October 9, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2003 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Jarrett Miller, Marilyn Tait, Tom and Jeanne Reynolds, Gary Truitt, Jeff Yatzor, Mike and Steve Wolchik and George Welka. VISITORS/PUBLIC COMMENT Tom Reynolds - I did some damage to West Stancliff Road and I'd like to offer to pay for the damages. Henderson - it's fine with me if he pays for the damages. Ireland - Dave called the State Police. Reynolds - PSP told me to talk to the Board and make restitution and charges wouldn't be pressed. Sachar - what's to keep you from doing it again? What made you do it in the first place? Reynolds - I didn't intend to cause damage and spin my tires. I thought the road was open. I drive a S-10 pickup and they are light in the back end. Henderson presented photographs of the damage done to West Stancliff Road at the I-79 bridge project site. Henderson - official road closed signs were up and slightly off center so construction equipment could come through. You got caught. Six others came down there. The road is closed for the safety of the workers and then for the safety of the public. You put all of us in jeopardy. You're here pleading for your license. George Antolik arrived at 2006 hours. Ireland moved to have Dave Henderson send Tom Reynolds a bill for damages. Sachar - I'm not going to second that, I don't know what our options are. Henderson - would you like to talk to the Trooper first, I'd like to talk to PSP also. Ireland withdrew his motion. Tom and Jeanne Reynolds left the meeting at 2008 hours. Marilyn Tait - how close are you to taking over Western Trail? Henderson - close, we haven't heard from Mark Corey yet on whether he made the inspection. Sachar - I don't know how much time it takes before we can take it over. Henderson - it just takes a meeting. To George Antolik - I assume you want us to take it over. Antolik - that was the intent. The last court order said you'd take it over. Sachar - I don't think that order would hold water. You never obeyed that order. Wolchik Sketch Plan - a sketch plan of a proposed subdivision was presented for review. The property is on Mohawk between Crane and New. The plan shows a private drive/public right-of-way with seven 5-acre lots, one 7.2-acre lot and one 13.73-acre lot fronting on the private drive. The Planning Commission stated that they would rather see a subdivision with all the lots fronting on a private drive than with some lots configured as flag lots fronting on Mohawk. The Subdivision Ordinance allows only four lots fronting on a private drive/public right-of-way. Henderson - to use this sketch, you would write the right-of-way into the deeds. Do the prep work on the road base and sub-base as though we'd take it over. Then don't ask us to take it over. If at some point you want us to take it over, you must complete the sub-base and pave it according to the Subdivision Ordinance specs. M. Wolchik - do we have to use fabric? Henderson - it might cost less in the long run to use it but you don't need fabric. Because of the depth of this piece of land, Erie County Planning will want you to make provisions for the road to extend all the way through to the next road from one of the back lots. The turn-around needs a 60-foot radius. Get your engineer to make a plan by consulting with our engineer. If we're not taking it over, you don't need to pave it. There's not a problem with the number of lots if some of them front the turn-around from a private driveway. M. Wolchik - I need to take the road up to the sub-base with a turn-around. Henderson - have your engineer talk to you about fabric. It depends on the lay of the land. With the new fabric out now you can use less gravel. It may be cost effective. M. Wolchik - it can be a private road until we want it taken over? Henderson - yes, then it must be brought up to Township specs and paved. You need to show the gross and net areas on your Mylar. The gross area of the lots doesn't consider the right-of-way. When purchased you pay for the net area. Discussion on flag lots. The Wochiks left the meeting at 2026 hours. Gary Truitt - Karl Boyes' office called and said meeting arrangements are still in progress. Henderson - I saw him and he said he wanted to meet. The economy isn't good right now and there is a substantial shortfall in the State budget. Even after the project is started, the State could still come through with money if we don't get it up front. Welka Ordinance Violation - discussion on the issue. G. Welka - we have a few problems with hauling. One tag customer put 15 bags of recyclables out and more of newspaper with one bag of tagged garbage. That could put us out of business. They also have a Waste Management container. Henderson - do you feel they're cheating you? Welka answered yes. Ireland - you'll always get a few that will cheat. Welka - if someone complains, call me so we can handle the problem. Henderson - you need to look at the history of that customer. Discussion on those playing the system. Henderson - one bag of garbage and one of recycling doesn't work for us. We don't want to discourage recycling. If someone has two bags of recycling out, that should be okay. We don't have figures in our ordinance. There is always some who will take advantage. Welka - we'll correct it if two bags of recycling aren't taken. We will correct the problem. Henderson - we did send you a letter saying that we are encouraging recycling. How many are recycling? Welka - not many. Discussion on pick-up in the spring especially for those with containers. Will handle the problem on a person-to-person basis. Sachar - direct the secretary to tell those who complain to contact Welka and Waste Management directly. Should we raise prices? Welka - no. Why punish everyone for a few. Henderson - we're going to get recycle containers. Welka - that is a problem. They are more trouble than they're worth. Henderson - DEP wants to see our figures raised. They think this will improve our figures. Discussion. George Welka left the meeting at 2050 hours. Jeff Yatzor Subdivision - Mr. Yatzor is purchasing property from his mother on Koman Road. The property has been surveyed but the Mylar is not back yet. He needs the subdivision process to be completed by November 8th. Henderson - this is a simple subdivision, it should sail through. Take it right to the County after the Planning Commission signs it and then get it right back here. Jeff Yatzor left the meeting at 2057 hours. MINUTES Ireland moved to approve the minutes of 9/27/01 as presented. Henderson seconded. Carried. Ireland - on the Brooks Road and Hawthorne Ridge Road agreement with Fairview Twp., the new agreement should say summer and winter maintenance. REPORTS Superintendent - Dave reported that the crew has been grading, the West Stancliff-I-79 project is finished, some equipment maintenance work is being done. Crew attended a winter road maintenance training session. All learned something from it. Mager Tree Report - Denver reported that it looks good. Agility - mowing is being done on Old State and Crane. International Cab and Chassis - nothing. Eureka Road #4 Paving Project - see visitor section. Gravel from Rick Summerville - no other gravel received. West Stancliff/I-79 Project - Dave reported that there were a couple of minor problems. Under the bridges it doesn't get wet. We wet the material but it is sloughing off the water. We put water on it trying to get it to bind. We could get a real roller to go over it. For the most part, the water mixed in with the material worked well on the second day. Now we have to get grass growing. For the most part the project is done. FINANCIAL AND TAXES Bills - discussion on various bills. Truck #5 was fitted with new springs. Dave is concerned with #6 also. It may need to be done. Dias Spring says it's a common problem for these trucks. Sachar - they are loaded too heavy. They should carry 6 yards, not 10 yards. Discussion. The Shingledecker bill is the final adjusting bill. Ireland - how much was the WS/I-79 project bill? Henderson - total cost will be between $37,000-$38,000. We ran over on the big rock and over on the 2-A but under on fabric. We will ask Leroy Gross if he can come up with more money to cover the cost of the big rock. Sachar moved to pay the bills as listed totaling $38,758.60 general fund; $2,041.66 state fund and $43.32 fire dept. fund. Ireland seconded. Carried. Payroll - Henderson moved to approve payroll #21-01 as presented. Sachar seconded. Carried. Tax Certification and Memo Bills - can be done by resolution. Will review the sample ordinances. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers, Lights on for Safety, Census Undercount - nothing. History Grant - Dave reported that he met with representatives from EUP. Some of their students are doing oral histories. They are interested in doing technical advisory work for us to help us get a grant. For their oral history project on World War II, some of our people can help them out also. We can do the oral history first and the graveyard history second. Ordinance #3-01/Animal Density - Sachar moved to advertise a hearing for November 13th at 8:30 p.m. in the Township office; if there is an overload to move to the FTVFD social hall. Ireland seconded.
