October 25, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0807 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Cindy Farmer, Sergeant Schau of PSP and Jim Mischler. VISITORS/PUBLIC COMMENT Sergeant Schau/PSP stated that he was paying a courtesy call. Nothing much has been happening within the Township, mostly vehicle accidents and two burglaries. Henderson - we attempted a meeting with Trooper Sibbald on the Reynolds issue. Mr. Reynolds is already driving on a suspended license. The ticket will extend the lost license time. He was ticketed for violation of a work zone. I'm not interested in cutting him a break. This was a road rage issue. He has a problem. You can still see the spin marks in the road and now it has potholes in it. The fine was $94.50 and could have been much higher. Sergeant Schau - his fine for driving while under suspension can go up as high as $1,000. The minimum is $250 for a first offense. If it was suspended for DUI, he can do jail time. Henderson - we don't have to do anything. This will take its natural course through the State Police. Ireland and Sachar agreed to let it take its course. Sachar - I wasn't inclined to cut him a break. Cindy Farmer asked about recent problems in Franklin Center. Schau - we have a minimum of 4 cars on duty. People all over are driving too fast. Sergeant Schau left the meeting at 0815 hours. Cindy Farmer - what's going on with the possible paving of Francis? Henderson - Cindy initiated a letter to Bob Everhart, Sr. before he passed away. Bob Jr. has talked to me about it. Farmer - Russell Standard has always kept it in good condition going one way. Now a lot of trucks are going the other way too. I was under the impression that Russell Standard would help with costs but would have to talk to you about it. Francis is one of the most heavily traveled roads. Henderson - we had it tarred and chipped and couldn't keep it up. There is no foundation and it blew up, potholes. We took it back to gravel. If we're to do it, we need to do it right. We must learn from past experience. We just couldn't afford to keep it up. Bob said they wouldn't be responsible, they don't use that end much. If we do it, I would want to use fabric and triple seal coat. Ireland - we didn't have triple seal coat on the other end of Francis. Henderson - yes we did. Bob had some material from another job that wasn't acceptable and he put that down and it blew up. We also tried an enzyme product and put that on it. It didn't do a significant job either. Sachar - we can look at it for the budget next week. Henderson - the Eureka 4 project is going forward. There is neither the time nor money for Francis next year. We'll pave Eureka and the residents will pay for it. Jim Mischler - your obligation is to get the road ready for paving. Farmer - how do you determine what roads get the care first? Ron McClelland arrived at 0825 hours. Henderson - potholes are a function of the travel level. McClelland - is there a base on that road? Henderson - none of these roads were built right. They all have organic material as a base, fence posts, planks etc. under the surface. Our solution is to do each section right when we do it. If we did that road, we would consider extra thick asphalt because of the level of volume. In answer to Farmer's question on where all the tax money goes, Henderson answered that the average resident pays $150 of taxes to the Township a year. Henderson - my road budget is around $250,000. After you take out equipment payments, snow removal, wages, repairs, materials, etc., I have around $60,000 left to put into the roads in the summer. George Antolik arrived at 0830 hours. MINUTES Ireland moved to approve the minutes of 10/9/01 as presented. Henderson seconded. Carried. REPORTS Superintendent - Dave reported that the first complete grading is done and he hopes to do another complete grading before the trucks are readied for winter. We may have to concentrate on the worst roads. Fry Road is bad. Dave Anthony/Washington Twp. said they are not going to pave Fry, they may use MC-70 on it. Sachar - the areas where you used limestone are holding up well. Henderson - I want to put that in the budget as standard operating procedure for next year. Mager Tree Report - Denver reported that the job is almost done. Agility - still mowing State roads. International Cab and Chassis - John needs to provide words for the ad. Eureka Road #4 Paving Project - the project passed 70% to 30% and will be included in the budget. The plan is for the final plan approval process to be completed in April for voting. Receipt of Gravel/R. Summerville - Dave reported that he talked to Mr. Summerville. No further gravel delivered as yet. Tractor Repairs - repairs may be around $2,000. Tractor is back from Walsh. Report on Reynolds Matter - see visitor section. Attorney George Schroeck arrived at 0836 hours. FINANCIAL AND TAXES Bills - discussion on various bills. Will bill Soil Conservation District for the remainder of the West Stancliff/I-79 project when all the bills are in. The project needs a little more work. Henderson moved to pay the bills as listed totaling $18,129.28 general fund; $3,412.42 state fund; #3,617.63 Silverthorn Road assessment fund. Ireland seconded. Carried. Payroll - Henderson moved to approve payroll #22-01 as presented. Sachar seconded. Carried. Charge for Tax Certification/Memo Bills - Dave proposed that we would want to decide on an amount for the certification and include it as a resolution at the organizational meeting in January. All agreed. PLANNING, ZONING, RECREATIN, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers - nothing. Ordinance #3-01/Animal Density - hearing is November 13th at 8:30 p.m. Welka's Disposal Ordinance Violation - on the last pick up, they did take two bags of recycled materials with one bag of garbage. Because of continued confusion, a letter will be sent outlining the collection program within the Township. Ron McClelland and Cindy Farmer left the meeting at 0847 hours. History Grant - Dave presented the project description for the grant application. Ireland - are there any other cemeteries in the Township beside Francis? Henderson - there was one on the Bucho place. Mischler - the graves there have been moved. Henderson - I suspect the $5,000 limit will be exceeded. We can divide the work into two sections, the oral history and the cemetery. I want to get the information in hand and apply for another grant to complete each project. November 2, 2002 is when the work can start if we get the grant. The $5,000 is a no match grant. Lights on for Safety, Census Undercount - nothing. SOLICITOR Zessinger Pit/R. Ivancic - Attorney Schroeck reported that he sent the original document back to Rudy for him to initial all the pages. George will file the document at the Courthouse when signed by all parties. Western Trail/G. Antolik - waiting for a report from Mark Corey. Attorney Moorhead made an official request on behalf of Mr. Antolik for the Township to take over Western Trail. Schroeck - do you want me to call Corey? Antolik - if we can resolve this today, I would like to do the paperwork as soon as possible. The people on the road would like to see this resolved. Ray Swift Complaint - haven't heard anything on this issue. Henderson - to distance myself, Rick Gould wrote the job description. Weight Limit Ordinance Comparison - Dave asked Attorney Schroeck if our emergency-posting ordinance conforms to Act 33 and what we need to do if it doesn't. George will check on it for us. Nudity Ordinance Comparison - waiting for Felicia Schroeck to complete her comparison with the City of Erie ordinance. GMSD/EIT Collection Revisions - Dave feels that we need to move along on this issue, the School Board will adopt these revisions soon. Sachar - they want to allow the tax collector to sheriff sale property for non- payment of EIT taxes. Henderson - we need to know if we have the legal standing to be allowed to sheriff sale a property. OLD BUSINESS November Meetings - Budget meetings, November 12, 14; regular meetings, November 13, 29. NEW BUSINESS Mining License/Girard Pit - Henderson moved to sign the license application and pay the $300 fee. Sachar seconded. Carried. Edinboro Food Pantry - Edinboro Borough wants money to help defray the yearly cost of $5,000 for operating the pantry. They reason that customers are from all the municipalities surrounding Edinboro, including Franklin Township. Henderson - there are a couple of issues here. There are several things that aren't direct government services, the pool at Culbertson Hills for the YMCA and this food pantry. In Washington Township's case, they contribute to the pool and the Borough has not. There are other issues too. There is no detail on the way this $5,000 is spent. I understand that the pantry was not charged rent. It's not appropriate to charge us if they're not charging rent. It may be a good idea not to have the pantry in the Borough building due to the parking limitations. We don't know how many of our people use the pantry. If you feel I should investigate this, I will. Sachar - it's implied that the Borough will charge them rent. The letter says that the pantry looked into moving into the Edinboro Mall at approximately $5,000 a year for rent. Henderson - all of these things relate to our greater societal area. If we're to help share expenses, we need to do it in an organized manner. All of the government officials need to decide as a group. Attorney Schroeck left the meeting at 0910 hours. CORRESPONDENCE E.M.A. Terrorism Training - Dave feels that we all need to participate in this training. The possibility may be remote in the Township but it is less remote in Erie. If struck your neighbors are the ones who support you. If we're put in a position to help in recovery, we need some training. We could combine with the Fire Dept. and get a training session held here. Sachar - it may be more feasible to do a West County session. Henderson - we have an emergency plan adopted previously and I am in the process of updating it so that it will conform to the State's standards. Sachar moved to contact the EMA and let them know we are interested in attending a session in our area. Henderson seconded. Carried. ADJOURN Sachar called the meeting adjourned at 0915 hours.
