March 12, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2003 hours with the Pledge of Allegiance. Present were Sachar, David Henderson, Gary Truitt and Mary Crane. Supervisor Jarrett Miller was absent due to a previous commitment. Chairman Sachar announced that an executive session was held to discuss legal matters with the Township Attorney. VISITORS/PUBLIC COMMENT Mary Crane asked for information on Western Trail and said that the neighbors want the Township to take over the road, as it would affect their property value if it remains a private road. Crane - was the turn-around a part of the subdivision? Was it to be paved? Henderson - it was a temporary turn-around so the subdivision could be extended. The time is up on the subdivision plans. The Judge gave Mr. Antolik two years to extend the subdivision or he would have to pave the cul-de-sac. He didn't do it. Sachar - PennDOT says the cul-de-sac must be part of the road and Judge Bozza said it must be paved. Henderson - he had until November of 2001 to pave the cul-de-sac. Sachar - we were willing to work with him. He says the cul-de-sac is not part of the road. Crane - can we get legal help to prevent him from getting his bond money back? Henderson - the best he'll get back is $1,100. The rest is under court order. The road can remain a private road/public right-of-way. A lot of exclusive subdivisions in Erie County are that way. He thinks by paving it, he will lose a lot of money if he extends his subdivision. Crane - the Township set a precedent, you're letting him get away with this. Henderson - that's not the case. The Subdivision Ordinance requires the road to be built and paved a certain way. He is now saying he'll keep it a private road. Crane - how much would it cost to pave the cul-de-sac? Can the neighbors push the Township into taking it? Henderson - the law is specific, if the neighbors bring a petition to the court, they are then on the hook. If he paves the cul-de-sac by early summer, then he has satisfied our requirements except for the ditch. Sachar - we're waiting. Crane - can we be apprised of the situation before he gets his bond money back? Board answered yes. MINUTES Henderson moved to approve the minutes of 2/28/02 as presented. Sachar seconded. Carried. George Antolik arrived at 2015 hours. REPORTS Superintendent - Dave reported that we received 13 inches of snow. Crew did one plow round and did damage to the soft roads. There was no significant snowfall over the weekend. There are a number of soft spots and roads were posted for 10-ton. The new spreader was installed on truck #6. It is set up for spreading cinders stone also. Agility - Dave reported that a meeting with George Backo of PennDOT would be held on Thursday. We will ask about using their skid-steer on Eureka #4 for trenching. We can also ask to use it for cleaning under guide rail. There may be money left banked that could be used for seal coat. International Engine - the ads are in, picture taken, bids are due April 25th. Eureka Road #4 Paving Project - bids are out for sub base and Geotextile. They are due back by March 28th. The likely bidders for sub base are Russell Standard, Hoover Sand and Gravel and Showman and Sons. Henderson - Gerry Rafeew suggested a change to the plan. Should someone sell a lot with no existing structure on it and build a home, that lot would be assessed to defray the charge to the other assessed property owners. Discussion. One question with this change is that there should be depreciation values of the assessment if the lot is sold near the end of the assessment period. There should be a depreciation factor involved. Sachar - when would the property not be assessed? Henderson - either at the end of the financing period of 10 years or after the end of the last payment on the last lien. That could be as short as 5 years or more than 15 years. The line is drawn at the end of the neighborhood improvement period. The Township has no authority after that. The neighbors can reassess themselves for other things but we can't. The assessment only applies to properties that were not originally assessed. Any original assessment will not be reassessed. The other assessed property owners would get a refund if this happened. Discussion. Sachar - the final plan has not been approved. Henderson - right. The final vote will be in April. Safety Study/Route 98 - waiting. Falls Road Bridge #1 - nothing. What Roads to Put Stone On - there is enough money for 40 10-ton loads of #67 crushed limestone. Suggested roads with slimy spots included New west, Silverthorn north and Clair Wright. Sachar - use your best judgment. FINANCIAL AND TAXES Bills - Henderson moved to pay the bills as listed totaling $7,272.31 general fund. Sachar seconded. Carried. Payroll - Henderson moved to approve payroll #6-02 as presented. Sachar seconded. Carried. Henderson stated that when he applied for updated virus protection, the company charged an extra $20 because we would send a check instead of using a credit card. He suggested that the Township set up a separate petty cash fund with a $500 limit and a debit card. If more funds would be needed for a purchase, the purchase would be paid for by check. Sachar - where is the accountability? I don't see where it's listed. Discussion. Henderson - you approve it in total, not in detail each month. The same way you approve petty cash. The account is subject to audit, same as the other funds. Sachar moved to approve the establishment of a separate petty cash fund with a check card and a limit of $500. Henderson seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes - reviewed. It was noted that the proposed Christine (Trimble) Hauser subdivision would be approved even though it is not a conforming use. The property on Silverthorn Road has two houses on one lot that predate the zoning ordinance. Francis Cemetery Improvements - Russell Standard submitted a quote for improvements totaling $11,908. The Township will work up a quote for the installation of driveway pipes. Both quotes will be used to apply for a grant. Discussion. Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers, Ordinance #1-02, History Grant, Lights on for Safety, Census Undercount, OTM Bulk Sewer, Recycling Grant - nothing. SOLICITOR Impact Fee Ordinance, Oshkosh Registration, Nudity Ordinance Comparison, EIT Collection Revisions - nothing. OLD BUSINESS Walker SFTF - waiting for signed agreement, escrow check and proof-of- publication from Mr. Walker. NEW BUSINESS PA Chamber Tort Issue - reform to the joint and several liability law is being sought. Discussion was held on several case scenarios involving stop signs. Sachar moved to support joint and several liability tort reform. Henderson seconded. Carried. C3 Economic Development Initiative - County Executive Rick Schenker has stated that there will be no regionalization of government in Erie County. C3 will work on economic development and a consultant has been hired. They are suggesting strategy sessions that focus on economic development with various focus groups. The local focus group will include Franklin Township, Washington Township, McKean Township, Edinboro Borough and McKean Borough, meeting date and time to be determined. CORRESPONDENCE Reviewed.
