June 11, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2000 hours with the Pledge of Allegiance. Present were Sachar, Jarrett Miller, David Henderson, Gary Truitt and Terry Rea representing Bill Smith. CONDITIONAL USE HEARING: JAMES MCKENRICK, 7460 OLD STATE ROAD/RESIDENCE IN B-1 ZONE, 2001 HOURS Chairman Sachar asked for comments on the request. No comments. Henderson moved to grant the conditional use request of James McKenrick for a residence in a B-1 zone. Miller seconded. Carried. VISITORS/PUBLIC COMMENT William Smith Mylar – Mr. Smith is subdividing property on Crane Road. Lot 1 will have 285 ft. of frontage and 11.5 acres. Lot 2 will have 350 ft. of frontage and 13.68 acres. The residue, Lot 3, will have 26.49 acres including a 50-foot right-of-way on the east boundary of Lot 1. Lot 3 includes the buildings known as Makco Manufacturing, 6020 Crane Road. Lots 1 and 2 are on the west side of Roberts Rental Center, 6050 Crane Road. The Township received a letter from Erie County Planning explaining that the discrepancies noted in the Planning Commission minutes of 6/4/02 were corrected by connecting and making a part of Lot 3 the 50' right-of-way (.47 acres). At a future date, Makco Manufacturing will be subdivided from the property to the rear of the buildings. The right-of-way will give access to that rear parcel. Henderson moved to accept the Smith Mylar as presented. Miller seconded. Carried. Mylar was signed. Discussion was held on the 2000 Census Data report. MINUTES Miller moved to accept the minutes of 5/30/02 as presented. Henderson seconded. Carried. REPORTS Superintendent – Dave reported that the crew is back from vacation. The road oiling is done; some grading has been done. He feels that the work schedule is three weeks behind due to the weather. The Eureka Road #4 paving project was approved, 75% for/25% against. Work on the project will begin the end of next week or the beginning of the following week. The 1-ton needs brakes and is being worked on. The tanker's exhaust manifold is broken and the repair job will be hired done. Sachar – it could be out of service for a full day for repairs. The diesel engine that we have for sale will be taken to Keystone Diesel's shop in an effort to sell it. Agility – PennDOT mowing is currently underway. Route 98 is done and Old State and Crane are nearly completed. When done, Rick J. will begin mowing Township roads. Eureka Road #4 Paving Project Bid Awards – discussion on the bid analysis sheet prepared by Henderson. It includes COG bid prices for Geotextile fabric. Henderson – we should take Russell Standard up on their offer of Geotextile installation. After talking with Mark Corey we can eliminate considering using the 15 ft. wide fabric. He says the 12.5 ft. fabric will work fine. Discussion on which type of fabric and aggregate to use. Henderson – Corey recommends using the 4C fabric; the question is do we use 2A gravel or limestone. Corey says the difference is not significant enough to warrant buying the limestone. The 2A material would meet PennDOT specifications. We have two separate opinions that say 2A is just as good as limestone. Also we are using ID pavement, a hot mix, which is better than what was used on Silverthorn. Sachar – you'd never know if the fabric, gravel or the road base underneath failed, if it does, to warrant the extra cost. Are we thinking of using calcium chloride with the gravel? Henderson – not intentionally but between the time we lay the gravel and pave, it will be brined to hold the dust down. It will settle over winter before the paving is done. Henderson moved to award Russell Standard Corp. the bid for 2A gravel with Geotextile installation with a bid price of $96,860. Miller seconded. Carried. Henderson moved to award the Geotextile fabric bid for 4C fabric 12.5 ft. wide rolls, 17,500 sq. yards to Chemung Supply at the COG bid price of $23,537.50. Miller seconded. Carried. Dave said that a tamper would be needed for the Eureka paving project. We rent one each year at a cost of several hundred dollars a week. We will need one for at least 3 weeks this summer. Cost would equate to half the cost of a newer used model. Sachar – can you borrow one from PennDOT? Henderson – on this project I could see doing that but on most projects we need one at the spur of the moment. We use it for cross-pipes. For an extended project, it makes sense to look at purchasing one. I'll check with PennDOT and neighboring municipalities. We sent a letter to the residents on Eureka that the project was approved. Our Attorney has to do up an ordinance and establish an authority. We are borrowing the money to pay the contractors. PNC sent us paperwork today but it needs to be adjusted to simple interest with a yearly payment. It also includes a prepayment penalty. Discussion on how to avoid a penalty. Miller – check with other banks to see if they have the prepayment penalty also. Sachar – can we get other quotes and accept the best offer? Henderson moved to authorize the adoption of the Eureka Road #4 Paving Project ordinance, the signing of all necessary documents, the acceptance of the proposal from a bank with the best rates and the advertising of the sale of the loan. Sachar seconded. Carried. Street Light at Crane and Route 98 – Dave reported that he called PennDOT about the placement of a pole at that intersection. They will determine the best location and then we will contact Northwestern RECA. Falls Road Bridge #1 – nothing. Cinders/August Week – Waterford Township will take our August week of cinders. FINANCIAL AND TAXES Bills – discussion on the bill from Washington Township for Fry Road. Dave said the invoice was $1,000 more than expected but they oiled and chipped the intersection of Fry and West Stancliff. Miller moved to pay the bills as listed totaling $6,512.58 general fund, $4,748.71 state fund, $9,065.15 EIT fund. Sachar seconded. Carried. Washington Township will patch the potholes on our section of Fry. Payroll – Sachar moved to approve payroll #12-02 as presented. Miller seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – a commission member is needed to represent the Township on the combined regional planning commission with Washington Twp. and Edinboro Borough. In general one is needed from each Board and one from each planning commission. Discussion on the memo from Graney and Associates concerning the LUPTAP grant (a planning assistance grant). A second grant would be sought to write new zoning and subdivision ordinances. Cost is estimated at $3,000 for our comprehensive plan, the same as the others involved. The total cost needed from our 2003 budget should be $1,800 instead of $6,000 that was originally estimated. Sachar – nothing has changed much, our comprehensive plan still embodies the original ideas and wishes for a rural character with controlled growth. Henderson – it just needs updated because of recent legislations. Industrial Park/KOZ, Storage Trailers, History Grant, Census Undercount, OTM Bulk Sewer Service, Maintenance Agreement for SFTF – nothing. Recycle Grant – we have been approved for a 2-year grant of $8,900. It can be used for newsletters, advertising, little blue recycle containers, compost bins and nothing else. Henderson – that means no Recycle Day, no Freon collection, no oil and antifreeze collection, no junk cars, no tires, no white goods collection, etc. Washington Township will receive a grant of almost ½ million dollars for drop-off recycle bins and a truck to haul the material collected to West Mead Township's collection center. DEP dropped all recycle day programs. Francis Cemetery – waiting for news about the grant application. Mrs. Laura Schultz of 4151 Station Road, North East, PA researched the civil war veterans buried in the Francis Cemetery and had a headstone in scripted with their names and erected at the cemetery. She also landscaped around the stone. A thank you letter will be sent to her in appreciation of her time and donation. Letters/Junk and Junk Vehicles – Miller presented a list of junk items on property owned by Paul and Janice Bizzarro on West Stancliff Road. It includes more than 1,200 tires. A ride-by of the Township will be held on Thursday, June 20th. SOLICITOR Animal Density – the Township needs a reading by the Solicitor concerning a new law passed that protects farmers and farms. Discussion. OLD BUSINESS Newsletter – Dave is collecting ideas for the newsletter. Resolution #3-02/Emergency Operations Plan – waiting for all to read the proposed plan. NEW BUSINESS None. CORRESPONDENCE Edinboro Borough/Food Bank Cost Sharing – the letter received from the Borough says that 14 residents of Franklin Township use the Food Bank, 9% of the total usage. Henderson – the Borough is looking for reimbursement for a non-existent expense. They don't charge the Food Bank for the use of their building. The discussion last year was that the Food Bank was moving and would pay rent at their new location. This is a good example of why we need regional discussions on this type of issue. Lets wait and see how this shakes out with Washington Township. This payment would not go to the Food Bank; it would go to Edinboro Borough. Sachar – government does not contribute to the Food Bank, it's volunteer. Miller – this is asking us to support the Borough, not the Food Bank. Sachar - no action taken on this issue. This is not congruent to our philosophy of government. Sachar - If we're concerned about recycling, next year we could budget for it. The market for scrap metal in Youngstown is good. Henderson – the big cost is for Freon removal and used oil and antifreeze collection.
