January 31, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0808 hours with the Pledge of Allegiance. Present were Sachar, Jarrett Miller, David Henderson, Gary Truitt and Mary Holt of the BTN. George Antolik arrived at 0810 hours. VISITORS/PUBLIC COMMENT No comments. MINUTES Miller moved to accept the minutes of 1/7/02 as presented. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that some maintenance has been done on the equipment; the predicted ice storm missed us. Agility - nothing. International Cab and Chassis - John will work on an ad. Eureka Road #4 Paving Project - will set up a meeting with Representative Karl Boyes. Henderson - I contacted the fabric dealer and they said we could save some money on gravel with the fabric. Earl at Russell Standard suggested using limestone instead of 2A gravel. It's a superior product and goes through the paver better. I'll run the figures. Sachar - will this project run over a two-year period? Henderson - we'll rebuild the road this year and pave next year. This year will be drainage and pipe work, lay the fabric and gravel. Next will be the final grade, paving, signage etc. Henderson moved to authorize the appropriate bids and advertising for the Eureka Road #4 Paving Project. Sachar seconded. Carried. Elk Creek Boundary Road Agreement - will meet with their Board next week. Safety Study/Route 98 - letter was sent to PennDOT. Falls Road Bridge #1 - Sachar moved to execute the engineering agreement for Falls Road Bridge #1 with Mark J. Corey and Associates. Miller seconded. Carried. FINANCIAL AND TAXES Bills - discussion on various bills. Miller moved to approve the bills as presented. Sachar seconded. Carried. Payroll - Sachar moved to approve payroll #2-02 and #3-02 as presented. Miller seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers, Animal Density/Ordinance #1-02, History Grant, Lights on for Safety, Census Undercount, OTM Bulk Sewer Service - nothing. William Walker Subdivision SFTF - revisions received differ greatly from the original plan. Planning Commission will review. Maintenance Agreement for SFTF's - Erie County Health is revising their decision concerning the maintenance on SFTFs. Henderson - hold off on the third party maintenance agreement. We'll wait for their decision. Recycle Grant Letter - Dave reported that he sent a letter to Rep. Karl Boyes, John Evans and others concerning recycle grants. The State is looking at a big deficit this year. We did respond to Guy McUmber's (DEP) questions. OLD BUSINESS New Computer, Web Site, E-Mail Addresses - Dave reported that the computer will be here soon. The Township web site will be twp.franklin.erie.state.us. The address has been authorized. E-mail can be directed here or to your home. Miller and Sachar prefer that their e-mail come to the Township, not their homes. NEW BUSINESS Exemption Hearing for ESTA - all agreed to let it go as exempt. ECATO Schools - March 7 - all will attend; March 14 - Miller and Sachar will attend; March 21 - all will attend; March 28 - Henderson and Miller will attend. Legislative Update - concerning H.B.#1219/Municipalities Planning Code, the State is trying to do something on this. The Governor directed the legislature to make the bill fairer to municipalities. The big problem with the bill is it limits any municipal response time to 100 days. Some complainants have taken two or three years to put on their case. Discussion. Sachar - it would be an added burden on the courts. Henderson - they want municipalities to have an equal amount of time as the complainant. They are waiting for the bill to come up that fixes the 100-day problem. Edinboro Lake Foundation Grant - a letter of support was sent. SOLICITOR Western Trail/G. Antolik - Mr. Antolik asked how the riprap in the ditch was to be installed. He feels the ditch is handling the water and not washing out. Sachar - according to how and where our engineer instructed. We said we'd take over the road next month and finish the work ourselves per Mark Corey's instructions. Henderson - the riprap is not installed properly. It needs to be installed according to PennDOT publications on the use of riprap. Sachar - we need to go by our Engineer's recommendations. It presents a maintenance problem for mowing, ditching, berm and bank work. Henderson - if you want us to take the road over, we'll take it and fix the problem according to PennDOT publications. Antolik - we all need to meet out there and you can explain how you want it done. If I can't do it the way you want it done, then you can do it. Henderson - you have two choices. You keep the road or we take it over and fix it according to how it is to be done by PennDOT publications or you fix it before we do according to PennDOT publications. Zessinger Pit Agreement - Miller moved to sign and initial the agreement. Sachar seconded. Carried. Agreement was signed. Impact Fee Ordinance, Oshkosh Registration, Nudity Ordinance Comparison - nothing. GMSD EIT Collection Revision - the school district may drop the revisions. Tax Collector as Delinquent Tax Collector - all tax collectors in Erie County must settle by December 31st. This ordinance is not needed in this County because there is no cross over time for duplicates here. Weight Limit Ordinance - the Solicitor's opinion is that we need an engineering study to post on an emergency basis. Mark Corey is going to do a study on a batch basis. Western Trail/G. Antolik continued - Antolik asked what it will cost the Township to repair the road ditch. Sachar - if it's more than what the bond is, we'll foot the bill. If it is less, you'll get the money back. There would be time, labor, materials involved. Antolik - I can agree to that. But if not, I do have a problem. You take over the road up to the cul-de-sac. It's just a temporary turn-around. It is not part of this phase of the subdivision. Henderson - if you're dedicating the road, you dedicate the road and the cul-de- sac. The court order says the cul-de-sac is to be paved. Antolik - I only dedicated a 50-foot right-of-way. I'm not dedicated the cul-de-sac for a public right-of-way. The temporary cul-de-sac was built with 2-RC. Sachar - we'll do more research on this issue. CORRESPONDENCE ECATO Fireman's Dinner - Henderson and Miller will attend along with two fire personnel from FTVFD.
