February 12, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2003 hours with the Pledge of Allegiance. Present were Sachar, Jarrett Miller, David Henderson, Gary Truitt, Cindy Farmer and George and Deborah Antolik. VISITORS/PUBLIC COMMENT Cindy Farmer - I contacted Rep. Karl Boyes to see if any grants were available for repairs to Francis cemetery. I got an application but a municipality not an individual must submit it. Miller - is it matching funds or an outright grant and how much is needed? Farmer - a new sluice is need so vehicles can get in and out. More lots were recently sold. The grant is for $5,000 and I don't have an estimate on costs. Henderson - first you need to decide on what is needed, that would drive the cost. Sachar - we'll need to know what is needed and figure out the match. Farmer - Larry Pieper is vice president of the board. I will ask Earl at Russell Standard if they would do the driveway. Henderson - ask Larry for a detailed plan. Russell Standard could be our match. Sachar - we need a plan for improvements and then see where and how we can accomplish the work. We'll do stage one, the information, so we can figure out the grant application. We'll get input from the cemetery board and anyone else that may be interested. Farmer - I'd be willing to go to companies for donations of work. MINUTES Miller moved to approve the minutes of 1/31/02 as presented. Sachar seconded. Carried. REPORTS Superintendent - Dave reported that more snow is expected tonight. The roads were plowed once since last meeting, some damage was done because they are so soft. Agility - Dave said that he would soon be talking to PennDOT about the agility project for the year. We could make use of a skid steer for cleaning out from under our guide rails. International Cab and Chassis - nothing. Eureka Road #4 Paving Project - Dave said that he is working on the technical aspect of the bids. There has been no word from Karl Boyes. Elk Creek Boundary Agreement - there will most likely be modifications made to the plow routes for next year's winter. Safety Study on Route 98 - a PennDOT letter says that they will do the study within 30 days. Falls Road Bridge #1 - nothing. County Liquid Fuels Application - Henderson moved to apply for funding for 2002 to be used for the Falls Road Bridge #1 engineering. Miller seconded. Carried. FINANCIAL AND TAXES Bills - discussion on the increase in IRS mileage reimbursement. It is set at 36.5 cents per mile for 2002. The bill list included retroactive mileage reimbursement for January 2002. Miller moved to pay the bills as listed totaling $4,753.83 general fund and $81.31 Silverthorn Road Assessment fund. Sachar seconded. Carried. Payroll - Miller moved to approve payroll #4-02 as presented. Henderson seconded. Carried. Warrant Real Estate Tax Collector - Henderson moved to warrant real estate tax collector, June Shelhamer, for $81,860.85 for the year 2002. Miller seconded. Carried. Delinquent Tax Collection Ordinance - PSATS sent a sample ordinance but it is not needed in Erie County. Tax collectors must settle on January 15th and are not allowed to collect any taxes between the deadline of 12/31 and January 15th. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes - reviewed. Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers, Ordinance #1-02, History Grant, Lights on for Safety, Census Undercount - nothing. William Walker SFTF/Silverthorn Road - the revised sketch and narrative was reviewed. The SFTF is now on a separate 4.17-acre parcel, lot #4, which will be dedicated to the homeowners association consisting of lots 1, 2, and 3. Mr. Walker reserves the residue of 58 acres for future development. Henderson - a homeowners association is quite common elsewhere and is written into the deeds. Miller - what would be agreed upon for maintenance? Sachar questioned section L on the agreement. Henderson - the assumption is that the system won't be abandoned if it is used. It could be if there was a change in the type of system used or if sewer lines are installed. Henderson moved to approve the agreement between Franklin Township and William Walker for a small flow treatment facility upon receipt of an escrow check for $1,000 and any other required documents. Miller seconded. Carried. OTM Bulk Sewer Service Agreement with Washington Township - the Township has received a verbal request from OTM. Dave replied listing all the requirements that include doing a small flow treatment plan so that there would be no change to our 537 Plan. The plan is modified by default by a SFTF. Miller - OTM is paying all the costs? Henderson - yes, the agreement is between Washington Township and OTM. They are paying for the extension of the line from Obed Heights. Miller moved to send a letter of request to Washington Township to service OTM with sewage service from their lines. Henderson seconded. Carried. Recycle Grant - no word from Guy McUmber at DEP. The second issue on recycling is a bill before the legislature to eliminate a municipality's ability to license waste haulers. The Township wouldn't be able to limit the weight going over the roads in the spring or the number of trips up and down the roads. DEP will do the licensing but they don't care about soft roads. George Antolik - you are allowed to make one-time local deliveries. Henderson - if we want to prohibit that we can. Miller - there is bill that would impose an extra $2.00 tax for haulers, one dollar is to go for recycling and the other dollar is for the Growing Greener program if it passes. Henderson moved to send our legislators a letter requesting that they retain waste hauler licensing privileges for municipalities. Miller seconded. Carried. Thank-You to Evelyn Keiper - Ms. Keiper personally removed some carpet debris that was illegally dumped on Francis Road prior to the Township crew's arrival to take care of it. A thank-you letter will be sent. SOLICITOR Western Trail/G. Antolik - Board reviewed a ditch sketch and an opinion letter from Attorney Schroeck concerning Western Trail. Copies of both were given to Mr. Antolik. Sachar read from the PennDOT regulations for adding a road to the Liquid Fuels list. Western Trail meets the criteria in length and because it has a cul-de-sac. Deborah Antolik - no, it is not a cul-de-sac, it is a temporary turn-around. Sachar - the State guidelines say it must have a cul-de-sac to meet the liquid fuels requirements. Will we be able to accept the road for liquid fuels if there is no cul-de-sac? Henderson and Miller - no. Sachar - will the State allow us to get liquid fuels with no cul-de-sac? G. Antolik - if the State calls it a cul-de-sac, fine, it is built with a 12-inch base. Sachar - an opinion letter from our Attorney says the court order says the cul-de- sac must be paved. Mr. and Mrs. Antolik loudly and in length stated their disagreement with the court's order saying that they did not have to abide by it. Henderson - it's your road, George, do what you want. D. Antolik - the judge signed the court order that was written by your Solicitor. Sachar - was the road built before the lots were sold? G. Antolik - yes, but it was not paved. Henderson - we would not approve the subdivision without an escrow of $12,000 from the purchase price of the first lot. Sachar - the State regulations for liquid fuels says the road has to have a cul-de- sac. G. Antolik - that court order means nothing. It was a temporary turn-around. Your engineer informed Bozza incorrectly. Sachar - the court gave you a two-year time limit for starting the next phase of development, that wasn't done. Henderson - we're under no obligation to take over that road at any time. Mr. Antolik did not agree to Franklin Township taking over Western Trail as per the minutes of January 7, 2002.
