November 29, 2001 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0810 hours with the Pledge of Allegiance. Present were Sachar, Denver Ireland, David Henderson, Gary Truitt, and George Antolik. VISITORS/PUBLIC COMMENT No comments from those present. MINUTES Henderson moved to approve the minutes of 11/12/01 as corrected and 11/13/01 and 11/14/01 as presented. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that the snow equipment is loaded on the trucks. Wednesday was the last day of work before lay-off that begins today. Mager Tree Report - Denver reported that the work is almost done. Agility - nothing. International Cab and Chassis - nothing. Eureka Road #4 Paving Project - Gary Truitt reported that the project is on Rep. Karl Boyes's back burner. Water and Beaver Problem/Silverthorn - nothing new to report. Elk Creek Boundary Road Plowing Agreement - Dave reported that their Board is not interested in switching Ivoray and Carbury even though the distance is the same. We will have to deadhead across Ivoray to get to Carbury. Sachar suggested paying them a visit. Will do. Safety Study of Rt. 98/Rumble Strips Crane and Old State Intersections - Dave reported on the recent double fatality at Crane and Rt. 98. The accident was caused by a failure to stop at the sign. Inattentive driver was the cause of all the accidents outlined on the study of 1998. The fire police on duty that night were not visible due to the fog that came in before clean up had occurred. For their safety, it was suggested that "accident ahead" signs with flares be purchased by the fire department for use. FP1, June Shelhamer, suggested using rumble strips on Crane. They are used frequently in other states but not in PA, and only with permission from PennDOT. If used they would need to be replaced every couple of years. Drawbacks are that they may not be effective in winter, residences nearby would not appreciate the noise and drivers may try to dodge them by using the other traffic lane. Their advantage would be to alert drivers. High visibility signage could also be used. Henderson - I would propose requesting another safety study be done. Ireland - do they make a flashing stop sign? Henderson - yes but they are not authorized in the PennDOT manual. A flashing light overhead is a not solution, it's costly and we would have to pay for it. If we can convince PennDOT to use rumble strips, we would want them at Crane and Old State. Larger signs are available but if the driver is distracted a larger stop sign won't do it. There is the possibility of using the Lights on for Safety light but Old State is well lit and there is still an inattentive driver problem. Ireland moved to ask PennDOT to do a safety study on Route 98 from Rt. 6N to Hawthorne Ridge Road. Henderson seconded. Carried. FINANCIAL AND TAXES Bills - Ireland moved to pay the bills as listed totaling $5,231.48 g. f.; $4,022 EIT; $2,628.66 m. b. fund. Henderson seconded. Carried. Payroll - Henderson moved to approve payroll #24-01 as presented. Sachar seconded. Carried. Charge for Tax Certification, Memo Bills - will do at organizational meeting. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers, Lights on for Safety, Census Undercount, OTM Bulk Sewer Agreement - nothing. Ordinance #3-01/Animal Density - Gary Truitt stated that the Planning Commission's reasoning makes sense but even with 15 acres and 250 ft. of frontage, you'd still be subjecting your neighbor to the smell and noise of animals. Truitt - you could fence all 15 allowable cows onto 1 acre right next to your neighbor. The ordinance needs to address smell and noise. Sachar - I would like to see the definition of animal density reworked, perhaps by adopting the State's definition using weight not numbers. Henderson - give the Planning Commission the combined meeting minutes of 11/13/01 and this meeting and ask for additional recommendations. Sachar - if this ordinance does not limit numbers, why do we need it, as long as they have to follow the State's regulations? Henderson - if someone meets the State's regulations for intensive farming, they can do it. The State's regulations are preeminent over ours. Sachar - maybe we should restrict where intensive farming would be allowed. Maybe we should rethink our zoning classifications and zoning districts. Ireland - legally can they say, no more than one animal per acre? Henderson - we can say it. The final argument will be with the Zoning Hearing Board or the courts. Our regulations would not be above the State's. Truitt - is it more feasible to have an odor and noise ordinance? Discussion. Welka's Disposal Letter - still needs to be written. Maintenance Agreement for SFTFs - will take up at the organizational meeting. Bizzarro Mylar - Mr. Bizzarro is subdividing his property on West Stancliff Road near the I-79 bridge. He is retaining parcel A that is 2 acres with 250 ft. of frontage and has an existing billboard. Parcel B is 32 acres with 595.66 ft. of frontage and is being purchased by Daniel Quick, 6065 West Stancliff Road. Ireland moved to accept the Bizzarro Mylar as presented. Henderson seconded. Carried. Mylar was signed. SOLICITOR Western Trail/G. Antolik - Sachar stated that the Supervisors went to look at the road. Discussion on the riprap put in the ditch. Sachar - I'm requesting a letter from Mark Corey on whether Western Trail is approved for take-over. If he gives the okay, I'll vote yes on taking it over. Henderson to Antolik - you're going to give us a copy of the plan you say was previously approved? Antolik answered yes. OLD BUSINESS, CORRESPONDENCE Nothing. NEW BUSINESS RESOLUTION #6-01 Falls Road Bridge #1 Agreement/Authorize David Henderson As Signatory NOW THEREFORE, BE IT RESOLVED that we the Supervisors of Franklin Township, Erie County, Pennsylvania, at a meeting of the Board of Supervisors on November 29, 2001 at the Franklin Township Municipal Building with Board members John J. Sachar, Denver L Ireland, and David G. Henderson present and being empowered to do so, do hereby authorize David G. Henderson, Supervisor/Road Master to act as the Signature Authority for the Township and sign the necessary documents to implement the Falls Road Bridge #1 Replacement Project in cooperation with the Pennsylvania Department of Transportation. Sachar moved to authorize David G. Henderson as Signature Authority as stated in Resolution #6-01. Ireland seconded. Carried. Payoff of TAN - Ireland moved to pay off the 2001 TAN as soon as funds become available. Sachar seconded. Carried. ADJOURN Sachar called the meeting adjourned at 0900 hours. Bonnie J.
