May 14, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Vice Chairman Jarrett Miller at 2000 hours with the Pledge of Allegiance. Present were Miller, David Henderson and Gary Truitt. Supervisor John Sachar was out of town on business. VISITORS/PUBLIC COMMENT No comments. MINUTES The minutes of 4/18 and 4/25 were tabled until next meeting when Sachar will be in attendance. REPORTS Superintendent – Dave reported that some grading was done on the northeast corner of the Township. No other roadwork has been done due to the heavy rains. Crew has been working on equipment. Crew will be on lay-off the week of Memorial Day. Agility, Falls Road Bridge #1 – nothing. International Motor – second bid opening is scheduled for 5/30. If no one bids, we will try to find a purchaser through word-of-mouth. Eureka Road #4 Paving Project – objection period ends June 4th at 2 p.m. Safety Study/Route 98 – no written report received. PennDOT may be waiting until Elk Creek Township approves the strobes that will be installed at Route 98 and Route 6N. Gravel from Route 98 Berm Work – we have received 2040 yards so far. It was put down on Mohawk and Clair Wright roads. Work will start again on May 15th. Dave reported that we had been splitting the gravel with Russell Standard for trucking but will stop that and take some for stockpiling at the Township building and pay for trucking. This ends up cheaper than buying gravel and paying for the trucking. Gravel and trucking for the stockpile is in the budget. Oil on Fry Road – work was done last Friday. Because of the heavy rains over the weekend, the oil never set up. Washington Township is putting another line of stone down the center in an effort to dry up the oil. The road will be closed tonight, (14th) and will be rolled tomorrow (15th). Lots of complaints for oil on cars have been received. We have been giving those who complain a quart of citrus cleaner to use on their vehicles. FINANCIAL AND TAXES Bills – bill list was reviewed. Miller moved to approve the bills for payment as listed totaling $8,749.09 General Fund; $3,505.60 State Motor Fund. Henderson seconded. Carried. Payroll – Henderson moved to approve payroll #10-02 as presented. Miller seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – reviewed. Update Comprehensive Plan – we received a draft from Joyce Berry for what she was assigned to write. It will be compiled with the sections that Henderson wrote and a total draft will be available for review. Industrial Park/KOZ – Dave reported on a meeting he had with representatives from Edinboro University and county industrial development personnel. They discussed the animation department at EUP. The idea is to get those who have been trained here to stay here to work and to hopefully locate within the KOZ. Recent graduates will be surveyed for ideas to create a way to keep students here. Once the survey is analyzed, those involved will have an idea on how to proceed with this issue. Storage Trailers, Lights on for Safety, Census Undercount, OTM Bulk Sewer Service Agreement, SFTF Maintenance Agreement, Recycle Grant – nothing. History Grant – we should hear something by the first of June or when the State sets their budget. Francis Cemetery Repairs – we received a nice letter of support from Senator Jane Earll. Public Assembly Permit for Bar None Festival and Rodeo – Henderson moved to approve the public assembly permit for the Bar None Festival on June 22, 23; 29, 30 and the Bar None ATV Rodeo on July 6. Miller seconded. Carried. A copy of the application will be mailed to Washington Township. Letters/Junk Vehicles, Car Parts Etc. – Miller presented a report on several locations that he received complaints on. Several other locations were added to his list. The Board will drive the Township and those properties noted will receive a letter concerning their ordinance violations. Permitted Sign Fee – Henderson moved to set the permit fee for a sign required to have a permit at $10. Miller seconded. Carried. No inspection fee is needed so the permit fee is reduced. Conditional Use Request/James E. McKenrick – Mr. McKenrick is requesting a conditional use permit for a residence in a B-1 zone. He currently has a mobile home at 7460 Old State Road and would like to remove it and replace it with a doublewide mobile home. Henderson moved to advertise and hold a hearing on the request on June 11 at 8:00 p.m. Miller seconded. Carried. SOLICITOR GMSD EIT Collection Revisions – nothing. OLD BUSINESS William Walker SFTF – signed agreement and escrow check were received. Henderson moved to sign the maintenance agreement for the William Walker SFTF and to adopt Resolution #2-02. Miller seconded. Carried. Agreement was signed. RESOLUTION #2-02 RESOLUTION FOR PLAN REVISION AND FOR NEW LAND DEVELOPMENT Resolution of the Supervisors of Franklin Township, Erie County, Pennsylvania (hereinafter "the municipality"). WHEREAS Section 5 of the Act of January 24, 1966, P.L. 1537, known as the Sewage Facilities Act", as Amended, and the rules and Regulations of the Pennsylvania Department of Environmental Protection (Department) adopted thereunder, Chapter 71 of title 25 of the Pennsylvania code, require the municipality to adopt an Official Sewage Facilities Pan providing for sewage service adequate to prevent contamination of waters of the Commonwealth and/or environmental health hazards from sewage wastes, and to revise said plan whenever it is necessary to determine whether a proposed method of sewage disposal for a new land development conforms to a comprehensive program of pollution control and water quality management, and WHEREAS William E. Walker has proposed the development of a parcel of land identified as William E. Walker, and described in the attached Sewage Facilities Planning Module, and proposes that such subdivision be served by: new treatment facility. WHEREAS, Franklin Township finds that the subdivision described in the attached Sewage Facilities Planning Module conforms to applicable sewage related zoning and other sewage related municipal ordinances and plans, and to a comprehensive program of pollution control and water quality management. NOW, THEREFORE, BE IT RESOLVED that the Supervisors of the Township of Franklin hereby adopt and submit to the Department of Environmental Protection for its approval as a revision to the "Official Sewage Facilities Plan" of the municipality the above referenced Sewage Facilities Planning Module which is attached hereto. Web Site – still some work to do on it. Triathlon/June 1st - proof of insurance received. Letter sent. NEW BUSINESS Letter from the Erie County Humane Organization – letter asks for support. No action taken. Miller – I would not be in favor of a yearly contract. William Dunegan Mylar – Mr. Dunegan, #22-12-29-1, is selling a strip of land, Lot 2, which has 107.92 ft. of frontage by 1,614.78 ft. deep on Route 98. Lot 2 is 4.09 acres. The land is to be conveyed to Daniel Magee on Crane Road, #22- 12-29-1.03. Lot 1 will retain 38.74 acres. Henderson moved to accept the Dunegan Mylar as presented. Miller seconded. Carried. Mylar was signed. Newsletter – discussion was held on the cost of putting out a newsletter and on the possibility of getting local businesses to offset the cost through advertising.
