August 13, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2004 hours with the Pledge of Allegiance. Present were Sachar, Jarrett Miller, David Henderson and Gary Truitt. VISITORS/PUBLIC COMMENT No comments. MINUTES Miller moved to accept the minutes of 7/25/02 as corrected. Henderson seconded. Carried. REPORTS Superintendent – Dave reported that some grading was done on Silverthorn north and West Stancliff. Mowing is ongoing and the crew finished the prep work for the EU4 project. Agility, Diesel Engine, Light at the Intersection of Crane and Rt. 98 – nothing. Eureka Road #4 Paving Project – Dave reported that the work is on schedule. The Geotextile fabric was delivered on the 12th. The entrance onto Crane was excavated on the 12th. Fabric was laid on the 13th. The project is going well. Falls Road Bridge #1 – nothing new to report. Will ask for an engineering bill to date. FINANCIAL AND TAXES Bills – the bill for the ram for truck #5 was much less than expected. Two knife disks were made by Gehrlein Welding for the mower. Sachar moved to approve the bills for payment as listed totaling $4,131.27 general fund; $2,546.01 state fund. Miller seconded. Carried. Payroll – Miller moved to approve payroll #16-02 as presented. Sachar seconded. Carried. EIT Year-End Report – the year-end report showed $15,000 less was received for the 2001-2002 fiscal year. Discussion on the problems between Millcreek Township and the City of Erie. PLANNING, ZONING, RECREATION, SAFETY, SANIATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – no quorum for the August meeting. Update Comprehensive Plan/Regional Planning Commission – the members present at the Planning Commission meeting suggested numerous changes to the propose by-laws for the Regional Planning Commission. The Board will review the latest draft. Henderson – wasteland is generally accounted for in a Comprehensive Plan. Riparian buffers can change; there is no hard and fast rule for a maximum. Discussion on the funding formula used. Sachar – if this formula is a problem or a stickler, perhaps it should be an even three way split between the municipalities. Sachar moved to advertise Ordinance #2-02, an Ordinance authorizing the creation of the Edinboro Regional Planning Commission with a hearing date and time to be determined. Miller seconded. Carried. Henderson – the ordinance does not include the funding formula. Industrial Park/KOZ – discussion on County Council's proposed action on LERTA designations. History Grant – discussion on entering into an agreement with EUP for their assistance with the history grant project. Sachar moved to approve signing the agreement for services with Edinboro University. Henderson seconded. Carried. Storage Trailers, Census Undercount, OTM Bulk Sewer Agreement, Maintenance Agreement for SFTF – nothing. Francis Cemetery Grant Application – the reapplication for a grant is in progress. Junk Car Letters – we received several responses to letters sent. Dave reported that the State passed a law making it much more stringent to dispose of tires. The cost for recycling them will go way up. Sachar – will this increase moonlight dumping? This will probably make it mandatory to charge a recycle fee for each tire sold. Board will do another drive-by checking for junk vehicles in October. Recycle Survey – will review the surveys already returned. The County is doing a recycle survey and would like a copy of our road list. Sachar – sent them the results of our survey. Henderson – it would be best if they used the tax rolls; that is the most accurate. We can send them a residential mailing list. Miller – if you want the results from more than 50 residents, you would have to pay for the extra surveys sent. Miller and Sachar said they were not willing to pay for any extra surveys. SOLICITOR EIT Collection Revisions – waiting for the tax collector's opinion. Animal Density Ordinance, Verizon DSL, Western Trail – nothing. OLD BUSINESS Guiderail at Falls and Francis – hearing date is September 3rd at 11 a.m. in front of District Justice Stuck. Political Signs – nothing. Resolution #5-02, EOP – Board signed the previously approved Resolution #5- 02 for the updated Emergency Operations Plan. NEW BUSINESS Amendment to Subdivision Ordinance – discussion on reinstating the 11 to 1 land development ratio. Without the reinstatement, we have to abide by the County's 4 to 1 ratio. Henderson – as long as we have side yard and front and rear set backs, do we need it? Either reinstate the 11 to 1 ratio or eliminate a ratio altogether. Take the 4 to 1 out of our version of the Subdivision Ordinance. Our Zoning Ordinance would take effect. You could conceivably have a lot 250 ft. wide by 1.67 miles long. Sachar – mostly they would be a half-mile deep. Henderson – the 11 to 1 ratio has a side benefit of long properties with lots of green space at the rear. It minimizes development. Four to one ratio creates short fat lots with more development and more roads and less green space. If we eliminate the ratio, a lot has to have 250 ft. frontage and we don't care how deep. I can't see a disadvantage to eliminating the ratio. We allow flag lots. Sachar – I can't see a problem with eliminating the ratio. Henderson moved to create an Ordinance that would eliminate Section 807.1 of the Subdivision Ordinance and authorize advertising for a hearing to be held September 10th at 8 p.m. Sachar seconded. Carried. EMTA/Lift – a letter received from EMTA requests support for their application for funding. Henderson – they are not asking for money, just for political support. Sachar moved to send EMTA/Lift a letter of support. Henderson seconded. Carried. CORRESPONDENCE Thanks - a letter of thanks was read from Waterford Township for the cinders they received from Franklin Township's summer week. Erie County Humane Organization – a letter was received asking for support. The cost for several quarantine cases for cats was cited. Henderson – the people that wanted the cats quarantined should be footing the bill. Headwaters Conservation Park Open House – Jarrett is chairman for the event sponsored by the Erie County Conservation District. Dave and John will attend the open house on August 23rd from 10 to 3.
