use ID. Rod Brandon - what are the prospects of getting the section of Eureka from Old State to New paved? Henderson - we can increase the size of improvement material 1.1 miles for that section. Cholak - what if the assessed value for the other section is low. Would the shift affect our section? Find out the assessed value as compared to our section. Truitt - that section has a lot of vacant land that is assessed differently. They could go assessed value. Cholak - if they went front-foot assessment that would go under the Second Class Township Code. Truitt - would the whole project have to go by front foot assessment then? Henderson - yes it would. Truitt - I wouldn't go for that. It would cost me $20,000. Cholak - if Representative Boyes could give us more money. I'll take the petition around. Henderson - we'll send out the material and call for a meeting. Brandon - I'll take a petition around on our section. Henderson - we need the preliminary plan approved. The final approval is after the meeting. Some may not sign a petition until after the meeting. That is not good because you can't go to Rep. Boyes and say "this is how many are in favor". Get the petition signed to show interest only. Let them know that they can back out after that. Truitt - any money from Rep. Boyes comes directly off the homeowners cost? Henderson - yes. We will send around the information to each resident with a cover letter. The petition will say sample on it so they know not to sign it. A public hearing will be advertised for August 21st at 7 p.m. in the social hall of the FTVFD. A letter and sample petition will be circulated before that meeting. A separate petition will be considered for the other section of Eureka. Eureka section 4 does not want Eureka section 3 involved because of the possible cost shift to them. Pat DeSimone/Waste Management District Manager - Mr. DeSimone stated that he is here to make sure that Waste Management is in full compliance with the Township's recycling ordinance. He said that he called and asked for information to see what remedial action is needed. Henderson - they are not in compliance with our ordinance. The cost of recycling has to be bundled in the pick-up cost for each customer. You've not been offering it or as an addition cost to the homeowner. DeSimone - if we need to offer it we will do that and get a plan in effect. Henderson - it is a significant disincentive to recycle if the costs are lower for not recycling. If you charge $30 a quarter for no recycling and $40 a quarter if you recycle, the pocketbook will dictate whether someone recycles. We are trying to encourage recycling. We need a plan from Waste Management for changing over their customers to recycling. DeSimone - we went through the extensive effort to stay off the roads in the spring. (Henderson thanked Mr. DeSimone for that effort.) I wasn't able to get information on this problem. When we are aware of a problem, we take care of it. We need to identify the customers who want to recycle. Henderson - bring back a plan for our August 30th meeting. Attorney Schroeck will discontinue the hearing set for August 20th. DeSimone - call if there are any other questions. Vice Chairman Ireland called an executive session at 0932 hours to discuss the letter just received from Mr. Summerville concerning the back bills owed on the Girard gravel pit. Meeting was reconvened at 1005 hours. Henderson moved to accept the Summerville proposal of $5.71 per yard that will net the Township 600 yards of gravel delivered from the Zessinger gravel pit to the Township lot. Ireland seconded.
