August 29, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0807 hours with the Pledge of Allegiance. Present were Sachar, Jarrett Miller, David Henderson, Gary Truitt, Bill Smith and Mary Holt/BTN. VISITORS/PUBLIC COMMENT William Smith Mylar – Mr. Smith is subdividing his property at 6020 Crane into two parcels. Lot 4 will have 25.73 acres with 50 ft. of frontage on Crane. Lot 3 (previously subdivided) becomes part of Lot 4. Lot 5 has the existing buildings of Makco Manufacturing and will have 3.61 acres with 309.46 ft. of frontage on Crane. Miller moved to approve the Smith Mylar as presented. Sachar seconded. Carried. Mylar was signed. Mr. Smith left the meeting at 0815 hours. MINUTES Miller moved to approve the minutes of 8/13/02 as presented. Henderson seconded. Carried. REPORTS Superintendent – Dave reported that after the Eureka Road #4 project was completed by Russell Standard, our crew did some finish work, riprap and ditching. A cross pipe on Silverthorn south of Old State is being replaced. Crew is starting on dry hydrants. One is being installed at Dave's Pond on Eureka. Special order pipe and supplies were ordered for a hydrant at Cindy Farmer's property along Old State and now she is having second thoughts. Grading will be done if we get some rain; brine is in limited supply. The one-ton will be taken to Hallman Ford for inspection. Diesel Engine – will take to Keystone Diesel for them to try to sell it. Eureka Road #4 Paving Project – Russell Standard completed the subbase on Friday. There is a defect on the surface. The material is separating. Dave reported that he has talked to several engineers about the problem. Of concern is the fabric underneath. PennDOT's techs will come in September and run compaction rates and see what the separation factor is and how it will affect the pavement. Sachar – what's underneath isn't the problem; you'll lose stone over winter. Henderson – we could lightly mix the surface late in the season and re-roll it. We will also crown it. Next season we can do it again in the spring. When the successful bidder prepares it for paving they will re-roll it and shape the surface. In future years the material underneath will move and squash and the road will have depressions. That is what the compaction gauges will show. Sachar – the problem areas seem to be mostly by the berms. Henderson – we could go as low as 5 inches in a re-mix but we can't snag the fabric or we're in trouble. Intersection Light at Crane and Rt. 98 – nothing. Falls Road Bridge #1 – we received the first engineering bill from Mark Corey. FINANCIAL AND TAXES Bills – will hold the bill from Mark J. Corey and Associates for $11,717.93 until we receive reimbursement from the State. Once the bill is paid we can claim our reimbursement from County Liquid Fuels. Sachar moved to pay the bills as listed totaling $3,990.27 general fund; $1,348.42 state fund; $24,508.80 permanent improvement fund; $2,978.00 EIT fund. Miller seconded. Carried. Payroll – Miller moved to approve payroll #18-02 as presented. Henderson seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Industrial Park/KOZ, Storage Trailers, Census Undercount, OTM Bulk Sewer Agreement, Maintenance Agreement/SFTF, Junk Car Letters – nothing. Regional Planning Commission By-Laws – on hold. There is a technical question on the number of members. We are awaiting clarification by the State. The MPC says the make-up is to be 5 members total. That would mean unequal representation with three municipalities involved. History Grant – the contract was signed and returned. EUP is back in session. Dave said he would call next week and see if they have a graduate student in mind to work on the project. We would like to capture information from several of our residents that are in poor health before the grant period begins. Francis Cemetery Repairs Grant – waiting for news on our application. Recycle Survey – Dave reported that he e-mailed our road list to Strategy Solutions at their request. We are still receiving our survey forms that were mailed with the newsletter. SOLICITOR GMSD EIT Collection Revisions – the tax collector gave her verbal approval. Animal Density – nothing. Western Trail/G. Antolik – a letter from Mr. Antolik's attorney, Michael Agresti, states that Mr. Antolik wants to keep Western Trail as a private road. Sachar – what is he doing with the cul-de-sac? Schroeck – it is my understanding that he will keep plowing the road. The residents are happy with him plowing it. My understanding is that he will not pave the cul-de-sac. Henderson – the Subdivision Ordinance says it must be paved whether it is a public or private road. Sachar – it must be paved whether he does it or we do it. Henderson – he has not filed any paperwork for an extension. Judge Bozza's order included paving the cul-de-sac. Schroeck – if you go in and pave it, you should tell them that is what you plan on doing. Tell him you are going to pave it by such and such a date. Henderson – we will give Mr. Antolik plenty of notice. I see the cul-de-sac and the private road as two issues. The Judge's order is pretty clear on this issue of the cul-de-sac. October 31st is PennDOT's last paving date. We can set the date of October 9th to do the work. Sachar – send Attorney Agresti a letter saying that George has to have the cul- de-sac paved by October 7th or we will pave it by October 9th using the bond money and it's immaterial if the road remains a private road. Henderson – if we get to the point of the road remaining private, we should consult in writing with the residents. Miller – is there a homeowner's association for that road? If something happens to Mr. Antolik, who will take care of the road? Henderson – the owners of the properties abutting the road would have to petition us to take it over. They must bring it up to Township specs and we must take it over according to the MPC. Miller – if something happened to George, we could be going through this all over again unless there was a homeowner's association. Henderson moved to authorize the Solicitor to send a letter to Attorney Agresti. Sachar seconded. Carried. Verizon – Attorney Schroeck said that Verizon's position is that they have never been billed. They do not pay a toll tax. A bill should be sent. Henderson – the PUC does not put the responsibility on the township. It puts it on the utility to pay the township. When Coaxial Cable wanted to put cable in, they came to us. We can ask the PUC consumer advocate. Schroeck – in their PUC filings, they probably factored in a rate schedule. Sachar – follow up on it. OLD BUSINESS Guiderail at Falls and Francis – hearing is 9/3/02 at 11 a.m. at D.J. Stuck's. Political Signs – nothing. Amendment to Subdivision Ordinance/Eliminate Ratio – hearing is 9/10/02 at 8 p.m. EOP – Dave said that he would respond to the comments made by the EMS office to our emergency operations plan. RESOLUTION #6-02 WHEREAS it is in the best interests of the tax payer to have a uniform system of earned income and net profit tax collection; WHEREAS the General McLane School District has proposed earned income and net profit rules and regulations that would be uniformly adopted by the municipalities within the General McLane School District; AND WHEREAS Franklin Township has not previously adopted rules and regulations governing earned income and net profit collections; NOW THEREFORE BE IT RESOLVED that the Board of Supervisors of Franklin Township in accordance with Act 511, Section 13, Part V, Subsection (c) adopts the attached rules and regulations to govern the administration of the Earned Income Tax Resolution as adopted by the General McLane School District. Adopted this 29th day of August 2002. Henderson moved to adopt Resolution #6-02, Miller seconded. Carried. CORRESPONDENCE Discussion on the State Wide Building Code. The federal government told the remaining states without a code that they wouldn't get any more FEMA money if they didn't adopt it.
