August 30, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0807 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Jarrett Miller, Gary Truitt and Mary Holt, BTN. VISITORS/PUBLIC COMMENT No comments. MINUTES Henderson moved to approve the minutes of 8/14/01 as presented. Ireland seconded. Carried. REPORTS Superintendent - Dave reported that the crew has spot graded 8 miles of road; some maintenance on equipment was done. Two dry hydrants were installed, Gastemire on Carbury and Nicholls on New. Crew will be on lay-off the week of Labor Day. While off they will all attend the equipment show at Walsh Equipment. Rick will drive and be reimbursed for his mileage. Mager Tree Report - Denver reported that he is waiting for the berms to be mowed. Agility - we have finished the second round of mowing for PennDOT. Sachar - the intersections need to be mowed back further, especially at Ivoray and Crane. Henderson - he can't reach any further with the boom. He needs to get up on the banks. International Cab and Chassis - nothing. Eureka Road Section 4 Paving Project - hearing is on September 4th. Gary Truitt - most of the people want to wait for the meeting before they sign the petition. Some have signed and some are a definite no. Most want to wait. Henderson - the Solicitor will be at the meeting on the 4th. I-79/West Stancliff Project - two bids were received and copies were sent to the Soil Conservation District for review. Dave reported that the Tucci bid meets hardness but not the fines requirement. Erie Sand and Gravel is off a little for the fines requirement also. The big difference is that the Tucci material does not come from a solid rock formation, it comes from a gravel pit. We have to accept the bid from Erie Sand and Gravel. Ireland moved to accept the bid from Erie Sand and Gravel for the Special Driving Surface Rock Aggregate for $16,500. Henderson seconded. Carried. Mohawk and Old State Pipe and Catch Basin Project - Dave reported that the edges of the road have been filled in. Crew finished the pipe on the north side and will cut down the south side bank so the water can get to the ditch. If it is dry enough today that work will be done. The project is almost completed. We purchased 100 yards of gravel from Showman for the job. Receipt of Gravel from R. Summerville - 14 loads have been received. No additional received from the last report. FINANCIAL AND TAXES Bills - discussion on various bills. Henderson moved to pay the bills as listed totaling $5203.60 general fund; $1068.87 state fund; $663.99 fire dept. fund and $7029.30 EIT fund. Ireland seconded. Carried. Payroll - Henderson moved to approve payroll #18-01 as presented. Ireland seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY AND HEALTH Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers, Ordinance #2-01/Animal Density - nothing. Ordinance #3-01/No Burning of Recyclables - the proposed ordinance was read to those present. The burning of recyclables collected curbside and at the annual recycle day will be prohibited. Ireland - I questioned whether a person could burn only one weekend a month. Sachar - we didn't want to limit burning, only the burning of recyclables just to satisfy DEP. Ireland moved to advertise and hold a hearing on Ordinance #3-01 on September 27th at 8 a.m. Henderson seconded. Carried. Conditional Use/Wynn Woods; Conditional Use/Dorothy Ogg - hearing is September 11th at 8:00 p.m. and 8:10 p.m. OLD BUSINESS Lights on for Safety - nothing. Recycle Day/New Grant - need authorization to apply for a new grant and the signing of necessary documents. Henderson - what about Washington Township? Sachar - participation was about 50/50. Henderson - if we combine, we need to readjust our figures for the application. Sachar - if we co-operate, should we alternate collection sites? Ireland - that would be confusing to the residents. Henderson - with our figures, we can get a good idea on the amounts to apply for but if we go in with Washington Township we will need to reassess the figures. Sachar - contact them and let them know we're reapplying for the next grant cycle. Get a definite commitment from them. Ireland move to authorize applying for a new recycle grant and the signing of necessary documents. Henderson seconded. Carried. Attorney George Schroeck arrived at 0828 hours. Census Undercount - nothing. SOLICITOR Western Trail/G. Antolik - Attorney Schroeck reported that he contacted Attorney Moorhead who said he would contact Mr. Antolik. Moorhead did not call back yet. Schroeck said that he encouraged Mr. Moorhead to have Antolik complete the work on the road. Henderson - it needs to be seeded and growing grass within the next three weeks or it will erode again and we'll be back in the same position. Impact Fee Ordinance - nothing. Oshkosh Registration - nothing. Nudity Ordinance Comparison - working on it. Zessinger Pit/Rudy Ivancic - Schroeck reported that he received two letters from Attorney Evan Rudert on this matter. Rudy is generally in agreement with our proposal. Discussion on a hold harmless clause. Henderson - tell them we'll do the hold harmless clause. Who does the language? Schroeck - you should have a total indemnity clause so the Township is clear. They probably will do the words and we'll have to modify it. Ireland - it will be awhile before he can close the pit with Summerville in there. Schroeck - my understanding is that they will continue to mine. Ireland - what if we advertise to sell the rights to the pit? Henderson - we tried that. Rudy doesn't want anyone to go deeper. You could go 20 feet deeper but you would be digging in water and that is a different animal. You would need to dig and let it dry out a summer and crush the next season. We don't have the money to invest in it like a commercial operator. Sachar - have our Attorney draw up a proposal and let us review it at the next Tuesday night meeting. Let Rudert know we're doing it. Waste Management Ordinance Violation - Mr. DeSimone is to arrive at 9 a.m. Weight Limit Ordinance Comparison with Act 33-01 - will review and make sure the ordinance complies with the new Act 33 of 2001. Ray Swift Complaint - Sachar called the meeting in recess to discuss a personnel issue at 0840 hours. Meeting was reconvened at 0853 hours. Ireland moved to authorize the Solicitor to respond to the Ray Swift Complaint. Henderson seconded. Carried. NEW BUSINESS Drought Reporting - the Emergency Management Agency is asking that we begin reporting on drought conditions within our Township. Henderson - residents report dry water wells to us. We would truck water if needed. Springfield Township trucked water last year. They bought a poly tank and filled it and people came to the township building to get water. We have to report houses and farms with no water and actions taken by our municipality and citizens and our needs. History Grant - Dave stated that we have a lot of history in the Township that isn't recorded. The grant is for researching, writing, recording and publishing. Discussion on historic information available within the Francis cemetery. Schroeck - college history students could help with this. Henderson - we could buy small handheld tape recorders with the grant and give them to some of our old-time residents. The program is $5,000 no match and $15,000 above that at a 50/50 match. Discussion on costs. December 1st is the deadline for the next year cycle. They also have grants for digitizing data and for microfilming. Henderson was authorized to contact Carol Sanders to see if she would head up the project. Fry Road - Ireland reported that he heard Washington Township was going to tar and chip Fry from Old State north. Dave said he would call Dave Anthony and find out about it. CORRESPONDENCE Reviewed. Henderson said that there would be notification soon of a meeting on the French Creek Watershed. He stated that the Board should attend this meeting. Waste Management Ordinance Violation - Pasquale DeSimone arrived at 0905 hours. DeSimone - we are in the process of creating a flyer for our customers concerning recycling. The only difference is that we will collect newspapers on a weekly basis instead of once a month. We have around 50 customers and you tell me you have 565 residences. We will notify each about the recycle program. On your annual recycle day, would the Township consider having Waste Management be your hauler for next year only free of charge. We could provide the hauling to the recycle center in lieu of the ordinance penalties. You may get some value from the scrap next year. Henderson - that would be providing roll-offs also? DeSimone answered yes. Sachar - are you proposing that in lieu of penalties you would provide hauling services? DeSimone - yes and we apologize for not getting information out to the residents. Our policy is to comply with all local ordinances. We're trying to remedy that situation. Henderson - are you doing bag tags and the quarterly method? DeSimone - we have a few bag customers, most are the quarterly method. Henderson - we encourage bags, it's a pay as you throw method. People are usually more diligent in recycling that way. It is also usually more economical for them. Ireland - it's fine with me if they create a recycle policy. Sachar - in lieu of penalties Denver? What are the penalties? Ireland - yes, in lieu of penalties. Schroeck - the penalties are around $6,000. We need an agreement drawn up.
